PUBLIC WORKS COMMENTS: 1. There is natural drainage from WCR 49(determined by the county when 49 was expanded) running SE to NW through our property (25311 CR 49) ending up in Mr. Mark Hamilton's field. Since most of our property is sand, runoff is easily absorbed. Lauren, In answer to the questions you posed to Mike in your 6/24 email ...all persons(employees) who come onto the property use our residence restrooms. We have a double septic, installed before we closed on this property in the Fall of '86. (There is only one septic system with an additional tee added at time of purchase as condition of sale, but the 2nd residence was permitted to flow into the existing septic in 2010...will scan the septic permits for both to you). Hamilton has received from you a request to allow your small trucking business to have equipment access through Mr. Hamilton's property. While previous consent has been informally provided, it was never Mr. Hamilton's intent to grant a permanent right-of-way to you or your business.. check of the county's online records shows that there is no valid right-of-way existing over Mr. Hamilton's property and that, to this point, such access has been purely by r. Hamilton's permission. This letter is to inform that Mr. Hamilton has decided to withdraw permission for your business to use his land and may be shortly putting up a fence to block access through his property. I was disappointed that you did not come to me to discuss the matter before engaging a lawyer. In the past, when your dad, Mel, asked to file water rights on the ditch crossing my property, l did not object and when he asked to split his land to develop his property into lots, again I did not object. Now I am asking to continue using Hamilton road access which your dad graciously agreed to and you have refused , To say I am disappointed is an understatement and I hope you might reconsider. Hi Evan, Cindy Stark here concerning our PRE19-0037(Stark) status...My phone # is 970-353-3313 if you would like to call me for vocal confirmation of anything. Meanwhile, I'm not understanding what an "exception" is and have no idea which one I would be applying for . Secondly, I tried to answer other questions to the best of my ability...we have no "origination" of any water other than rain water, no other water flows onto to our property from anywhere else. Rainwater doesn't ever "leave" our property, it soaks into the sand(our property is essentially a huge sand pile), if the rain is substantial enough to actually "flow", it "flows" from the highest point of the property, (which is the residence itself)d own toward the lowest point,(which is in the direction of the driveway leading to CR 49), that would be from east to west...we have never had drainage problems with this property as long as we have lived here (since 1986). I don't know any other way to answer your questions???? Please call me if we need to discuss anything. And I would appreciate your help understanding "exception"... Cindy Stark 2 Hello
