LENGTH IN THE A (AGRICULTURAL) ZONE DISTRICT — KERR-MCGEE GATHERING,
LLC
A public hearing was conducted on February 13, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated December 13, 2019, and duly published
December 18, 2019, in the Greeley Tribune, a public hearing was conducted to consider the
request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special
Review Permit, USR18-0107, for a greater than 12 -inch High Pressure Natural Gas Pipeline
(24 -inch natural gas pipeline) approximately 7.5 miles in length in the A (Agricultural) Zone
District. Bob Choate, Assistant County Attorney, made this a matter of record.
Angela Snyder, Department of Planning Services, presented a brief summary of the
proposal of the pipeline, that will connect the proposed Johnstown Compressor Station to the
existing St. Vrain Compressor Station, USR14-0013. She explained the pipeline will
accommodate Kerr-McGee's pipeline development in Weld County and provide flexibility to the
existing system. She indicated the pipeline will cross several County Roads (CR) and the St. Vrain
Creek floodplain. She noted a referral was received from the Weld County Floodplain Planner
stating the applicant shall submit a Floodplain Permit prior to installing the pipeline and delineate
the floodplain and floodway boundaries on the map. Ms. Snyder explained a permanent
easement, 100 feet in width, has been obtained to accommodate this and future pipeline projects,
and described the monitoring methods. She indicated the project is within the three (3) mile
referral areas of various towns, however, no responses were received. She noted a Cultural
Resource Inventory fora specific site assessment of the biological aquatic and cultural resources,
adjacent to the proposed pipeline route, was submitted with the application, and Colorado Parks
and Wildlife (CPAW) and History Colorado did not return a referral response. She went on to talk
about the required Emergency Action and Safety Plan, as well as the design and construction of
the pipeline. She stated referrals were sent to 30 agencies, eight (8) commented, and no

correspondence was received from Surrounding Property Owners (SPOs). Ms. Snyder displayed
images of the project and entered the favorable recommendation of the Planning Commission
into the record as written.
le Hayley Balzano, Public Works Engineer representative, provided a brief overview of the
transportation plans and requirements, and stated access permits are required for all impacted
roads. She noted tracking control and a Road Maintenance Agreement are also required during
construction and presented the drainage and grading requirements.
O Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions and stated portable toilets will be allowed along on the construction route, an Air
Emissions Permit is required if more than 25 acres are disturbed, and Development Standards
(DS) #14-20 address Environmental Health (EH) items.
O Nathan Kaiser, representative for Anadarko Petroleum, indicated there was a community
meeting prior to planning of the pipeline and noted 1,200 people were invited, 23 attended, two (2)
couples had concerns, and those concerns are being addressed. In response to Chair Kirkmeyer,
Mr. Kaiser stated all of easements are in place and they are working on the Crossing Agreements.

• In response to Chair Kirkmeyer about Condition of Approval (COA) #1.B, Mr. Kaiser stated
Anadarko Petroleum is working to address the concerns of the Little Thompson Water District.
Chair Kirkmeyer suggested deleting COA #1.C, as that condition is already being met. In
response to Chair Kirkmeyer, Mr. Kaiser confirmed they are working with Great Western Railroad
to address COA #1.D, and Highland Ditch Company to address COA #1.E.
ID In response to Chair Kirkmeyer, Mr. Kaiser indicated he reviewed, and agreed to abide by,
the Conditions of Approval and Development Standards, as amended.
• Commissioner Moreno moved to approve the request of Kerr-McGee Gathering, LLC, for a
Site Specific Development Plan and Use by Special Review Permit, USR18-0107, for a greater
than 12 -inch High Pressure Natural Gas Pipeline (24 -inch natural gas pipeline) approximately
7.5 miles in length in the A (Agricultural) Zone District, based on the recommendations of Planning
staff and the Planning Commission, with the Conditions of Approval and Development Standards
as entered into the record. The motion was seconded by Commissioner Conway, and it carried
unanimously. There being no further discussion, the hearing was completed at 10:23 a.m.
