The claim of the Brewster Motor Co. , Reception # 5267, in the amount of $15.00, for
Auto for Coroner' s Witnesses, was disallowed by reason of "County not liable tor transportation
of witnesses as they get their witness fees & mileage.

Pursuant to law, the Board sat throughout the day. as a Board of equalization, adjusting and
equalizing the assessment of all taxable property within Weld County for the year 1921, as
\ assessed and certified to b;: County Assessor, Robert E Hanna, upon abstracted assessment
\ heretofore filed with the Board.

STATE ROAD # 49.
RESOLUT I ON.
Member F. L. Powars introjuced and moved the adoption of the following resolution:
RESOLVED, That with reference to State Highway No. 49, and more particularly that portion
of the highway known and designated as Federal Aid Project No./.4 extending through the Town
of Evans from its north town limits to its soutn boundary, in a general course along a strip
fifty feet in width along the west side of Union racific Railroad right of way through said tows
excepting as deviation from said course is made to pass between the beet dump of The Great
Western railroad and the mill of The Colorado Milling and Elevator Company,
Upon promptly declaring said strip to be a public street of the Town of Evans, the
County of Weld will pay all expense of obtaining right of way, both for purchase money of
acquiring the land therefor and for legal expense in any proceedings necessary to obtain title,
subject only to the condition that no agreements for payments of right of way shall be made
except with approval of the Board of County Commissioners or their County Attorney, and provided
also, that the Town of Evans will permit any condemnation or other proceedings necessary for
such purpose to be brought in the name of the town, and will ex,oute such papers as are
necessary for promptly proceeding with obtaining any portion of r':ghts of way not n.lroady
acquired.
Said motion was duly seconded and vote was had thereon resulting as follows:

IN THE MATTER OF REBATE
' a� .ABATEMENT AND CORRECTION OF TAXES.
The petitions of various County Banks for Rebates of taxes of 1913, in the sum of
$16,202.28 , and the same for taxes of 1914, in the sum of $6516.23, were returned by the
Colorado tax com mission without official action thereon, but enclosing a letter under date of
August 18th, signed by C. P. Link, a member of said Commission, stating that the action of
the County Assessor and Board of County Commissioners in disapproving these petitions "meets
with the approval of this Commission. "-
There being no further business for the day, a recess was ordered taken to 9: 00 o'clock

The Board having carefully considered the report of the viewers herein, as well as
the objections made thereto, and finding the report correct as to form, and believing the
publi^ good requires the laying out of the road as recommended by the viewers, it was on
motion ordered that the report be approved and adopted and the road therein described and
recommended by the viewers be and is hereby declared public highway. T: e Clerk is directed
to reoord the report , plat the road, draw warrants . in favor of parties for damages awarded,
and cause notifies to be posted of opening of said road, and notify the Road Overseer of
proper district to open the same to travel in sixty days as required by law. �.

starting point at 11: 00 o'clock A. M. , Monday the 26th day of September, 1921, and view the
line of road herein prayed for and file their report thereon, as required by law, with the

There was presented to the Board a petition signed by residents and voters of Justice Prect
Precinct # S, asking for the appointment of Wi J1iam Lawley as Constable of said Precinct , to
fill vacancy caused by the failure of the person elected, to qualify. And the Board having
considered said petition, on motion it was ordered that said Williac! Lawley be and he hereby r
is appointed to fill such vacancy, provided he qualifies as required by law.

There was presented to the Board, Warranty Deed of John R. Phelps, conveying about
one-half acre more or less , of land in the S. E. Quarter of the S. E. Quarter of Section 11, Ty

}��'' of V. W. Conner to purchase 36 certain tax sale. Certificates, belonging to Well County, on
lots 1thin the Townsite of Kuner. In which said Conner agrees to purchase said certificates
for face, without interest , penalties or fees. And the Board having considered said matter,
ard deeming it to the best interest of Weld County to do so, on motion it was ordered that
said certificates, being all tar sale Certificates now outstanding on said lots of the
sales of 1912 to 1915 inclusive, be sold to said v. W. Conner, in accordance with said
application. . And the County Treasurer is hereby authorized and directed to assign and
surrender to said V. W. Conner, said certificates, in accordance herewith.
IN ThE MATTER OP A SIGNMENT
TAX SALE CERTIFICATE
949- 1911.
Came before the Board T. C. Phillips, County Treasurer, and presented the application of
the Consolidated Coal & Coke Company to purchase Tax Sale Certificate # 949, of t e sales of
1911, with subsequent indorsements thereon. And it appearing to the Board that the assessment
on which said sale was made, was an error, and said applicant having offered the sum of $24.00
plus fees, and the Board having considered it to the best interest of Weld County, on motion
it was ordered that said offer be accepted. And the County Treasurer is hereby authorized
and direoed to assign and surrender to said The Consolidated Coal & Coke Company, said
certificates upon lots 7 and S, Block 7, in the Town of Daoona, upon payment of $24.00, plus
assignment fees.

" Be it Resolved that tr:e Board of County Commissioners request the State Highway
Commission to open and declare a state road the line so surveyed by said Aighway Commission
from the filling station north of La Salle, along the west line of the right of 'Ply of the
Union Pacific Railroad to the intersection of State Road # 49 North of Platteville. "

The Buarn of County Commissioners, sitting as 9 Board of Equalization, having consider-
ed the protest ,of the Great Western Sugar Con;any, on the increase 8£ assessment of its three
sugar factories in Weld County, and its petition for adjustment hereon, whloh said protest
and petition was filed at its first ;meeting, Sept. 6th, and havi heard the arguments both for
and against sa ' petition, and the time for consideration being too short , said matter having
been continued em :ire to time , to this date , Commissioner Powars moved the adoption of the
following reso talon:
" WHEREAS, the Greet Western Sugar Company, in its tax schedules for the year 1921,
returned the luation of each of its three sugar factories at Eaton, Greeley and Windsor, in
Weld County, a one million dollars.
AND WHEREAS, the County Assessor has assumed to increase said valuation to one million,
two hundred and eighty thousand dollars ($1,280,000. 00) .

AND WTTERE►S, it appears that the increase of valuation placed upon said sugar factories
is exoessive and out of proportion to the valuations for 1921, placed upon like sugar factories
in other Counties of Colorado and is out of proportion and exoessive as compared to the
valuations placed upon other property for taxation in Weld County, for the year 1921;
and that the valuation of said factories in Weld County, of one million dollars ($1,000,000.00) •
each, is fair and that any increase of valuation above that amount Would be unjust and excessive
TPEREFORE, BE IT RESOLVED that the assessment of said Company' s three sugar factories in We
O Weld County, for 1921, be fixed at one million 1,000,000. 00) d liars each, and t r.at the
assessment thereof by the County Assessor, at a greater amount , the set aside , and said
valuations placed in the tax schedules of said Company, be reinstated and accepted by the

Gentlemen:
The Great Western Sugar Colpany considers that the taxes paid in the years 1920 and 1921,
on the valuations of its sugar factories in Weld County, over and above the valuations of
one million dollars on each of said plants, is Unjust and excessive and properly subject to
rebate and refund to this Company. Nevertheless, the Company is willing to waive any claim for
refund of said taxes, provided the County L3oard of Equalization fixes and determines, as the

assessed valuation of said plants, for the year 1921 , a '►aluation of one million dollars for
each plant. And provided that the assessed valuation of one million dollars on eao.h is
not changed in any respect by the State Board of Equalization, or o'.herwise, and that such
assessed valuations are final bases of assessment on said plants for the taxes of 1921,
payable in 1922.

IN THE MATTER OF TRANSFER OF FUNDS.
RESOLUTION BY T'tE BOARD OF COUNTY COMMISSIONERS OF
WELD COUNTY, COLORADO.
Member Dan C. Straight moved the adoption of the following Resolution:
WHEREAS, It appears there is a defioiency of Fifteen Hundred Dollars in the present
balance on hand in the advertising fund less than the amount of outstanding olaims against
said fund,
THEREFORE, BE IT RESOLVED, That tree sum of Fifteen Hundred Dollars be transferred from
the Contingent fund to the advertising fund.

WELD COUNTY FAIR.
RESOLUTION BY THE BOARD OF
COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO.
Member Dan C. `'trafght introduced and moved the adoption of the following resolution:
WHEREAS, it appears from report of The Weld County Fair Assooi^.Lion and of W. A.
Insinger, President of The Weld County Commercial Club, that there is a deficiency of Fifteen
Hundred Dollars in the amount of funds of said Fa. r Association needed to pay premiums and
expenses of conducting said Fair, for the year 1921, and that the success of said Fair is a
credit to, and of value, to the whole of Weld County, and that it is to the interest of the
whole of Weld County that all premiums and expenses of conducting said Fiar should be
honorably and promptly met , to encourage further Fairs, and that such need is a proper purpose
for the advertising fund of Weld County.

THE.REFCR :, BE IT RESnLVED, That warrant iS authorizei to be made and delivered to
The Weld County Commercial Club in the sum and amount of Fifteen Hundred Dollars, to be used
for the purpose, first of paying premiums, and next , of paying other expenses of the 1921
Weld County Fair.

The Presidentand Secretary of the Board of Directors of the Henrylyn Irrigation Di strict ,
Mr. Clarence A. Ireland, and Hugh Matth :ws and the Chairman of the Henrylyn Bond Holders
Committee Fredl•Wright appeared before the Board and upon their request it was resolved that
the Treasurer of Weld County, Colorado is hereby authorized and directed to issue redemption
certificates on all tax sales in the Henrylyn Irrigation District held inthe years previous
to 1921, including tax sales held in 1920, for face and fees without any interest or penalties
upon any irrigation district taxes and all redemptions previously made are hereby approved.
Be It further resolved that this order continue effective until rescinded.

was presented to the Board when the following action was taken and entered of record to—wit:
The Board raving carefully considered the report of the viewers herein, as well as
the objections made thereto, and finding the report correct as to form, and believing the
public good requires the laying out of the road as recommended ,b the viewer;, it wa.s on
motion ordered that the report he approved and adopted, and the oad therein described anti
recommended by the viewers be and is hereby declared a public hi hway. The .C CLerk is directed
to record the report , plat the road, draw warrants in favor of parties for damages awarded, .
and cause notio a to be posted of opening of said road and notify the Road Overseer of proper
District to ope the same to travel in sixty days as required be law.

Committee Fred. R. Wright appeared before the Board- and upon their request- it was resolved
that the Treasurer of Weld County, Colorado, is hereby authorized and dirent•ed, as to that
portion of tax for Irrigation District purposes, to issue redemption certificates on all tax
sales in the Henrylyn Irrigation District held in the years previous to 1921, including tax
sales held in 1920, for face of tax at the date originally .flyable and fees, without any
interest or penalties upon any irrigation district tax either before or after sale , and all
redemptions previously made are hereby approved.
Be it further resolved that this order continue effective until rescinded.

Pursuant to authority received from the Colorado Tax Commission relating to valuations
placed upon property of Companies assessed by said Tax Commission, doing business in Weld County
Colorado, subject to taxation,for the year 1921, on motion regularly made, seconded. and
unanimously carried, it was ordered by the Board of County Commissioners of Weld County,
Colorado, that the proper relative mileage and valuations of said oompanies be distributed to '
the various municipalities of the County and that same be and is hereby now fixed and estab—
lished, and that the same be spread upon the records of this office and the Clerk is hereby
directed to furnish a certified copy thereof to the Assessor of Weld County, empowering him
to extend the same upon the Assessment Rolls of Weld County,Colorado, for the year 1921.

The minutes of the meeting of October 26th were read and there being no objections or
corrections thereto, they were ordered approved.
4 IN THE MATTER OF COMPENSATION OF WATER
COMMISSIONERS FOR TEE MONTHS OF DECEMBER,
1921, AND JANUARY AND FEBRUARY, 1922.
The Board having under consideration the matter of compensation of water commissioners
in the various districts for the months of December, 1921 and January and February, 1922,
Andthe same having been discussed and considered, aid the Board deeming it for the best
interest of Weld County that part time supervision be had by water commissioners in their
respective districts during said months.

Therefore, it is resolved that Weld County will pay its proportionate share for
compensation of said water commissioners' services, for such time as may be necessary in said
months, not exceeding fifteen days in any one month, in the following distriots to wit:
Nos. 1,2,4,5,6 and 7.
And in District #3, for such time as may be necessary, up to full time during said months.
IN THE MATTER OF COLLECTIONS
GREELEY HOSPITAL.
The Board having under consideration the natter of unpaid balance due for services render*
ed at the Greeley Hospital and deeming it for the best interest of Weld County that an effort/
be made to colleot same. And propositions having been received from various attorneys and
oolleotors, the same having been discussed and considered by the Board, on motion it was
ordered that the Weld County Credit Association be and it hereby is appointed County
Collector, for the purchase of collecting such dnounts now due and owing, account said services
at the Greeley Hospital, in accordance with their written proposal on the basis of ten per
cent. of the collections during LIB first sixty days after this day and date. except on
accounts or payments of more than one hundred dollars, shall be five per cent. And on
accounts paid subsequent to sixtd days, of amounts less than ten dollars,. twenty five
per cent. On amounts, ten to one hundred dollars, fifteen per cent ; and on aoo uunt s above
one hundred dollars, ten percent. provided that this contract shall expire on December, 1st ,
1922, and all accounts un-collected at that tiwe , ;,hall be returned without charge , except
upon actual collections made thereon.
IN THE MATTER OF TAX LEVIES
