HomeMy WebLinkAbout20191604.tiffHEARING CERTIFICATION DOCKET NO. 2019-49 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR19-0009, FOR A 1041 MAJOR FACILITY OF A PUBLIC UTILITY (A NEW ABOVE GROUND SINGLE -CIRCUIT 230 KV TRANSMISSION LINE THAT WILL EXTEND THROUGH 3.9 MILES IN WELD COUNTY) IN THE A (AGRICULTURAL) ZONE DISTRICT - ROUNDHOUSE RENEWABLES, LLC A public hearing was conducted on May 1, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair - EXCUSED Commissioner Mike Freeman, Pro -Tern Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman Public Works Department representative, Evan Pinkham Health Department representative, Lauren Light The following business was transacted: • I hereby certify that pursuant to a notice dated March 13, 2019, and duly published March 20, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Roundhouse Renewable, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0009, for a 1041 Major Facility of a Public Utility (a new above ground single -circuit 230 kV transmission line that will extend through 3.9 miles in Weld County) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. • Chair Pro-Tem Freeman reviewed for the applicant and the public, the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present and Chair Kirkmeyer excused. • Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and stated the proposed pipeline line will cross 3.9 miles in Weld County and will be placed in a 150 -foot -wide easement. He explained the pipeline is a segment of the Roundhouse project, described its route, and stated as of the Planning Commission hearing, all involved jurisdictions had approved the project except Weld County and The State of Colorado Land Board. He mentioned the Department of Planning Services received a letter of support from the Duck Creek Grazing Association, and no other correspondence had been received. Mr. Gathman stated the applicants will work with affected landowners to minimize the disruption of livestock grazing, and displayed images of pipeline route. He stated transmission lines are exempt from the drainage requirement, however, the applicant did provide a Drainage Narrative. • Lauren Light, Department of Public Health and Environment, stated portable toilets may be used along the construction route, explained if they disturb over 25 acres they will need an Air Emissions Permit through the State, and mentioned DS #9-15 address Environmental Health items • Jeremy Call, associate with Logan Simpson, represented the applicant. He displayed a PowerPoint presentation and noted the type of pipeline material had changed since the application was originally submitted. He provided information about the transmission line, such as typical pipeline height, width of the permitting corridor and easement, and indicated Roundhouse Renewables, LLC, is agreeable to all of the Conditions of Approval (COA) and Developments Standards (DS) as written. He explained the benefits to Weld County, described the approved permits and easements acquired to date, and in response to Commissioner Conway, Mr. Call provided clarification on the landowner agreements. In response to Commissioner James, Mr. Call indicated it added substantial cost to build the pipeline in a straight line, and in response to Commissioner Conway, Mr. Call stated there are no wind farms in the Platte River Power service area, the City of Fort Collins, or Larimer County. • No public testimony was offered concerning this matter. ▪ After discussion about Conditions of Approval and Development Standards, the Board agreed to remove the portable toilet screening language in DS #14. • Commissioner Conway described the reasoning behind his support of this project and Commissioners James agreed with Commissioner Conway's comments. Commissioner Moreno moved to approve the request of Roundhouse Renewable, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0009, for a 1041 Major Facility of a Public Utility (a new above ground single -circuit 230 kV transmission line that will extend through 3.9 miles in Weld County) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner James, and it carried unanimously.
