DIVISION OF LAND NO. 0961-4-2-RE140
DETERMINED TO BE EXEMPT FROM THE DEFINITION OF SUBDIVISION
RANGE 65 WEST, TOWNSHIP 5 NORTH, SECTIONS 4 & 5
PT. SE4NEa SECTION 5, AND SW4NW4 SECTION 4
WHEREAS, on May 5, 1972 , the General Assembly of the
State of Colorado, enacted Senate Bill #35 as relates to
Chapter 106 of the Colorado Revised Statutes, and
WHEREAS, on August 30 , 1972, the Board of County
Commissioners of Weld County, Colorado, adopted Subdivision
Regulations for Weld County, Colorado, to comply with the
prescribed Senate Bill #35, and
WHEREAS, the Weld County Planning Commission has
recommended denial to the Board of County Commissioners for
recording of plat number 0961-4-2-RE140 as provided in
Section 9 of the Subdivision Regulations (exemption rules and
regulations) for Weld County, Colorado, and
WHEREAS, the Board of County Commissioners heard
all the testimony and statements of those present; has studied
the request of the petitioner and studied the recommendations
of the Weld County Planning Commission, and having been fully
informed,
NOW, THEREFORE, BE IT RESOLVED, that said division
of land determined to be exempt from the definition of subdivision
is more particularly described as follows:
A tract of land located in part of Lot 6 and in part of Lot
5 of the Southeast Quarter (SE4) of the Northeast Quarter
(NEa) of Section 5, and Lot 3 of the Southwest Quarter (SWa)
of the Northwest Quarer (NWa) of Section 4, Township 5 North,
Range 65 West of the Sixth Principal Meridian, according
to the Union Colony Subdivision, Weld County, Colorado and
being more particularly described as follows:
Beginning at the Northwest Corner of said Lot 3 and considering
the North line of said Lot 3 to bear South 86°44 ' 00" East and
with all other bearings contained herein relative thereto;
Thence South 86°44 ' 00" East, 727 . 36 feet to the Northeast
Corner of said Lot 3 ;
Thence South 03°19 ' 00" East, 713 . 56 feet to the Southeast
Corner of said Lot 3 ;
Thence South 87°52 ' 00" West, 714. 98 feet to the West line of
said Section 4;
Thence North 02°09' 00" East, along said West line of Section
4, 135. 35 feet;
Thence North 76°48 ' 00" West, 103 . 66 feet to a point on the
East Right-of-Way line of U.S. Highway 85 Bypass;
Thence along the East Right-of-Way line of U. S. Highway 85
Bypass the following three (3) bearings and distances:
North 06°45 '30" West, 108. 60 feet;
South 83°14 '30" West, 20. 00 feet;
North 06°45' 30" West, 744. 30 feet;
Thence North 87°04 ' 00" East, 254. 86 feet to a point on the
East line of said Lot 6;
Thence South 02°09 ' 00" West along the East line of said Lot
6, 236. 33 feet to the True Point of Beginning.

The Planning Commission staff has reviewed the application for
Recorded Exemption No . g90-4-0?- A.47/40 submitted by
and finds the following :
1 . That the proposed lots are not part of a recorded exemption
from the definition of "subdivision or subdivided land" or •
a subdivision approved within less than five years previous ;
2 . That the proposed land division would not constitute the sub-
division of a larger tract or parcel of land into more than

Dear Harry:
Concerning the Recorded Exemption for the Geisert ' s (RE-140 ) ,
a review of the site and further interpretation of the flood
plain information on the Cache La Poudre River , Volume II ,
it is felt by the Planning staff that the Recorded Exemption
can be granted under the condition that all building permits
require a ground elevation of 4640 . 0 feet M . S . L . This ele-
vation would be at a level greater than the designated standard
project flood elevation .
The site should have fill that would bring it to this elevation .
It is therefore recommended for approval subject to establishing
an elevation of 4640. 0 feet M . S . L .

Applicant submits herewith for the consideration and approval of the Division a sketch (or blueprint) of the proposed
installation showing all necessary specification detail including (1) frontage of lot"along highway, (2) distance from center-
line of highway to property line, (3) number of driveways requested, (4) width of proposed driveways) and angle of approach,
(5) distance from driveway to road intersection. if any, (6) size and shape of area separating driveways if more than one
approach, and (7) setback distance of building(s) and/or gasoline pump island(s).
The applicant binds and obligates himself to construct and maintain the driveway approach(es) n accordance with the
provisions, specifications, and conditions enumerated in this document.
GENERAL PROVISIONS
FIRST: The Applicant represents all parties in interest, and affirms that the driveway approach(es) is to he cod by
him for the bona fide purpose of securing access to his property and not for the purpose of business or 'cing
vehicles on the highway right-of-way.
SECOND: The applicant shall furnish all labor and materials, perform all work, and pay all costs in connet;tion with
the construction of the driveway(s) and its appurtenances on the right-of-way. All work shall be completeid within 30
days of the Permit date.
THIRD: The type of construction shall be as designated and/or approved by the Division of Highways and all materials
•
used shall he of satisfactory quality and subject to inspection and approval by the Division.
FOURTH: The traveling public shall be protected during the installation with proper warning signs and signals and the
Division of Highways and its duly appointed agents and employees shall be held harmless against any action for personal
injury or property damage sustained by reason of the exercise of the Permit.
FIFTH: The Applicant shall assume responsibility for the removal or clearance of snow, ice or sleet upon any portion of
the driveway approach(es) even though deposited on the driveway(s) in the course of the Division's snow removal operations.
SIXTH: In the event it becomes necessary to remove any right-of-way fence, the posts on either side of the entrance shall be
securely braced before the fence is cut to prevent any slacking of the remaining fence, and all posts and wire removed
shall be turned over to the District representative of the Division of Highways.
SEVENTH: No revisions or additions shall be made to the driveway(s) or its appurtenances on the right-of-way without the
written permission of the Division of Highways.
EIGHTH: On those highways along which access rights are restricted or for which service roads have been constructed,
driveways shall connect only to the service roads and not to the main traveled highways.
NINTH: Provisions and specifications e"1ined herein shall apply on all highways ur`m tthe jurisdiction of the Division of
Highways, except that on highway court ate'g links within the corporate limits of mtiroJ alities operating under home rule

SPECIFICATIONS
Section 1 A driveway approach is understood to be that portion of the highway right-of-way between the pave-
Definition ment edge and the property line which is designed and used for the interchange of traffic between the
roadway pavement and the abutting property.
Section 2 At any intersection of a State Highway with another highway, road, or street, where right-of-way has
Intersection been acquired to provide sight distance, no driveway approach shall be permitted within the frontage
Clearance thereof. At any other intersection, a driveway shall be restricted for a sufficient distance from the
intersection to preserve the normal and safe movement of traffic. (It is recommended for rural residence
entrances that a minimum intersection clearance of 50 feet be provided and for rural commercial entrances
a minimum of 100 feet be provided. For similar installations in urban or suburban areas, a minimum of 20
feet for both residence and commercial entrances is recommended.)
Section 3 All entrances and exits shall be so located and constructed that vehicles approaching or using them will
Sight be able to obtain adequate sight distance in both directions along the highway in order to maneuver

Section 4 Driveway locations for ingress and egress must be reasonable from the viewpoint of the traveling public
Traffic in that no unusual hazard to pedestrians or motorists shall be created, nor shall the driveway(s) invite
Operations or compel vehicular movements in directions or locations contrary to those for which the highway was
designed, neither shall they invite or compel illegal or unsafe traffic movements.
Section 5 No entrance or approach shall be located or constructed so as to interfere with or prevent the proper
Control location or functioning of any traffic regulating device. The Applicant shall not be 'permitted to erect

Section 6 Generally, no more than one approach shall be allowed any parcel of property the frontage of which

ence and necessity.
Section 7 All driveways shall be so located that the flared portion adjacent to the traveled way will not encroach

Section 8 No commercial driveway shall have a width greater than thirty-five (35) feet measured at right angles
Driveway to the centerline of the driveway, except as increased by permissible radii. No noncommercial driveway
Width shall have a width greater than twenty-four (24) feet measured at right angles to the centerline of the
driveway, except as increased by permissible radii.
Section 9 The axis of an approach to the highway may be at a right angle to the centerline of the highway and of
Approach any angle between ninety (90) degrees and sixty (60) degrees but shall not be less than sixty (60)
Angle degrees. Adjustment will be made according to the type of traffic to be served and other physical
conditions.
Section 10 Permissible radii on driveway returns shall be governed by such factors as width of drive and angular
Curb Return placement. Where the flared edge of an approach controls the turning radius of a vehicle entering a
Radii property by a right turn from the adjacent outside traffic lane of the roadway, the radius of that edge
shall be not less than twenty (20) feet where the approach is to be used by passenger cars and single-
unit trucks and not less than fifty (50) feet where all types of vehicles may be expected.
Section 11 A safety island or buffer zone shall be constructed and maintained between adjoining driveway approaches

line shall be required for the island separator. Curbs or posts, or other suitable methods of island desig-
nation and protection as approved by the Division, shall be provided to prevent vehicle parking
and access in the restricted island area.
Section 12 The construction --- --arking or servicing areas on the highwa< ight-of-way is specifically prohibited.
Parking Off-the-road park facilities should be provided by commer establishments for customers' vehicles.
Section 13 The grade of entrance and exit shall slope downward and away from the road surface at the same rate

Section 14 All driveways and approaches shall be .so constructed that they shall not interfere with the drainage sys-

structures at entrances and exits which will become an integral part of the existing drainage system.
The dimensions of all drainage structures mutt be approved by the Division representative prior- to

NOTICE
The applicant, his agents and employees shall comply with all the rules, regulations, restrictions and requirements of the Weld County Zoning
Regulations and the Uniform Building Code governing location,construction and erection of the hereinabove proposed structure for which the permit
is granted. Violation of any of the rules ar regulations applicable may result in the revocation of this permit. The Building Inspector or his agents are
authorized to order the immediate cessation of construction at any time a violation of the rules and regulations appears to have occurred.
The applicant is required to call for inspection at various stages of the completion of the construction and in accordance with the aforesaid rule,
the applicant shall give the Building Inspector not less than one day's notice to perform such inspection.
In the event construction is not commenced within 60 days of the issuance of this permit, then the same is automatically void and of no further
force in effect. Cessation of work for a period of 120 continuous days shall cause the permit herein issued to be void.
