The purpose of this letter is to detail the proposed sewage disposal system for the Waste Connections project
in Weld County. The development is proposing a septic system and leach field that will lie to the east of the
proposed building in a location that will be free of utilities, landscape amenities or pavement. The site has
been also designed to ensure there is adequate setback from the proposed detention pond.
Based on a previous phone conversation I had with Katie Sall, this approach was deemed appropriate and no
further information beyond a description was required for this application. A full septic and leach field design
will be provided in the future.

I apologize for the short noticed attempt at a conference call last week. The Waste Connections
folks were available and wanted me to try and set something up.
I wanted to give you an update on where we are and see what you needed from us to move the USR
forward. Our planned approach for water now is to obtain potable water from an existing well
located at the landfill facility. This water would be pumped directly to the facility without storage.
Non -potable water would be stored in a tank onsite (this water would also come from the well). The
idea here is to avoid the cistern requirements previously discussed.
If you could, let me know what information we would need to provide to satisfy the USR application
request, I will make sure we are heading in the correct direction.

1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the permit does
not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested water right
from seeking relief in a civil court action.
2) The construction of this well shall be In compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a
variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in
accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(4) and the findings oftheState Engineer dated i M P\
4) This well shall be constructed at least 600 feet from any existing well completed In the same aquifer that is not owned by the
applicant.
5) This well shall be constructed not more than 200 feet from the location specified on this permit.
6) ProduCtiOn is limited to the Laramle-Fox Hills aquifer which is located at a depth of approximately 510 feet below land surface
and extends to a depth of approximately 870 feet below land surface. Plain casing must be installed and sealed to prevent the
withdrawal of ground water from other aquifers and the movement of ground water between aquifers.
7) The entire length of the hole shall be geophysically logged as required by the Statewide Nontrlbutary Ground Water Rules prior
to installing casing.
8) The maximum pumping rate shall not exceed 100 GPM.
9) The allowed average annual amount of ground water to be withdrawn is 133 acre-feet
10) A totalizing flow meter must be Installed on the well and maintained in good working order. Permanent records of all diversions
must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request.

IN THE MATTER OF AN APPLICATION FOR A PERMIT TO CONSTRUCT A WELL IN WATER
DIVISION NO. 1, WELD COUNTY, COLORADO

In compliance with C.R.S. 37-90-137(1) and the Statewide Nontributary Ground Water
Rules, Sanifill of Colorado, Inc., c/o David Hall, 4600 South Ulster Street, Suite 700, Denver, CO
80237 (hereinafter "applicant") submitted an application for a permit to construct a well. Based
on information provided by the applicant and records of the Division of Water Resources, the
State Engineer finds as follows:
1. The application was received complete by the State Engineer on March 22, 1996.
2. The applicant proposes to construct the well in the NW+ of the NW% of Section 28,
Township 1 North, Range 68 West, 6th Principal Meridian.
3. The proposed well is located outside the boundaries of a designated ground water basin.
4. The applicant proposes to apply the water withdrawn from the well to the following
beneficial uses: Industrial, Commercial including sanitary, dust control and reclamation,
Municipal, Irrigation, Domestic, and Augmentation.
5. The proposed maximum pumping rate of the well is 100 gallons per minute, and the
requested average annual amount of ground water to be withdrawn Is 150 acre-feet,
6. The applicant is the owner of the land on which the well will be constructed.
7. The proposed well would withdraw ground water from the Laramie -Fox Hills Aquifer
(hereinafter "aquifer"), which, according to the geophysical log for the Carr No. 1 Well, Is
located at a depth of approximately 510 feet below land surface and extends to a depth of
approximately 870 feet below land surface at the location of the proposed well.
8. The location of the proposed well is more than 600 feet from any existing well completed
in the aquifer.
9. According to a sworn statement, the applicant owns, or has consent to withdraw ground
water underlying 468 acres of land as further described in said statement, which is attached
hereto as Exhibit A.

10. Withdrawal of ground water from the aquifer underlying the land claimed by the applicant
will not, within one hundred years, deplete the flow of a natural stream at an annual rate
greater than one -tenth of one percent of the annual rate of withdrawal and therefore the
ground water is nontributary ground water as defined in C.F.S. 37-90-103(10.5).
11. In considering whether the requested permit shall be approved the provisions of C.R.S.
37-90-137(4) and the Statewide Nontributary Ground Water Rules shall apply. Withdrawals
shall be allowed on the basis of an aquifer's life of 100 years, C.R.S. 37-90-137(4)(b)(l).
12. The quantity of water in the aquifer, exclusive of artificial recharge, underlying the 468 acres
of land described in Exhibit A is 13,338 acre-feet. This determination was based on an
analysis for the thickness of aquifer materials indicated on the geophysical log on file in the
State Engineer's Office for Carr No. 1 Well and an average specific yield value for the
aquifer.
a. The average specific yield of the saturated aquifer materials underlying the land under
consideration is 15 percent.
b. The average thickness of the saturated aquifer materials underlying the land under
consideration is 190 feet,
13. A review of the records in the State Engineer's office has not disclosed that there are any
existing wells or other water rights claiming or withdrawing ground water from the aquifer
underlying the land claimed by the applicant.
14. An application for nontributary underground water rights for the proposed well is not
pending in the Division 1 Water Court.
Based on the above, the State Engineer finds that there Is water available for withdrawal
by the proposed well and no material injury to vested water rights would result from the issuance
of the requested permit subject to the following conditions:
a. The allowed average annual amount of water to be withdrawn from the aquifer by the
well shall not exceed 133 acre-feet (the quantity of water which is considered available
divided by the 100 year aquifer life).
b. The well shall be constructed no more than 200 feet from the location specified on the
permit application.
c. The applicant shall submit geophysical and lithologic logs after the construction of the
well. The geophysical logs shall be obtained from the hole before the casings are
installed.
d. The maximum pumping rate of the well shall not exceed 100 gallons per minute.

Subject: Laramie - Fox Hills Aquifer Study; Sanifill Site Near Erie, Colorado
Dear Mr. Bull:
We have completed our review and assessment of the water supply potential and
nontributary determination of the Laramie - Fox Hills aquifer at the Sanifill site near Erie,
Colorado. The property encompasses 468 acres in the W'A and the NE'% of Section 28,
Township 1 North, Range 68 West of the 6th P.M. in Weld County, as shown on Figure 1.
The water requirements for the site are expected to be 12 acre-feet (af) annually, or
approximately 7.5 gallons per minute (gpm) on a continuous basis. In accordance with our
Proposal dated January 26, 1996, this letter presents the results of Part B of our Proposal.
Our investigation was based on a review of records in the files of the Colorado
State Engineer, reports and maps published by the State Engineer and the U.S. Geological
Survey describing the geology and aquifer characteristics of the Denver Basin, geophysical
log analyses for wells in the area, information provided by Sanifill concerning water
requirements and previous investigations, and our knowledge of ground water occurrence
and availability in the Denver Basin.
SITE CONDITIONS
Land surface elevations at the site range from approximately 5,180 feet to
5,310 feet; the average elevation is about 5,250 feet. The site is located in the northwest
portion of the Denver Basin, which contains as many es four principal bedrock aquifers.
They are, in order of increasing depth beneath the land surface, the Dawson, Denver,
Arapahoe, and Laramie - Fox Hills aquifers. In this area, the Dawson, Denver, and
Arapahoe have been removed by erosion and are not present. Our letter, dated
February 9, 1996, presented the results of the study to verify that the Arapahoe aquifer is
not present at the site. Overlying the Laramie - Fox Hills aquifer and outcropping on the
site is the Laramie Formation, consisting mainly of shales with mineable coal units and
occasional sandstones. The Laramie is not considered as a useable aquifer in this area.
Numerous bedrock faults are present in this area. The faults generally have a
southwest to northeast orientation. Bedrock is typically downthrown on the southeast side
of the faults, with the upthrown block on the northwest side.

The withdrawal of "nontributary" and "not nontributary" ground water is
administered by the State Engineer's Office under Senate Bill 213, passed in 1973, and
under Senate Bill 5, passed in 1985. Under these legislations, water availability is
calculated and well permits are granted on the basis of overlying, contiguous property and
the hydrogeologic characteristics of the aquifer.
Prior to the passage of Senate gill 213, well permits were granted for the amount of
water that a well could produce, without regard to overlying land ownership. As a result,
a pro -Senate Bill 213 well in the vicinity of a property may have already appropriated some
of the ground water underlying the property, and thus, may reduce the post -Senate Bill
213 entitlement available to a landowner. To account for wells completed prior to Senate
Bill 213, a "circle of appropriation" is computed for each existing well. The overlap of this
circle onto a neighboring property will reduce the amount of ground water available to a
well on that property.
Under Senate Bill 5, a well is considered to be "nontributary" if the stream
depletions associated with pumpage are estimated to be less than one -tenth of one percent
of annual pumping over the 100 -year administrative life of the aquifer. Conversely, a well
is considered "not nontributary" if those depletions exceed one -tenth of one percent.
Stream depletions caused by not nontributary wells are replaced through implementation of
an augmentation plan approved in the Water Court, and may include delivery of
nontributary ground water to the stream system, or committing senior surface water rights
to the plan. The replacement requirement associated with not nontributary pumpage varies
depending on the distance from the pumping well to the stream system being depleted. If
a not nontributary well in the Laramie - Fox Hills aquifer is located greater than one mile
from the surface water system, then four percent of the amount pumped must be replaced
to the stream system. Not nontributary wells closer than one mile in the Laramie - Fox
Hills aquifer must replace actual depletions to the stream system. Senate Bill 5 further
requires that two percent of pumpage from all nontributary wells be relinquished to the
surface water system.
The annual ground water entitlement from a bedrock aquifer is computed as the
volume of water recoverable from the aquifer underlying the subject property, divided by
an assumed aquifer life of 100 years. Recoverable water in an aquifer is calculated using
the equation:

of porous material, has been presented in the Denver Basin Rules prepared by the State
Engineer's Office. A specific yield value of 0.15 is estimated for the Laramie - Fox Hills
aquifer.

The aquifer maps prepared by the State Engineer as part of the Denver Basin Rules
and Senate Bill 5 did not map the Laramie - Fox Hills aquifer in this area due to the bedrock
faulting and complex geologic structure. Although the State's maps indicate the presence
of the aquifer underlying the Sanifill property, no information was presented in the maps
for the elevations of the aquifer top and base or sand thickness.
Also, the State did not include this area in the computer modeling efforts to
determine if the aquifer was nontributary or not nontributary. Because this area was not
modeled, it is considered by the State Engineer to be not nontributary unless a nontributary
determination can be made.
AQUIFER CHARACTERISTICS
Earlier investigation of the Denver Basin aquifers by the U.S. Geological Survey
(Robson, Wacinski, Zawistowski, and Romero, 1981) estimated the top of the Laramie -
Fox Hills aquifer to be at an elevation of about 4,800 feet and the base to be at an
elevation of 4,600 feet, with a sand thickness of 150 feet.
Three geophysical logs of water wells and oil and gas wells or test holes in the area
were obtained and reviewed. Their locations are shown on Figure 1. The Carr No. 1 log is
the most important source of aquifer data as it is located on -site in the northwest corner of
the Sanifill property. At this location, the top of the Laramie - Fox Hills aquifer is present
at an elevation of 4,759 feet, or a depth of 500 feet beneath the land surface. The base
of the aquifer is present at en elevation of 4,399 feet, or a depth of 860 feet. An aquifer
sand thickness of 200 feet was determined from the log. Carr No. 1 was logged on
August 15, 1980; therefore, this log was not available for the preparation of the U.S.
Geological Survey mapping described in the above paragraph.
PRE -SENATE BILL 213 WELLS
Our review of well permits and Water Court decrees within one mile of the property
indicates that there are no pre -Senate Bill 213 wells that would appropriate water beneath
the property. As shown on Figure 1, there are five pre -Senate Bill 213 Laramie - Fox Hills
aquifer wells within one mile of the Sanifill site; however, their circles of appropriation do
not encroach into the property.
GROUND WATER AVAILABILITY
Based on the ground water availability formula discussed above, and using a land
area of 468 acres, a specific yield of 0.15 and a sand thickness of 200 feet, it is estimated
that 140.4 of per year would be available from the Laramie - Fox Hills aquifer.

Well yields from the aquifer in the area, as reported on well completion reports,
range from 7 to 25 gpm. Therefore, more than one well would be necessary if Sanifill
desired to withdraw the full annual entitlement of 140.4 af available from the property.
For the expected annual water requirement of 12 af, it is likely that one well would be
adequate.
NONTRIBUTARY DETERMINATION
The Analytical Stream Depletion Model, published by the Colorado Division of Water
Resources (Schroeder, 1987), was used to analyze the potential for stream depletion
caused by pumpage of a Laramie - Fox Hills aquifer well located in the northwest part of
the property. This model computes stream effects caused by well pumping using the
equations derived by Glover (1977). Inputs to the model include pumping rate, pumping
duration, aquifer transmissivity and storage coefficient, and distance from the pumping
well to the outcrop of the bedrock aquifer where connection with a stream or alluvial
aquifer is possible. The analysis was run for a 100 -year period in 20 -year increments.
The pumping rate used for the analysis was 7.5 gpm. The aquifer transmissivity
was determined using the sand thickness of the Laramie - Fox Hills aquifer (200 feet)
multiplied by the hydraulic conductivity estimated by Robson (1983) (0.05 feet per day).
A specific yield of 0.15 and a distance of approximately 16,500 feet from the pumping
well to the closest point of connection with a tributary stream or aquifer were used. The
closest subcrop of the Laramie - Fox Hills aquifer is located northwest of the site
underlying the alluvium of Coal Creek in the SEA of Section 12, Township 1 North,
Range 69 West.
This analysis showed no stream depletion within the 100 -year period, indicating the
Laramie - Fox Hills aquifer is nontributary at the Sanifill site.
During our review of Laramie - Fox Hills well permits at the State Engineer's Office,
we located nontributary well permits for four nearby Laramie • Fox Hills wells that were
granted by the State Engineer after the passage of Senate Bill 5 in 1985. The well
locations and permit numbers are shown on Figure 1. It is interesting to note that three of
the wells are located closer to the Laramie - l=ox Hills subcrop under the Coal Creek
alluvium than the Sanifill property and a nontributary determination was issued by the
State Engineer. The Glover method used in this investigation was also used for the
nontributary determination for these four well permits.
WATER QUALITY
Robson (1981) estimated that the Total Dissolved Solids (TDS) concentration from
the Laramie - Fox Hills aquifer in this part of the Denver Basin is approximately
1,200 milligrams per liter (mg/L). A review of nearby wells and a sampling of one
Laramie - Fox Hills aquifer well was completed for Sanifill by KRW Consulting, Inc. in
1995. This effort indicated a TDS of 1,700 mg/L from the Baker well, located
approximately one mile east of the Sanifill site. A detailed description of the review of

wells, sampling program, and laboratory analyses can be found in a KRW Memorandum
dated August 2, 1995. Although the aquifer may not be suitable for human consumption,
it should be adequate for the remaining sanitary and commercial uses at the site.

It is recommended that a nontributary Laramie - Fox Hills aquifer well permit
application be prepared and submitted to the State Engineer. Review and approval of well
permits by the State Engineer can take four weeks or more. A water rights application for
the Laramie - Fox Hills aquifer could also be prepared and submitted to the Water Court for
Division No. 1. A qualified, licensed well driller should be obtained to drill, complete, and
test your water supply well.
A listing of the references discussed above is attached and, if needed, we could
review these materials and my findings in detail with you. Please call if you have any
