Billings Gentlemen: This is to advise you that because of insufficient funds for August, 1971 and because no immediate relief of this critical situation is assured, a contingency plan must be made for the lay-off of most or all of the staff of the Weld County Department of Public Welfare. Under the provisions of Volume III, 3914.55, State Department approval must be obtained for an action of this nature and a fifteen-day notice (3914.552) must be provided for employees before this action is taken. I am calling your attention to this matter so that a decision can be made, particularly by the State Department, related to the requirements of 3914.55, prior to August 1. The County Board has indicated that funds may be provided to pay all staff through August 15 so that proper notice may be provided to the employees if this notice is given August 1. Also a small amount of funds may be available for the full month of August to pay the salaries of approximately 10% of staff (9 persons) so that very minimal emergency service coverage can be maintained. It is with much regret that I write this letter. The implications of a lay-off of this nature, and the denial of funds and services to a dependent and needy segment of our population are awesome. ��SDGGa' 710496 Page 2 Mr. Con Shea Mr. Marshall B. Shea Executive Director DATE: July 26, 1971 SUBJECT: Weld County Court Proceeding At 10:35 a.m. this date, I met with Mr. Sam Telep, Weld County Attorney; Mr. Ronald L. Cooke, Attorney for the Colorado County Commissioners Association; and Mr. Glenn K. Billings, a County Commissioner from Weld County. Mr. Billings did return the state warrant for $56,000 which advanced the 80 percent share of state and federal welfare admin- istration money for Weld County for the month of August, 1971. At the same time, Mr. Billings presented me with the attached letter from Mr. Eugene McKenna, Director, Weld County Department of Public Welfare, indicating his desire to have a contingency plan for layoff of public welfare employees in the county department, effective August 1, 1971, if the County Commissioners do not make available county funds to the extent of 20 percent of employee salaries, or if other arrangements are not made to provide said 20 percent of employee salaries. Such layoff procedure requires State Department of Social Services approval under provisions of Staff Manual, Volume III, 3914.55, which rules and regulations are binding on counties. Please advise whether or not such approval of such layoff is appropriate under current federal and state laws, so that we may send a response to Mr. McKenna. CFS:lr Attachment cc: Charline J.
