B. 1041 Technical Bulletin Number 4 I have sent copies of Technical Bulletin Number 4, Work Plan Guideline, to your county land use administrator or county representative working with H. B. 1041 . Copies are also available from our field offices and from the Division of Planning. This bulletin supplements Technical Bulletin Number 1 , Suggested Outline: County Work Plan for Identification and Designation of Matters of State Interest, and other bulletins prepared by the Department of Local Affairs, Division of Planning. Its purpose is to provide assistance in completing work plans, and the Department of Local Affairs will use it as a standard for evaluating these plans. Our field representatives are available to assist in the preparation of these plans. Do not hesitate to contact them. A list of the field representatives is attached. I am requesting that counties submit their work plans by November 1 , 1974. The work plan will be used in determining the allocation of the "supplemental planning funds." A number of state agencies are now preparing guidelines which will be sent to you. These documents will deal with specific matters of state interest, including guidelines for identification, designation and administration. Please feel free to contact the Division of Planning or our field representative assigned to your area for any matters of interpretation or assistance. Schmuckg SUBJECT: Model Wildfire Hazard Area Control Regulations and Model Geologic Hazard Area Control Regulations The Division of Planning has been asked to mail copies of Model Wildfire Hazard Area Control Regulations and Model Geologic Hazard Area Control Regulations to your county land use administrator or county representative working with H. B. 1041 and cities over 1 ,000 population. Copies are alsb available from the Division of Planning field offices and from the Division of Planning in Denver. These two documents are model regulations for controlling wildfire and geologic hazards as required in H. B. 1041 . The State Geological Survey and the State Forest Service have also prepared guidelines for identification and designation pertaining to wildfire and geologic hazards. After adoption of these guidelines the Land Use Commission will forward copies to local governments for their use. As you may recall, earlier in Septem ber Model Flood Plain Regulations, pre- pared by the Water Conservation Board, were forwarded to local governments. In the preparation of these regulations it was possible to achieve some cooperation among the Water Conservation Board, the Geological Survey and the Forest Service. However, it is quite apparent from a comparison of the model regu- lations that a much greater degree of coordination can be achieved. Consequently, a redrafting and coordinating effort is being undertaken immediately to prepare a standardized set of regulations. This effort will be organized by John R. Bermingham, Assistant to the Governor, in cooperation with the Department of Local Affairs, the agencies that originated the regulations, and interested county attorneys and private attorneys. Denver, Colorado 80203 303-892-2771 August 30, 1974 Dear County Commissioner: There apparently is a misunderstanding about H.B. 1041 monies . The $25,000 is to be used to implement the provisions of this bill. Since the funds expended in this program will be audited, it is advisable that the money be accounted for and expenditures clearly identified as a part of the approved 1041 program. The funds may be used for personnel if designated to carry out the provisions of H.B. 1041 as outlined in your work program, or you may contract with the regional organization to do the work. Related costs such as travel and operating expenses are permissible. I trust this more clearly explains the use of the $25,000, but should you have any questions please call. Sincerely, J D. VANDERH00F =Y Governor ' September 11, 1974 -7 sra I Weld County Commissioners «_ 1 County Courthouse tF. 4/, Greeley, Colorado 80631 Gentlemen: The Colorado Open Mining Land Reclamation Act as amended by the Legislature during the 1973 session established a Land Reclamation Board which has authority to establish rules and regulate the reclamation of all open mining in the state, including cities and counties. Any operator who engages in open mining after July 1, 1973 must obtain an Open Mining Permit from the Land Reclamation Board. Counties, like the Colorado Division of Highways, are not exempt from this law and must obtain a permit for their sand and gravel operations. A copy of the law, in pamphlet form, was included in our packet concerning HB 1041 which was mailed to you earlier. Printed in the pamphlet are the various forms to be used in this program. When applying for a permit to perform open mining, the operator must first submit a complete Application for Permit to Operate Open Mining Mining (Form LRB 1) as shown on pages 23-26 and an Operator's Plan of Reclamation as shown on pages 32-33. Second, a field trip by the staff of the Land Reclamation Board will be made and a land stabilization and reclamation agreement will be drawn up following the format on pages 19-22. Third the Land Reclamation Board will meet to approve the permit; then a permit will be issued if approved. No bond or permit fee will be charged at this time as we are awaiting a ruling from the Attorney General's office on city, county and state fees. *Se, ca/ C. ,LORADO DIVISION OF M .
