Mendoza Annexation
Forward:
This annexation impact report has been prepared pursuant to Section 31-12-108.5 Colorado
Revised Statutes, 1986 Repl. Vol. The exhibits contain maps showing the present and proposed
boundaries of the Town of Frederick, the existing public improvements, and the existing and
proposed land use patterns in the area to be annexed.
I. Project Description — Mendoza Annexation
The property proposed for annexation has a total of 192.62 acres. The Mendoza property is
generally located north of Tipple Parkway/County Road 16 and west of Aggregate
Boulevard/County Road 7.
The land proposed to be annexed is owned by the Town of Frederick and Carlos Mendoza. The
Town purchased the property from Mr. Mendoza as open space with the agreement that a five
acre piece of property would be created for Mr. Mendoza. Currently, the property is zoned
within Weld County as "A", Agricultural. In conjunction with the proposed annexation, the
zoning is proposed to have two zoning districts applied. The property owned by Town is
proposed to be zoned as Agriculture within the Town. The property owned by Mr. Mendoza is
proposed to be zoned as Public within the Town.
The properties adjacent to the annexation have the following land uses. Directly to the south is
currently agriculture but will eventually be developed as residential properties within the
Wyndham Hill neighborhood. To the east, there is existing estate residential and planned low
density residential. To the north are agricultural uses and rural residences on large lots. Tow
the west are estate residential lots and agricultural uses within the County.
II. Municipal Services
Municipal services for the Mendoza Annexation may be provided in the following manner:

• Electricity
Electric services will be provided by United Power. There are
existing overhead electrical lines that run directly adjacent to
the property.
• Telephone Telephone services are able to be provided as desired by the
developer. Land lines are available from CenturyLink.
• Water
• Sanitary Sewer
• Fire
Water service is available to be served by the Left Hand
Water District. Existing water lines are near the property but
will have to be extended to the property once developed.
Sanitary sewer service is greater than 400' from the property
line. If sewer services are extended to within 400' of the
property line prior to development then a connection to
sewer will be required.
The property is currently served by the Mountain View Fire
and Protection District. Once annexed, the property will be
included into the Frederick -Firestone Fire Protection District
and excluded from the Mountain View Fire and Protection
District.
• Police Police service will be provided by the Town of Frederick
Police Department.
• Street Maintenance Maintenance of public roadways within the annexation will
be provided by the Town.
Ill. Method of Financing the Extension of the Municipal Services
The Town of Frederick is not obligated to provide municipal services that require a physical
extension of facilities such as water or sewer lines. Water and sewer services are provided by
separate agreement with a special district. Roadways across the property would be funded by

the Town of Frederick.
IV. Special Districts
The area to be annexed is included within the following special districts:
• St. Vrain Valley School District RE1-J
• Northern Colorado Water Conservancy District
• Left Hand Water District
• Mountain View Fire Rescue District
• High Plains Library District
• Longmont Conservation District
V. School District Impact
The property to be annexed is proposed to be zoned a combination of Agriculture (A) and
Public (P) and will be used as open space and have one single family home. No immediate
impact on the St. Vrain Valley School District RE -1J is anticipated.

Three exhibits are attached to define the present and proposed boundaries of the Town of
Frederick (A), the existing public improvements (B), and the existing and proposed land use
pattern in the area to be annexed (C).

NOTICE OF PUBLIC HEARING
FOR THE MENDOZA ANNEXATION
NOTICE IS HEREBY GIVEN that the Planning Commission will hold a public hearing
commencing on June 18, 2019 at 6:30 pm and that the Board of Trustees will then hold a public
hearing commencing on July 9, 2019 at 7:00 pm at the Frederick Town Hall, 401 Locust Street,
Frederick, Colorado 80530 to consider a Project application received from the Town of Frederick,
401 Locust Street, Frederick, Colorado 80530 and Carlos Mendoza, 7411 Aggregate Boulevard,
Erie, CO, 80516; for real property located within a portion of the Section 28, Township 2 North,
Range 68 West of the 6th P.M., within the Town of Frederick.
The Planning Commission and Board of Trustees will consider whether the proposed request meets
the requirements of the Frederick Land Use Code and whether the request should be granted
approval for the property.
Any person may appear at the public hearing and be heard regarding the matters under
consideration.
Copies of the full application and supporting materials submitted as well as the full-sized maps are
available for review in the Frederick Town Hall, 401 Locust Street, Frederick, Colorado.

RESOLUTION NO. 19-R-45
A RESOLUTION OF INTENT TO ANNEX CERTAIN PROPERTIES IN
WELD COUNTY, COLORADO TO THE TOWN OF FREDERICK, SAID
ANNEXATION TO BE KNOWN AS THE "MENDOZA ANNEXATION"
WHEREAS, petitions for annexation of certain properties has been filed with the Board of
Trustees of the Town of Frederick by the Town of Frederick, 401 Locust Street, Frederick, Colorado,
80530; and
WHEREAS, the Board of Trustees has reviewed the petition; and
WHEREAS, the Board of Trustees wishes to permit consideration of the property for
annexation and zoning, as requested in the petition; and
WHEREAS, the Board of Trustees has reviewed the petition and desires to adopt by
Resolution its findings in regard to the petition; and
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
FREDERICK, COLORADO, AS FOLLOWS:
Section 1. The petitions, whose legal description is attached hereto as Exhibit A and
Exhibit B and incorporated by reference herein, is in substantial compliance with the applicable laws
of the State of Colorado.
Section 2. No election is required under C.R.S. §31-12-107(2).
Section 3. No additional terms and conditions are to be imposed except those provided
for in the petition.
Section 4. The Board of Trustees will hold a public hearing for the purpose of
determining if the proposed annexation complies with C.R.S. §31-12-104, and with C.R.S. §31-12-
105, and will hold a public hearing to determine the appropriate zoning of the subject property as
requested in the petition, at the Frederick Town Hall, 401 Locust, Frederick, Colorado 80530, at the
following time and date:
7:00 P.M., July 9, 2019
Section 5. Any person may appear at such hearing and present evidence relative to the
proposed annexation or the proposed zoning.
Section 6. Upon completion of the hearing, the Board of Trustees shall set forth, by
resolution, its findings and conclusions with reference to the eligibility of the proposed annexation,
and whether the statutory requirements for the proposed annexation have been met, and further, will
determine the appropriate zoning of the subject property if requested in the petition.
Section 7. If the Board of Trustees concludes, by resolution, that all statutory
requirements have been met and that the proposed annexation is proper under the laws of the State of
Colorado, the Board of Trustees shall pass one or more ordinances annexing the subject property into
the Town of Frederick, and shall pass one or more ordinances zoning the subject property if
requested in the petition.

Mendoza Annexation
PETITION FOR ANNEXATION TO THE TOWN OF FREDERICK
DATE: April 12, 2019
TO: THE BOARD OF TRUSTEES OF THE TOWN OF FREDERICK, COLORADO.
I, Carlos Mendoza, the undersigned landowner, in accordance with Colorado law,
hereby petition the Town of Frederick and its Board of Trustees for annexation to the
Town of Frederick of the following described unincorporated territory located in the
County of Weld and State of Colorado, to -wit:
See Exhibit A
As part of this petition, your petitioner further states to the Board of Trustees of
Frederick, Colorado, that:
1. It is desirable and necessary that the territory described in Exhibit A be
annexed to the Town of Frederick.
2. The requirements of C.R.S. sections 31-12-104 and 31-12-105, as
amended, exist or have been met in that:
a. Not less than one -sixth of the perimeter of the area proposed to be
annexed is contiguous with the Town of Frederick or will be
contiguous with the Town of Frederick within such time as required
by 31-12-104.
b. A community of interest exists between the area proposed to be
annexed and the Town of Frederick.
c. The area proposed to be annexed is urban or will be urbanized in
the near future.
d. The area proposed to be annexed is integrated with or is capable of
being integrated with the Town of Frederick.
e. No land within the boundary of the territory proposed to be
annexed which is held in identical ownership, whether consisting of
one tract or parcel of real estate or two or more contiguous tracts
or parcels of real estate, has been divided into separate parts or
parcels without the written consent of the landowner or landowners
thereof, unless such tracts or parcels were separated by a

dedicated street, road or other public way.
f. No land within the boundary of the area proposed to be annexed
which is held in identical ownership, comprises twenty acres or
more, and which, together with the buildings and improvements
situated thereon has an assessed value in excess of two hundred
thousand dollars ($200,000.00) for ad valorem tax purposes for the
year next preceding the annexation, has been included within the
area proposed to be annexed without the written consent of the
landowner or landowners.
g. No annexation proceedings have been commenced for any portion
of the territory proposed to be annexed for the annexation of such
territory to another municipality.
h. The annexation of the territory proposed to be annexed will not
result in the detachment of area from any school district.
The annexation of the territory proposed to be annexed will not
have the effect of extending the boundary of the Town of Frederick
more than three miles in any direction from any point of the
boundary of the Town of Frederick in any one year.

Prior to completion of the annexation of the territory proposed to
be annexed, the Town of Frederick will have in place a plan for that
area, which generally describes the proposed: Location, character,
and extent of streets, subways, bridges, waterways, waterfronts,
parkways, playgrounds, squares, parks, aviation fields, other public
ways, grounds, open spaces, public utilities, and terminals for
water, light, sanitation, transportation, and power to be provided
by the Town of Frederick; and the proposed land uses for the area;
such plan to be updated at least once annually.
k. In establishing the boundary of the territory proposed to be
annexed, if a portion of a platted street or alley is to be annexed,
the entire width of the street or alley has been included within the
territory to be annexed. The Town of Frederick will not deny
reasonable access to any landowners, owners of any easement, or
the owners of any franchise adjoining any platted street or alley
which is to be annexed to the Town of Frederick but is not bounded
on both sides by the Town of Frederick.
3. The owners of more than fifty percent of the area proposed to be
annexed, exclusive of dedicated streets and alleys, have signed this

petition and hereby petition for annexation of such territory.
4. Accompanying this petition are four copies of an annexation map
containing the following information:
a. A written legal description of the boundaries of the area proposed
to be annexed;
b. A map showing the boundary of the area proposed to be annexed,
said map prepared and containing the seal of a registered
engineer;
c. Within the annexation boundary map, a showing of the location of
each ownership tract in unplatted land and, if part or all of the area
is platted, the boundaries and the plat numbers of plots or of lots
and blocks;
d. Next to the boundary of the area proposed to be annexed, a
drawing of the contiguous boundary of the Town of Frederick and
the contiguous boundary of any other municipality abutting the
area proposed to be annexed, and a showing of the dimensions of
such contiguous boundaries.
5. Upon the Annexation Ordinance becoming effective, all lands within the
area proposed to be annexed will become subject to all ordinances, rules
and regulations of the Town of Frederick, except for general property

zoned Public District. The remaining approximately 189 acres east of the half
section line will be zoned Agricultural District.
The plat will create one buildable lot on approximately 5 acres and the plat will be
submitted as soon as the surveyor completes the document with utilities identified
on it. The remainder of the property will be open space for the Town of Frederick.
The property currently has one home and multiple agricultural outbuildings on it
and is zoned agricultural by Weld County.

(C) The information regarding special districts and the boundaries of such districts may be obtained from the Board of
County Commissioners, the County Clerk and Recorder, or the County Assessor.
Note: Effective September 1, 1997, CRS 30-10-406 requires that all documents received for recording or filing in the clerk
and recorder's office shall contain a top margin of at least one inch and a left, right and bottom margin of at least one half of
an inch. The clerk and recorder may refuse to record or file any document that does not conform, except that, the
requirement for the top margin shall not apply to documents using forms on which space is provided for recording or filing
information at the top margin of the document.
Note: Colorado Division of Insurance Regulations 8-1-2 requires that "Every title entity shall be responsible for all matters
which appear of record prior to the time of recording whenever the title entity conducts the closing and is responsible for
recording or filing of legal documents resulting from the transaction which was closed". Provided that Land Title Guarantee
Company conducts the closing of the insured transaction and is responsible for recording the legal documents from the

Note: Affirmative mechanic's lien protection for the Owner may be available (typically by deletion of Exception no. 4 of

(E) If there has been construction, improvements or major repairs undertaken on the property to be purchased within six

disclosure of certain construction information; financial information as to the seller, the builder and or the contractor;
payment of the appropriate premium fully executed Indemnity Agreements satisfactory to the company, and, any
additional requirements as may be necessary after an examination of the aforesaid information by the Company.
No coverage will be given under any circumstances for labor or material for which the insured has contracted for or agreed
to pay.

This notice applies to owner's policy commitments disclosing that a mineral estate has been severed from the surface
estate, in Schedule B-2.

COMMITMENT TO ISSUE POLICY

Company, a Minnesota corporation (the "Company"), commits to issue the Policy according to the terms and provisions of this Commitment. This Commitment is
effective as of the Commitment Date shown in Schedule A for each Policy described in Schedule A, only when the Company has entered in Schedule A both the
specified dollar amount as the Proposed Policy Amount and the name of the Proposed Insured. If all of the Schedule B, Part I —Requirements have not been met

COMMITMENT CONDITIONS
1. DEFINITIONS
(a)"Knowledge" or "Known": Actual or Imputed knowledge, but not constructive notice Imparted by the Public Records.
(b)"Land": The land described In Schedule A and affixed improvements that by law constitute real property. The term "Land" does not Include any
property beyond the lines of the area described in Schedule A, nor any right, title, Interest, estate, or easement In abutting streets, roads, avenues,
alleys, lanes, ways, or waterways, but this does not modify or limit the extent that a right of access to and from the Land is to be insured by the
Policy.
(c)"Mortgage": A mortgage, deed of trust, or other security instrument, including one evidenced by electronic means authorized by law.
(d) "Policy": Each contract of title insurance, in a form adopted by the American Land Title Association, issued or to be issued by the Company pursuant
to this Commitment.
(e) Proposed Insured": Each person identified in Schedule A as the Proposed Insured of each Policy to be issued pursuant to this Commitment.
(f) "Proposed Policy Amount": Each dollar amount specified in Schedule A as the Proposed Policy Amount of each Policy to be issued pursuant to this
Commitment.
(g)"Publiic Records": Records established under state statutes at the Commitment Date for the purpose of imparting constructive notice of matters
relating to real property to purchasers for value and without Knowledge.
(h)"Title°: The estate or interest described in Schedule A.
2. If all of the Schedule B, Part I —Requirements have not been met within the time period specified in the Commitment to Issue Policy, Comitment terminates and
the Company's liability and obligation end.
3. The Company's liability and obligation is limited by and this Commitment Is not valid without:
(a)the Notice;
(b)the Commitment to Issue Polcy;
(c)the Commitment Conditions;
(d)Schedule A;
(e)Schedule B, Part I —Requirements; and
(f) Schedule B, Part II —Exceptions; and
(g)a counter -signature by the Company or its issuing agent that may be in electronic form.
4. COMPANY'S RIGHT TO AMEND
The Company may amend this Commitment at any time. If the Company amends this Commitment to add a defect, ben, encumbrance, adverse claim, or
other matter recorded in the Public Records prior to the Commitment Date, any lability of the Company is limited by Commitment Condition 5. The Company
shall not be liable for any other amendment to this Commitment.
5. LIMITATIONS OF LIABILITY
(a)The Company's liability under Commitment Condition 4 is limited to the Proposed Insured's actual expense incurred in the interval between the
Company's delivery to the Proposed Insured of the Commitment and the delivery of the amended Commitment, resulting from the Proposed Insured's
good faith reliance to:
i. comply with the Schedule B, Part I —Requirements;
ii. eliminate, with the Company's written consent, any Schedule B, Part II —Exceptions; or
ill. acquire the Title or create the Mortgage covered by this Commitment.
(b)The Company shal not be liable under Commitment Condition 5(a) if the Proposed Insured requested the amendment or had Knowledge of the matter
and did not notify the Company about it in writing.
(c)The Company will only have liability under Commitment Condition 4 if the Proposed Insured would not have incurred the expense had the
Commitment included the added matter when the Commitment was first delivered to the Proposed Insured.
(d)The Company's lability shall not exceed the lesser of the Proposed Insured's actual expense Incurred in good faith and described in Commitment
Conditions 5(a)(i) through 5(a)(iii) or the Proposed Policy Amount
(e)The Company shall not be liable for the content of the Transaction Identification Data, if any.
(f) In no event shall the Company be obligated to issue the Poicy referred to in this Commitment unless all of the Schedule B, Part I —Requirements have
been met to the satisfaction of the Company.
(g)In any event, the Company's liability is limited by the terms and provisions of the Policy.
6. LIABILITY OF THE COMPANY MUST BE BASED ON THIS COMMITMENT
(a)Only a Proposed Insured identified in Schedule A, and no other person, may make a claim under this Commitment.
(b)Any claim must be based in contract and must be restricted solely to the terms and provisions of this Commitment.
(c)Until the Policy is issued, this Commitment, as last revised, Is the exclusive and entire agreement between the parties with respect to the subject
matter of this Commitment and supersedes all prior commitment negotiations, representations, and proposals of any kind, whether written or oral,
express or implied, relating to the subject matter of this Commitment.
(d)The deletion or modification of any Schedule B, Part II —Exception does not constitute an agreement or obligation to provide coverage beyond the
terms and provisions of this Commitment or the Policy.
(e)Any amendment or endorsement to this Commitment must be In writing and authenticated by a person authorized by the Company.
(f) When the Policy is issued, all lability and obligation under this Commitment will end and the Company's only liabilty will be under the Policy.
7. IF THIS COMMITMENT HAS BEEN ISSUED BY AN ISSUING AGENT
The Issuing agent is the Company's agent only for the limited purpose of issuing title insurance commitments and poicies. The Issuing agent is not the
Company's agent for the purpose of providing dosing or settlement services.
8. PRO -FORMA POLICY
The Company may provide, at the request of a Proposed Insured, a pro -forma policy illustrating the coverage that the Company may provide. A pro -forma
policy neither reflects the status of Title at the time that the pro -forma policy is delivered to a Proposed Insured, nor is it a commitment to insure.
9. ARBITRATION
The Policy contains an arbitration clause. All arbitrable matters when the Proposed Policy Amount is $2,000,000 or less shall be arbitrated at the option of
either the Company or the Proposed Insured as the exclusive remedy of the parties. A Proposed Insured may review a copy of the arbitration rules at

I, Mayor Tony Carey, the undersigned landowner, in accordance with Colorado
law, hereby petition the Town of Frederick and its Board of Trustees for annexation to
the Town of Frederick of the following described unincorporated territory located in the
County of Weld and State of Colorado, to -wit:

As part of this petition, your petitioner further states to the Board of Trustees of
Frederick, Colorado, that:
1. It is desirable and necessary that the territory described in Exhibit A be
annexed to the Town of Frederick.
2. The requirements of C.R.S. sections 31-12-104 and 31-12-105, as
amended, exist or have been met in that:
a. Not less than one -sixth of the perimeter of the area proposed to be
annexed is contiguous with the Town of Frederick or will be

or parcels of real estate, has been divided into separate parts or
parcels without the written consent of the landowner or landowners
thereof, unless such tracts or parcels were separated by a

dedicated street, road or other public way.
f. No land within the boundary of the area proposed to be annexed
which is held in identical ownership, comprises twenty acres or
more, and which, together with the buildings and improvements
situated thereon has an assessed value in excess of two hundred
thousand dollars ($200,000.00) for ad valorem tax purposes for the
year next preceding the annexation, has been included within the
area proposed to be annexed without the written consent of the
landowner or landowners.
g.
No annexation proceedings have been commenced for any portion
of the territory proposed to be annexed for the annexation of such
territory to another municipality.
h. The annexation of the territory proposed to be annexed will not
result in the detachment of area from any school district.
j•
The annexation of the territory proposed to be annexed will not
have the effect of extending the boundary of the Town of Frederick
more than three miles in any direction from any point of the
boundary of the Town of Frederick in any one year.
Prior to completion of the annexation of the territory proposed to
be annexed, the Town of Frederick will have in place a plan for that
area, which generally describes the proposed: Location, character,
and extent of streets, subways, bridges, waterways, waterfronts,
parkways, playgrounds, squares, parks, aviation fields, other public
ways, grounds, open spaces, public utilities, and terminals for
water, light, sanitation, transportation, and power to be provided
by the Town of Frederick; and the proposed land uses for the area;
such plan to be updated at least once annually.
k. In establishing the boundary of the territory proposed to be
annexed, if a portion of a platted street or alley is to be annexed,
the entire width of the street or alley has been included within the
territory to be annexed. The Town of Frederick will not deny
reasonable access to any landowners, owners of any easement, or
the owners of any franchise adjoining any platted street or alley
which is to be annexed to the Town of Frederick but is not bounded
on both sides by the Town of Frederick.
3. The owners of more than fifty percent of the area proposed to be
annexed, exclusive of dedicated streets and alleys, have signed this

petition and hereby petition for annexation of such territory.
4. Accompanying this petition are four copies of an annexation map
containing the following information:
a. A written legal description of the boundaries of the area proposed
to be annexed;
b. A map showing the boundary of the area proposed to be annexed,
said map prepared and containing the seal of a registered
engineer;
c. Within the annexation boundary map, a showing of the location of
each ownership tract in unplatted land and, if part or all of the area
is platted, the boundaries and the plat numbers of plots or of lots
and blocks;
d. Next to the boundary of the area proposed to be annexed, a
drawing of the contiguous boundary of the Town of Frederick and
the contiguous boundary of any other municipality abutting the
area proposed to be annexed, and a showing of the dimensions of
such contiguous boundaries.
5. Upon the Annexation Ordinance becoming effective, all lands within the
area proposed to be annexed will become subject to all ordinances, rules
and regulations of the Town of Frederick, except for general property
taxes of the Town of Frederick which shall become effective as the
January 1 next ensuing.
6. The zoning classification requested for the area proposed to be annexed is
Public.

Frederick, acting through its Board of Trustees, approve the annexation of the
