Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: A Site Specific Development Plan and Use by Special Review Permit for any Use permitted as a Use by Right, an Accessory Use or a Use by Special Review Permit in the Commercial or Industrial Zone Districts (semi -truck parking for a sand and gravel hauling business) provided that the property is not a lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. This project is north of and adjacent to SH 52 and is west of CR 43. Parcel number 147304000033. Access is from Colorado State Highway 52. ACCESS Weld County Public Works has reviewed the application materials related to access, and has determined that the site has access on Colorado State Highway 52. ROADS AND RIGHTS -OF -WAY The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to state highways. Please contact Tim Bilobran at the Greeley office (970-350-2163) to verify the access permit or for any additional requirements that may be needed. (State Highway 52) DRAINAGE REQUIREMENTS This area IS within a Non -Urbanizing Drainage Area: Non -Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON - URBANIZING areas. Detention Pond summarized in a Drainage Report: The applicant submitted a drainage letter requesting an exemption from providing a drainage report and on -site stormwater detention. The information contained in the letter is inconsistent with the project Site Plan. The Site Plan shows the truck parking area will be approximately 80,000 square feet (SF) and have an all-weather gravel surface. The proposed truck parking area is currently comprised of a grassed/dirt corral and a grassed pasture. The exemption sited in the letter for not needing a drainage report and stormwater detention allows for a onetime exception for a new 2,000 SF building or equivalent imperviousness. The equivalent imperviousness for a gravel parking area (40% imperviousness) would allow for the addition of up to 4,500 SF of gravel packed surface. This 4,500 SF allowable area is considerably less than the 80,000 SF area shown on the applicant's Site Plan. Therefore, the applicant shall submit a preliminary drainage report for review. A final drainage report and detention pond design completed by a Colorado Licensed Professional Engineer is required prior to recording the USR map. The drainage report must include a certification of compliance stamped and signed by the PE. A Certification of Compliance form can be found on the Public Works Development Review website. General drainage report checklist is available on the engineering website. More complete checklists are available upon request. GRADING PERMIT A Weld County Grading Permit is required when disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant, Public Works and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Public Works for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575. CONDITIONS OF APPROVAL A. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional Engineer registered in the State of Colorado is required. (Department of Public Works) B. If applicable, the applicant shall submit a recorded copy of any agreement signed by all of the owners of the property crossed by the access. The access shall be for ingress, egress, utilities and shall be referenced on the USR map by the Weld County Clerk and Recorder's Reception number. (Department of Public Works) C. The plan shall be amended to delineate the following: 1. Show the approved Colorado Department of Transportation (CDOT) access on the site plan and label with the approved access permit number if applicable. (Department of Public Works) 2. Show and label the accepted drainage features and drainage flow arrows. Stormwater ponds should be labeled as "Stormwater Detention, No -Build or Storage Area" and shall include the calculated volume. (Department of Public Works) 3. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around the property. (Department of Public Works) Prior to Construction: If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required. (Department of Public Works) DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works) 2. The existing residence is served by an existing domestic well (permit 043282-F) and a septic system permitted for 3 bedrooms (SP -0000595). A portable toilet and bottled water will be provided for employees, which is acceptable according to EH policy. No fuel storage, associated emissions, washing of vehicles or floor drains will be on site. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 3. The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 4. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. 5. The facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S. 6. Adequate drinking, hand washing and toilet facilities shall be provided for employees, at all times. For employees or contractors on site for less than 2 consecutive hours a day, and 2 or less full time employees on site, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 7. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On -site Wastewater Treatment Systems. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 10.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. Unfortunately, the County's response date for USR18-0111 fell in-between Planning Commission dates. So, the Planning Commission did not formally hear or respond to this request. However, the general consensus of the Planning Commissioner's is that they are fine with the USR, however they would like conditions of approval placed on the USR so the parcel does not become a junk/salvageyard. Water Division 1, Water District 2 Dear Mr. Hall, This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office wilt only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a welt permit, or physical availability of water. According to the submitted information, the Applicant is seeking a site specific development plan and use by special review permit for a semi -truck parking for a sand and gravel hauling business in the A (Agricultural) Zone District. The referral information indicated that the property will be used for a single-family residence with a home office and by a trucking company. Bottled water and portable toilets would be used for the employees that use the property. However there will also be instances when the employees will use the residence facilities for drinking and sanitary purposes. The referral information indicates also that the well operating under permit no. 43282-F is located on the property. Well permit no. 43282-F was issued on May 10, 1994, pursuant to 37-90-137(4) C.R.S. and the decree granted by the Division 1 Water Court in Case No. 90CW065. The maximum average annual amount of ground water to be appropriated by this well is limited to 1 acre-foot, and the combined average annual amount of ground water to be appropriated by this welt and well permit nos. 36075-F and 35250-F is limited to 27.5 acre-feet. The welt is producing water from the nontributary Laramie -Fox Hills aquifer. The use of ground water from this welt is limited to the decreed uses identified in case no. 90CW065, which are domestic, industrial, agricultural, commercial, irrigation, stock watering, recreational, fish and wildlife, and fire protection. The applicant will need to obtain a new access permit for the change of use of the access. If no surfacing or grading of the parking area is planned, CDOT will not require a drainage study.
