A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,
December 13, 2018 at 10:00 a.m., in the Hearing Room of the Weld County Planning Department at 1555 N
17th Ave, Greeley, Colorado.

A SITE SPECIFIC DEVELOPMENT PLAN AND FINAL PLAN FOR FIVE (5) LOT
MINOR SUBDIVISION - S588 (IVY CREST). APPLICANT IS PROPOSING TO
MODIFY THE CONDITIONALLY APPROVED FINAL PLAN TO REDUCE THE
NUMBER OF LOTS FROM FIVE (5) TO THREE (3) ALONG WITH MODIFYING
THE ACCESS INTO THE MINOR SUBDIVISION.
LOT A AMD REC EXEMPT RE -2151, PART E2 SECTION 21, T3N, R67W OF
THE 6TH P.M., WELD COUNTY, COLORADO.
WEST OF AND ADJACENT TO COUNTY ROAD 19 AND APPROXIMATELY 1,800
FEET NORTH OF STATE HIGHWAY 66.
Chris Gathman, Planning Services, stated that the original minor subdivision for five (5) lots (under the name
of Ivy Crest) was approved in 2001. The minor subdivision conditions were not finalized for this case and the
plat was never submitted for recording. This property has since been sold to another party, John and Kim
Pence. The new owners are proposing to modify the conditionally approved final plan to reduce the number of
lots from five (5) to three (3) along with modifying the access into the Minor Subdivision. The parcel is currently
vacant (no residences).
Due to the modifications to the minor subdivision, Staff is bringing this back before the Utility Board.
Utility Easement requirements are outlined in 24-7-60 of the Weld County Code:
A. Easements shall follow rear and side lot lines whenever practical and shall have a minimum total width of
twenty (20) feet apportioned equally on abutting properties.
B. Where front line easements are required, a minimum of fifteen (15) feet shall be allocated as a utility
easement.
C. Easements shall be designed to provide efficient installation of utilities. Special guying easements at
corners may be required. Public utility installations shall be located to permit multiple installations within the
easements to avoid cross connections minimize trenching and adequately separate incompatible systems.
Staff's recommendation is that the Minor Subdivision plat should be modified to adhere to the requirements of
Section 24-7-60:
1) Delineate a 15 -foot utility easement along the eastern boundary (outside of the existing and/or future
right-of-way for County Road 19.
2) Delineate 20 -foot wide utility easements (10 -feet each side of the property line) along the common lot
lines between Lot A and Lot B and between Lot B and Lot C (as shown on the draft plat map.
3) Delineate a 20 -foot utility easement along the northern, western and southern boundaries of the
proposed minor subdivision.
Staff noted that the draft minor subdivision plat identifies the lots as A, B and C. Due to this being a
subdivision, Staff will require the lots to be re -labeled as Lots 1, 2 and 3.
Hayley Balzano referred to the 20 -foot wide utility easement, with 10 feet on each side of the property line, and
noted that on the southern boundary of Lot A there is a water line easement. She asked if the water line
easement is exclusive. Mr. Gathman said that he would research if it is exclusive. Ms. Balzano suggested
that if it is exclusive that the entire 20 -foot utility easement go on the southern side of the lot line.
LeAnn Koons summarized the changes:
1) Delineate a 15 -foot utility easement along the eastern boundary (outside of the existing and/or future
right-of-way for County Road 19.
2) Delineate 20 -foot wide utility easements (10 -feet each side of the property line) along the common lot
lines between Lot A and Lot B and between Lot B and Lot C, with the exception of checking on the
exclusivity of the easement for Lot A. If the existing waterline easement along the southern boundary
of Lot A (recorded under Rec. No. 2490818) is designated as an exclusive easement, the 20 -foot
utility easement shall not overlap this easement and the entire 20 -foot utility easement shall be
delineated on the northern edge of Lot B.
3) Delineate a 20 -foot utility easement along the northern, western and southern boundaries of the
proposed minor subdivision.
Motion: Approve the Final Plan for MINF18-0001, along with summarized changes, Moved by Hayley
Balzano, Seconded by Robert Fleck. Motion carried unanimously.
