Conway — EXCUSED Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Karin McDougal Planning Services Department representative, Chris Gathman Public Works Department representative, Evan Pinkham Health Department representative, Lauren Light The following business was transacted: • I hereby certify that pursuant to a notice dated April 26, 2019, and duly published May 1, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Boulder Creek Estates, LLC, c/o Grow Your Storage, LLC, for a Change of Zone, PUDZ18-0005, from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District for C-3 (Business Commercial) and I-1 (Industrial) Uses for a Self -Storage Facility, along with an existing 214 -foot in height Telecommunications Antenna. Karin McDougal, Assistant County Attorney, made this a matter of record. e Chair Kirkmeyer reviewed, for the applicant and the public, the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present and Commissioner Conway excused. e Chris Gathman, Department of Planning Services, presented a brief summary of the proposal, described surrounding uses, and mentioned there is an existing telecommunications tower on the south end of the site. He displayed an image of the site layout, noted there are two (2) proposed access points into the site, and referenced the referral from the City of Longmont. In response to Commissioner James, Mr. Gathman confirmed the only request the Board is currently considering is the Change of Zone. He displayed additional images of the site, and entered the favorable recommendation of the Planning Commission into the record, as written. CC- Pi- CCG/TP), Pw(E.P), £H(LL) O9/l-7/19 2019-2166 PL2677 HEARING CERTIFICATION - BOULDER CREEK ESTATES, LLC, C/O GROW YOUR STORAGE, LLC (PUDZ18-0005) PAGE 2 e Evan Pinkham, Department of Public Works, provided a brief overview of the transportation plans and requirements, stated the site accesses County Road (CR) 5, and the Department of Public Works (PW) is agreeable with the access location. He provided average speeds and indicated there will be about 110 daily roundtrips associated with the proposed site. He presented the drainage and grading requirements, and in response to Chair Kirkmeyer, Mr. Pinkham clarified the proposed southern access is in the City of Longmont's jurisdiction. e Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and stated the Left Hand Water District will provide water service, the Saint Vrain Sanitation District will provide sewer service, and the Department of Public Health and Environment (EH) had no outstanding issues with the request. le Tony Ollila, Grow Your Storage, LLC, represented the applicant and provided a brief overview of the proposed project. e No public testimony was offered concerning this matter. e In response to Chair Kirkmeyer, Mr. Ollila answered questions about the letter from the Saint Vrain Sanitation District, the City of Longmont trail easement, and the necessity of two (2) access points. At Chair Kirkmeyer's request, Mr. Gathman explained a Specific Development Guide and the Board added language to criteria paragraph 2.H to allow administrative approval of the Final Plan. Chair Kirkmeyer suggested deleting COA #1.B (mineral rights), as it is a contractual issue between surface and sub -surface property owners, and she suggested changing the language in COA #1.F.7 (access), to clarify only a single County -approved access off the County -maintained road shall be granted, and the Board agreed. El In response to Chair Kirkmeyer, Mr. Ollila indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. e No public testimony was offered with regard to changes to the Conditions of Approval. e Commissioner Moreno moved to approve the request of Boulder Creek Estates, LLC, do Grow Your Storage, LLC, for a Change of Zone, PUDZ18-0005, from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District for C-3 (Business Commercial) and I-1 (Industrial) Uses for a Self -Storage Facility, along with an existing 214 -foot in height Telecommunications Antenna, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner James, and it carried unanimously.
