RE: NO ACTION CONCERNING SITE SPECIFIC DEVELOPMENT PLAN AND USE BY
SPECIAL REVIEW PERMIT, USR19-0035, FOR AGRICULTURAL SERVICE
ESTABLISHMENTS PRIMARILY ENGAGED IN PERFORMING AGRICULTURAL,
ANIMAL HUSBANDRY OR HORTICULTURAL SERVICES ON A FEE OR CONTRACT
BASIS, INCLUDING: VETERINARY CLINICS OR HOSPITALS AND AN ADDITIONAL
BUILDING MOUNTED SIGN IN THE A (AGRICULTURAL) ZONE DISTRICT - DVM
BURROS, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 4th day of
September, 2019, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose of
hearing the application of DVM Burros, LLC, 1521 Dove Haven Ln., Berthoud, Colorado 80513,
for a Site Specific Development Plan and Use by Special Review Permit, USR19-0035, for
agricultural service establishments primarily engaged in performing agricultural, animal
husbandry or horticultural services on a fee or contract basis, including: Veterinary Clinics or
hospitals and an additional building mounted sign in the A (Agricultural) Zone District, on the
following described real estate, being more particularly described as follows:
Lot 5 Bohrer PUD; being part of the S1/2 NW1/4 of
Section 19, Township 3 North, Range 68 West of the
6th P.M., Weld County, Colorado
WHEREAS, at said hearing, on September 4, 2019, the Board deemed it appropriate to
continue the matter to October 16, 2019, at 10:00 a.m., to allow the applicant adequate time to
discuss amending the PUD with the Planning Staff, and
WHEREAS, at said hearing, on October 16, 2019, the applicant was present and
represented by Sheri Lockman, Lockman Land Consulting, 36509 CR 41, Eaton, CO 80615, and
WHEREAS, the County Attorney's Office advised the Board that the appropriate
permitting procedure for the proposed development would be to amend the existing Planned Unit
Development (PUD) zone and final plat, and that a USR permit was not appropriate in a PUD
zone, and
WHEREAS, the Board of County Commissioners heard from Planning Staff and the
applicant, studied the request of the applicant and the recommendation of the County Attorney's
Office and, having been fully informed, deemed it advisable to take no action.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that no action is taken concerning the application of DVM Burros, LLC, for a
Site Specific Development Plan and Use by Special Review Permit, USR19-0035, for agricultural
service establishments primarily engaged in performing agricultural, animal husbandry or
horticultural services on a fee or contract basis, including: Veterinary Clinics or hospitals and an
additional building mounted sign in the A (Agricultural) Zone District, on the parcel of land
described above.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 16th day of October, A.D., 2019.
