HomeMy WebLinkAbout20194995.tiffHEARING CERTIFICATION DOCKET NO. 2019-138.B RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR19-0049, FOR ANY USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS, (OUTDOOR STORAGE OF RVS, ATVS, BOATS, CAMPERS, TRAILERS, AND VEHICLES) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT - NATHAN TROWBRIDGE AND GROVES FARM, LLC A public hearing was conducted on December 23, 2019, at 9:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Michael Hall Public Works Department representative, Evan Pinkham Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated October 24, 2019, and duly published October 30, 2019, in the Greeley Tribune, a public hearing was conducted on December 18, 2019, to consider the request of Nathan Trowbridge and Groves Farm, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0049, for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts, (outdoor storage of RVs, ATVs, boats, campers, trailers, and vehicles) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, at which time the matter was continued to allow the applicant adequate time to compile a Landscaping and Screening Plan and evaluate additional visual impacts. Bob Choate, Assistant County Attorney, made this a matter of record. Chair Kirkmeyer provided an overview of the initial hearing on December 18, 2019. Nathan Trowbridge, applicant, described the draft Landscape and Screening Plan and confirmed the access to the site. In response to Chair Kirkmeyer, Mr. Trowbridge provided the size of the proposed trees on the north property line, confirmed there is irrigation water on the property, and in response to Commissioner Freeman, he stated the trees on south side will be cc PLCrnH/TP), Pw(EP). £H(LL) OQ/IO 190 2019-4995 PL2724 HEARING CERTIFICATION - NATHAN TROWBRIDGE AND GROVES FARM, LLC (USR19-0049) PAGE 2 six (6) to eight (8) feet tall. Commissioner James suggested Mr. Trowbridge make a note on the final Landscape and Screening Plan of the availability of irrigation water and Mr. Hall confirmed the well permit allows for homes and lawn/garden. Mr. Trowbridge requested the flexibility to phase the landscaping, to which the Board agreed. Commissioner Conway suggested common sense prevail with regard to the landscaping, as it is winter right now, and Mr. Hall requested Mr. Trowbridge make a note regarding the phasing plan on the final Landscape and Screening Plan. • In Condition of Approval (COA)#1.B, #1.F.6, and Development Standard (DS) #5 (Landscape and Screening Plan), Chair Kirkmeyer suggested adding "and Maintenance" to the Plan that will be submitted to the Department of Planning Services, adding the Dark Sky Policy to COA #1.D (Lighting Plan), adding the phrase "which shall be screened from existing surrounding residences and public right-of-way' to COA #1.F.5 (show and label the location of the portable toilet), adding the Dark Sky Policy to COA #1.F.8 (show and label the location of the lighting). The Board agreed to all of the aforementioned changes. El In response to Chair Kirkmeyer, Mr. Trowbridge indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. • No public testimony was offered with regard to the changes to the Conditions of Approval and Development Standards. e Commissioner Conway moved to approve the request of Nathan Trowbridge and Groves Farm, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0049, for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts, (outdoor storage of RVs, ATVs, boats, campers, trailers, and vehicles) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendation the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner James, and it carried unanimously.
