Before the County Planning Cosmissice shall approve or dis—
'TT, approve a special request for the location of a sand or
gravel pit, rock crusher, quarry or open mining operation,
d concrete and asphalt plants in any "l" or"1-1" Agriculture _ _ S
r, District or in any "I" Industrial District, the applicant
Cshall supply the required information and shall be subject j'---'
F> to the following conditions! c

(A) Application s. ~
t! {1) Plan. When the application is filed, the applicant G.

shall provide a plan shoving the land from which
[t
the sand and gravel will be excavated and a. plan
providing for rehabilitation of the excavated r .- '
4, area. These plans prepared by a registered en-
`•
r gineer shall show the contours of the land on at i. ,
least fin-foot contour intervals and any Apron- _
assents thereon and a distance of 300 feet in all

. directions from the subject property. The plans
shall be placed on a 24" x 36" sheet and shall con-
' taro the legal description, acreage, scale of the • -
' drawing, vicinity sketch and the written and graphic
details of the rehabilitatio^

may be allowed. However, the Planning Commission
may set out additional conditions under which these

(B) Operations Standards
I (1) No excavation or processing of sand and gravel shall
H3 be permitted nearer than 10 feet to the boundary of
,A adjacent property, easement, or irrigation ditch or
right-of-way, nor nearer than 125 feet to any exist-
ing residence, unless by written agreement the .1.j!
caner or owners of such adjacent property consent -p -
to a lesser distance and the Planning Commission
approve such lesser distance. The Planning Commis-
sion may set a greater distance than mentioned above
when, in their opinion it is justified.
(2) The operation shall maintain haulage roads in a
reasonable dust-free condition if within one-
• . fourth mile of a residential subdivision.
(3) The hours of operation shall be unlimited unless the ,
operation is located within one-fourth miles of ■
• i residence in which case the hours of operation shall
f om be fr 6:00 A. M. to 10:00 P. M. or longer as the
Planning C®aission may specify.
(4) All wet pits (definitions any pit excavated belay
e - , existing water table or subject to underground seep- ___
age where water would acciaulate and pond) shall be
excavated in such a manner as to leave an average of
, not less than eight inches of undisturbed sand or
5 gravel, as evenly as possible, over the entire ex-
i cavation tract to provide a water bearing strata for

i•., (1) Permit fee. An annual permit fee of $50.00 shall be

nected with or incidental thereto. •
(3) Bond. The operator shall post a bond in the form
prescribed by the Board of County Commissioners in '
a sum equal to the number of acres covered by the
{ ' permit multiplied by $500.00 to insure full cm-
f.: pliance with all of the terms and conditions of the •
permit and the rules and regulations of the Board
of County Commissioners pertaining to extraction
i,. Commissioners and processing of sand and gravel. The minimum
* amount of such bond shall be $2,500.00; and the a
'i maximum amount, $15,000.00.
(4) Time of permit. All permits shall be in force
. until the operation is completed unless the annual
permit is not renewed by the operator. - •
(5) Cancellation of permit. The Board of County Com-
missioners shall have the power to cancel peermits
r. for violation of any of these regulations or con-
_ ditions imposed by said Board. The Board of County --_-___-.
commissioners shall cause to be served written notice

1 to correct such violation within thirty days. If
-; the violations have not been corrected then the L., '

•! more than thirty days after the date of service of
notice. The Board of County Commissioners shall
" hold a hearing to determine the nature and extent
; of the alleged violation and shall hove the power,
upon good cause being shown, to cancel or revoke -
the permit heretofore issued to the permittee, to
require certain corrective measures to be taken or �.-;"+
