BROWN TRUST, C/O BENJAMIN BROWN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Road Right -of -Way Petition from Wells Ranch, LLLP, c/o Steve Wells, 32010 County Road 63, Gill, Colorado 80624-9314, and Benjamin D. Brown Trust, c/o Benjamin Brown, 35954 County Road 59, Briggsdale, Colorado 80611-8105, a copy of said petition and a list of the adjoining property owners marked Exhibit A, being attached hereto and included by reference, requesting vacation of a portion of right-of-way for County Road 69, between County Roads 74 and 68, being more fully described as follows: All of Weld County's interest in County Road 69 as it runs along the section line between Sections 2, 3, 10, 11, 14 and 15, all within Township 6 North, Range 63 West of the 6th P.M., in Weld County, Colorado; except for the north 50' of Sections 2 and 3, and the south 30' of Sections 14 and 15, Township 6 North, Range 63 West of the 6th P.M., in Weld County, Colorado, as further described in Exhibit B WHEREAS, the Department of Public Works has recommended approval of said request since that portion of right-of-way is not needed for the safety and welfare of the traveling public, and WHEREAS, any persons owning dedicated and recorded easements and rights -of -way for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by Weld County, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of that portion of right-of-way which is described above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS, the Board of County Commissioners deems it advisable to vacate said portion of road right-of-way, with said vacation to become effective upon recording as required below. 4473616 Pages: 1 of 9 03/15/2019 01:55 PM R Fee:$0.00 Carly Koppes, Clerk and Recorder, Weld County, CO III! Brown Trust, do Benjamin Brown, be, and hereby is, accepted. BE IT FURTHER RESOLVED by the Board that the portion of right-of-way which is described above, be, and hereby is, vacated. BE IT FURTHER RESOLVED by the Board that any persons owning dedicated and recorded easements and rights -of -way for the use of the vacated right-of-way, if any, shall not be affected by the right-of-way vacation authorized herein. BE IT FURTHER RESOLVED by the Board that Weld County shall retain any mineral interests it may possess in the area of the vacated right-of-way and that the vacation authorized herein shall in no way affect such mineral interests. The Right - Of -Way to be vacated lies in Sections 2,3,10,11,14 and 15 all in Township 6 North, Range 63 West of the 6th P.M. adjacent to their property. Currently this road is maintained by Weld County. General Information The segment of County Road 69 to be vacated is a 3 mile stretch of maintained gravel road providing north/south connectivity between County Road 68 and County Road 74. County Road 67 located one mile to the west is a maintained paved road providing north/south connectivity for two miles between County Road 68 and State Highway 392. County Road 83 located seven miles to the east is a maintained gravel road providing north/south connectivity between County Road 68 and County Road 74. The Petitioners own all the land directly adjacent to the proposed right of way to be vacated. Further, Wells Ranch owns the majority of the Section between County Road 69 and County Road 83 where the right of way has been previously vacated as well. In 2016, Weld County worked with CDOT to realign and construct the intersection of Weld County Road 74 and State Highway 392. This project required the acquisition of additional right of way within the area proposed to be vacated. Existing County Road Right of Way Based on the information found we have determined the following: • 30' of ROW exists for CR 69 along in Sections 2,10,14 and 22 based 1889 BOCC Resolution Book 86 Page273 • 60' of ROW (Section 2,3,10,11,14,15) per 1915 Petition recorded at reception number #220696 • ROW of varying width (.73 acres) per Warrant Deed 2017 recorded at reception number 4274714 • The total area of the existing ROW proposed to be vacated is 23.1 acres • The Public Works CIP 5 Year Plan does not identify any improvements to County Road 69 • Previous vacations approved as Petitioned by large landholder. • If the vacation is approved no parcel is left without access. Recommendation Public Works does not typically support requests for right of way vacations to ensure the ability to provide adequate and safe traveling for the public however, given the existing road only severs two landowners who are willing to take on the maintenance of the road and existing drainage culverts, Public Works recommends approving the vacation of right of way. Public Works also recommends retaining a utility easement for any existing utility that may be currently located within the public right of way. Further, Public Works recommends that the vacation should continue south an additional mile include 30' right of way located in the east 30' of the Section 22. REFERRAL RESPONSES ► Briggsdale Fire Protection District: No Concerns ► Eaton School District RE -2: No Concerns ► Xcel Energy: Public Service Company of Colorado (PSCo) owns and operates existing overhead electric distribution facilities within and crossing the right-of- way, and requests that a utility easement is reserved over this area. ► No other responses were received. • DEPARTMENT OF PUBLIC WORKS COMMENTS Existing County Road Right of Way 30' of ROW for CR 69 in Sections 2, 10, 14 and 22 (1889 BOCC Resolution Right -of -Way [Book 86, Page 2733) • 60' of ROW in Sections 2, 3, 10, 11, 14, 15 (1915 Petition Right -of -Way (Recorded with Reception #220696) • ROW of varying width (.73 acres) per 2017 Warranty Deed (Recorded with Reception #4274714) • The total area of the existing ROW proposed to be vacated is 23.1 acres • The Department of Public Works CIP 5 -Year Plan does not identify any improvements to County Road 69 • Previous vacations approved as petitioned by large landholder • If the vacation request is approved, there are no parcels left without access DEPARTMENT OF PUBLIC WORKS RECOMMENDATION ► The Department of Public Works does not typically support requests for right- of-way vacations because the Department aims to ensure the ability to provide adequate and safe traveling for the public; however, given the existing road only severs two landowners who are willing to take on the maintenance of the road and existing drainage culverts, Public Works recommends approving the vacation of right-of-way. ► Further, Public Works recommends that the vacation should continue south an additional mile to include 30' right of way located in the east 30' of the Section 22. This section of ROW will be left as a single strip of public road right-of-way and vacating would remove any need for future ROW permits in a area surrounded by private use. Hello
