Dear Sir:
Pursuant to your request to me to give you
my opinion from a legal standpoint relative to the closing
of a certain rbad -in-Weld- County known as- Road No-. - 460; - -- -
lying between Seca. 18 & 19; 15 & 22; 14 & 23; and
13 & 24, in Tp. 6 N.R. 63, will say:
That the records in the office of the County
Clerk and Recorder of Weld County, Colorado, show that
a road was petitioned for which included the above
described line, which petition was signed by certain
land owners' adjacent to said road; that due consideration
was given to said petition and the' Commissioners of Weld
County, Colorado, found that the petition was in due form,
and signed by the proper number of qualified persons; and
that $15 had been deposited as required to cause viewers-
to be appointed to view the road.
That after the aforesaid steps had been taken
viewers were duly appointed to view the proposed road;
that notice was served on the viewers, the proper notices
given, and the inspection was made by the viewers and a
proper report made thereon;. that the report was approved
by the Commissioners and the compensation awarded to the
various property owners along the road was paid by the
Commissioners . It may be that some of the property owners
didn ' t ever call for the warrant, but that makes no differ-
_ ence.
That \po objections were ever made to the report
as by statute provided in case some property owner was
not' satisfied. All of the necessary records have been made
and kept showing that the road was establishes[ and laid out;
and as I have been informed a road has been used since
that time on approximately the line described in the peti-
tion. It is not necessary that it be on the exact line.
That any person acquiring property along this road
after the above proceedings were had is bound by those
proceedings . That all persons can be compelled now to
allow said road to remain open, and any person obstructing
the same by fences or gates can be prosecuted as provided
- by Section 6537 of -M.A.S. 1912 edition. _

We therefore petition your honorable body to cause to be laid out and opened a County road as above
described, and we, the owners of the land through which said road is sought to be laid out, in consideration
of the sum of one dollar to us each and severally in hand paid by the said County of Weld, the receipt of
which is hereby acknowledged, and of the laying out and opening of said road, hereby agree to give the right
of way through our lands as shown by the plat accompanying this petition, and relinquish all claims for
