WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Authorization for Hazmat Spill Mitigation and Clean -Up between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Office of Emergency Management, and Custom Environmental Services, Inc., commencing upon full execution, with further terms and conditions being as stated in said authorization, and WHEREAS, after review, the Board deems it advisable to approve said authorization, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Authorization for Hazmat Spill Mitigation and Clean -Up between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Office of Emergency Management, and Custom Environmental Services, Inc., be and hereby is, approved. The spill was drilling mud. Due to the amount of mud spilled on CR 18 the roadway had to be closed for cleanup. We contacted Public Works and talked to them to see if they were able to clean up the product on the road. Public Works indicated they did not have any crews available to complete the cleanup. Custom Environmental was contacted and requested to respond to complete the mitigation of the product on the roadway and complete the cleanup. Custom environmental completed this task and sent us the attached document to sign for proper disposal of the product (Drilling Mud) This is a rear incident and typically we have the company identified that caused the spill, through investigation we have not been able to identify who spilled the product. Therefor we do not have a way to recover the cost for cleanup. I'm requesting to add the attached Authorization form to the BOCC Agenda and have the Boar approve the authorization and complete the disposal process. The estimate for the clean up is around 3,000.00. an invoice will be submitted once the product is disposed at a proper disposal site. What options exist for the Board? (include consequences, impacts, costs, etc. of options): Approve the authorization form to be added to the BOCC agenda and sign the form. The undersigned " Weld County " hereby authorizes CUSTOM ENVIRONMENTAL SERVICES, INC. to immediately proceed to render the following services; Emergency respond to Production mud spill at the locations of CR 49 & CR18 and Hwy 34 & CR 49. Complete steps to mitigate and clean affected areas and surfaces. Profile and dispose of waste to an approved disposal facility. 2.
