Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Maxwell Nader Public Works Department representative, Zachery Roberson Health Department representative, Lauren Light The following business was transacted: le I hereby certify that pursuant to a notice dated August 2, 2019, and duly published August 7, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Manuel Gallegos -Herrera and Apryl Herrera, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0039, for a Home Business (transmission repair shop) and one (1) Single -Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. El Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal, indicated liquids associated with the business will be properly disposed by an outside company, provided the hours of operation and the number of employees, and stated the request for vacation of USR-1447 had been approved by the Board. He noted no correspondence had been received from surrounding property owners (SPO), stated 13 referrals were sent out, and six (6) referrals agencies responded. He explained the site is within the three (3) mile referral area of the Town of Kersey, and within Kersey's Coordinated Planning Agreement (CPA), who, in their referral response, indicated the site is not eligible for annexation. He described surrounding uses, entered the favorable recommendation of the Planning Commission into the record as written, and displayed images of the site and surrounding views. c_c,: Pc_ Coln/ TP), PwCZR), of-H(LL's tOIO4s/t9 2019-3949 PL1703 HEARING CERTIFICATION - MANUEL GALLEGOS-HERRERA AND APRYL HERRERA (USR19-0039) PAGE 2 Zachery Roberson, Department of Public Works, provided a brief overview of the transportation plans and requirements, stated site access is off of County Road (CR) 48, indicated there are no traffic counts in the area, and presented the drainage and grading requirements. IE Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, and stated water will be provided by the Central Weld County Water District (CWCWD), and the existing residence has a septic system permitted for three (3) bedrooms. She indicated a commercial septic system is proposed for the second residence, the noise level for the site is residential, and Development Standards (DS) #8-17 address Environmental Health (EH) items. Manuel Gallegos -Herrera and Apryl Herrera, applicants, provided an overview of the proposal. In response to Chair Kirkmeyer, Mr. Gallegos -Herrera indicated the number of customers visiting the site would be minimal, possibly one (1) or two (2) per day and confirmed himself and one other person will be the only employees. No public testimony was offered concerning this matter. El In response to Commissioner Conway regarding DS #4 (number of employees), Mr. Gallegos -Herrera indicated four (4) on -site employees is sufficient to allow for any potential future growth. Chair Kirkmeyer suggested deleting Condition of Approval (COA) #1.B (vacation of USR-1447), as it had been completed, deleting the "s" in "locations" in COA #1.D.7 (access labels on the site plan), and deleting COA #4.A (tracking control), as tracking control is not required. Commissioner Moreno suggested deleting DS #3 (hours of operation), Chair Kirkmeyer suggested deleting the second sentence in DS #11 (compliance with the Colorado Air Quality Commission's Air Quality Regulations), and Commissioner James suggested deleting DS #13 (permissible noise level). The Board agreed to all of the aforementioned changes. CI In response to Chair Kirkmeyer, Mr. Gallegos -Herrera and Mrs. Herrera indicated they had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. El No public testimony was offered with regard to changes made to the Conditions of Approval and Development Standards. Commissioner Moreno moved to approve the request of Manuel Gallegos -Herrera and Apryl Herrera for a Site Specific Development Plan and Use by Special Review Permit, USR19-0039, for a Home Business (transmission repair shop) and one (1) Single -Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner James, and it carried unanimously.
