Upon review of the draft resolution for 1MUSR18-17-0024, Public Works is requesting an additional
Development Standard be added This development standard is meant to address traffic for events larger
than 500 attendees in the future absence of Temporary Assembly Permits.
The requested additional Development Standard is:
"Events with greater than 500 attendees will require a Traffic Control Plan prepared by a Traffic Control
Supervisor to be submitted to Public Works no less than 30 days prior to the event. This Traffic Control
Plan shall be approved by the County prior to the event date."
To come up to date with current standards for USRs. Public Works is requesting the following changes be
made to the draft resolution. in accordance with the submitted referral.
Condition of Approval 1.A.12: Show and label the approved access(es) (AP#17 00275), and the 60' foot
turning radii.
Addition of a new Development Standard 15, 16. & 17 (and renumber subsequent Development standards):
15. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire
an approved Right -of -Way Use Permit prior to commencement. (Department of Public Works)
16. The Property Owner shall comply with all requirements provided in the executed Improvements

17. The Improvements Agreement for this site may be reviewed on an annual basis, including a site visit

Commissioners -
On April 10th I am bringing forward a minor amendment to USR17-0024. The case number associated with the
minor amendment is 1MUSR18-17-0024. The owners of the property are requesting to modify certain
development standards associated with the original USR. The modified Resolution with changes can be located
in Tyler. Initially, staff decided that the amendments could be handled administratively but following recent
direction from the Commissioners concerning TAP's (Temporary Assembly Permits) the owner revised their
application to request further changes to their development standards. Following this request, I decided that the
changes could not be approve administratively and that the requests warranted Commissioner review and
consideration.
Timeline:
• Planning Commission recommended approval of USR17-0024 on June 20, 2017
• Board of County Commissioners approved USR17-0024 on July 5, 2017
• Owner submitted Amended USR (l AMUSRl8-17-0024 on October 10, 2018
• Referral received by all parties on December 12, 2018
• Work Session held to discuss Race Tracks and Temporary Assembly Permits —January 21,-2019 (Ana Ornelas
present at work session and the Commissioner's agreed to remove TAP's from the Weld County Code)
• Revised Application to delete additional Development Standards received on February 26, 2019
• Director decision to take Minor Amendment to Board of County Commissioners — February 27, 2019
• Updated application with revised Resolution emailed to referral agencies — March 1, 2019
• IMUSR18-17-0024 scheduled for a hearing before the BoCC — April 10, 2019
Recommendation:
No objection from referral agencies received by staff, which include no issues from the Sheriff's Office. Staff
recommends approval of the modifications to Development Standards associated with 1MUSR18-17-0024
(formally USR17-0024).

The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: First Amendment to a Site Specific Development Plan and Use by Special Use Permit
No. USR17-0024 for Recreational Facilities and uses including, Race Tracks and Race Courses (Match
Horse Racing) to modify Development Standards and #10 concerning an ambulance, #12 related to
veterinarians, and #16 concerning alcohol on site,in the A (Agricultural) Zone District
This project is north of and adjacent to CR 96 and is east of and adjacent to CR 37.
Parcel number 055106300024.
Access is from CR 96 (Emergency Access on CR 37).
ACCESS
Weld County Public Works has reviewed the application materials related to access, and the proposed
application does not change the existing access points which were permitted under AP17-00275.
ROADS AND RIGHTS -OF -WAY
County Road 96 is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a(n) local road, which requires 60 feet of right-of-way. The applicant shall delineate
on the site map or plat the future and existing right-of-way and the physical location of the road. If the right-
of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County
Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-
way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained
by Weld County.
County Road 37 is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a(n) local road, which requires 60 feet of right-of-way. The applicant shall delineate
on the site map or plat the future and existing right-of-way and the physical location of the road. If the right-
of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County
Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-

Per Chapter 12, Article 4, Section 12-4-30.B, a Weld County Right -of -Way Use Permit is required for any
project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any
County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
Latest ADT on CR 96 counted 4 vpd with 14% trucks. The 85th percentile speed is 30 mph.
The traffic information submitted with the application materials indicated that typical events would cause
approx. 326 round trips. The 12 racing events held in 2018 had an average attendance of 285 spectators.
TRACKING CONTROL POLICY
Double cattle guards are required for tracking control at the access points.
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT
There is an Improvements Agreement on the site recorded under Reception Number 4372673.
DRAINAGE REQUIREMENTS
This area IS within a Non -Urbanizing Drainage Area: Non -Urbanizing Drainage Areas typically require
detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON -
URBANIZING areas.
Detention pond waived and a simple drainage narrative:
Under the original USR, the applicant has submitted a drainage narrative stating that the site meets
drainage exception 23-12-30.F.1.a.8 for sites where development of the site does not increase the
imperviousness of the site. The proposed amendment will not change the imperviousness of the site.
Existing Drainage Report and Detention Pond:
Please submit a drainage narrative stamped and signed by a Colorado Licensed Professional Engineer
indicating the existing detention pond can handle the increased imperviousness or update the Drainage
Report and drainage design to accommodate the increase in imperviousness.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
CONDITIONS OF APPROVAL
A. The plan shall be amended to delineate the following:
1. County Road 96 is a gravel road and is designated on the Weld County Functional Classification
Map as a local road which requires 60 feet of right-of-way at full buildout. The applicant shall
delineate on the site plan the existing right-of-way. All setbacks shall be measured from the edge
of right-of-way. This road is maintained by Weld County. (Department of Public Works)

Map as a local road which requires 60 feet of right-of-way at full buildout. The applicant shall
delineate on the site plan the existing right-of-way. All setbacks shall be measured from the edge

3. Show and label the approved access locations, approved access width and the appropriate turning
radii (60') on the site plan. The applicant must obtain an access permit in the approved location(s)
prior to construction. (Department of Public Works)
4. Show and label the approved tracking control on the site plan. (Department of Public Works)
5. Show and label the entrance gate if applicable. An access approach that is gated shall be designed
so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled
surface be less than 35 feet. (Department of Public Works)
6. Show and label the drainage flow arrows. (Department of Public Works)
7. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around

Prior to Construction:
A. The approved access and tracking control shall be constructed prior to on -site construction. This site
requires a tracking control device for tracking control. (Department of Public Works)
B. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages

3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a First Amendment to a
Site -Specific Development Plan and Use by Special Use Permit No. USR17-0024 for
Recreational Facilities and uses including, Race Tracks and Race Courses (Match
Horse Racing) to modify Development Standards and #10 concerning an ambulance,
#12 related to veterinarians, and #16 concerning alcohol on site in the A (Agricultural)
Zone District.
Environmental Health Services has no objections to the proposed modifications to
development standards. We have provided the comments and development standards
that were requested for the original Use by Special Use Permit No. USR17-0024.
According to the application, the racing will operate all year on weekends. There will be
between 200 and 500 people at events but up to 2,000 people may attend events 3 to 5
times a year.
The patrons must have access to potable water, restrooms and hand washing facilities.
The applicant is proposing to use portable toilets for the public. Portable toilets are
acceptable for recreational facilities that are utilized 6 months or less per year in
accordance with EH policy.
A waste handling plan was submitted which states that garbage bins will be provided
throughout the property and a trash crew will pick up litter during and after the event.
Manure will be spread on the property.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, flies, odors, disease hazards, and
nuisances are minimized.

2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not meant
to include those wastes specifically excluded from the definition of a solid waste in
the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.
5. Fugitive dust should attempt to be confined on the property. Uses on the property
should comply with the Colorado Air Quality Commission's air quality regulations.
6. This facility shall adhere to the maximum permissible noise levels allowed in in the
Commercial Zone as delineated in 25-12-103 C.R.S.
7. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility at all times. Temporary uses for a time
period of six months or less, portable toilets and bottled water are acceptable.
Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of
Public Health and Environment. Portable toilets shall be serviced by a cleaner
licensed in Weld County and shall contain hand sanitizers.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to On -site Wastewater Treatment Systems.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
10. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Good afternoon.
Ana Ornelas has submitted an application to modify certain development standards
;sociated with her USR. We treated these changes under our minor amendment
rocess (1MUSR18-17-0024). However, given the nature of these changes I didn't feel
comfortable approving the changes administratively, and therefore, a hearing has been
scheduled before the County Commissioners on March 13th for consideration. Please take

a moment to review the changes (red line strikeout) and let me know if you have any
concerns. The main reason Ms. Ornales wants to modify her USR is because the Board
recently did away with TAPs (Temporary Assembly Permits) and she feels like she won't
competitive without these changes. Please let me know if you have any questions or
