HomeMy WebLinkAbout20194243.tiff HEARING CERTIFICATION DOCKET NO. 2019-117 RE: A CHANGE OF ZONE, COZ19-0003, FROM THE A (AGRICULTURAL) ZONE DISTRICT TO THE 1-3 (INDUSTRIAL) ZONE DISTRICT- CHESTER THOMPSON A public hearing was conducted on October 2, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman Public Works Department representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: cm I hereby certify that pursuant to a notice dated August 16, 2019, and duly published August 21, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Chester Thompson, for a Change of Zone, COZ19-0003, from the A (Agricultural) Zone District to the 1-3 (Industrial) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. la Chris Gathman, Department of Planning Services, presented a brief summary of the proposal, and mentioned the parcel has existing USR11-0009 and 1MUSR16-11-0009 on it. He described the nearest residences, clarified boundaries of the site at Chair Kirkmeyer's request, and described the surrounding uses. He stated no correspondence had been received, entered the favorable recommendation of the Planning Commission into the record as written, and indicated ten (10) referrals were sent out and seven (7) agencies responded. There was discussion of the future plans for the site and potential uses, and in response to Chair Kirkmeyer, Mr. Gathman confirmed the lot is seven (7) acres. He displayed images of the site and surrounding views and in response to Commissioner Conway, Mr. Gathman confirmed the mobile home in the pictures is currently being stored on-site and will be converted into an office. El Hayley Balzano, Department of Public Works (PW), provided a brief overview of the transportation plans and requirements, stated the existing access is on County Road ,(CR) 30, mentioned a potential future access on CR 47, and provided the daily roundtrips and average speeds. She mentioned there is a water quality feature on the southeast corner of the parcel, indicated aerial photography shows material being stored, and stated, prior to the Change of Zone plat, all stored material shall be removed. In response to Chair Kirkmeyer, Ms. Balzano confirmed if the scope of the Use changes, PW will need to evaluate the access on CR 30. c.C : PLCCGITP),Pw(HB).�t-t(LL) t O I Q(19 2019-4243 PL2138 HEARING CERTIFICATION - CHESTER THOMPSON (COZ19-0003) PAGE 2 • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, stated a commercial well provides water and there is a septic system permitted for 15 people. • Kris Pickett, JKP Consulting, LLC, represented the applicant and stated the property owner has had interest from oil and gas support companies wanting to locate on the site, therefore, he desires to scale back his current operation, limit it to the northern portion of the parcel and leave the southern portion open for potential future development. He expressed concern about the requirement of a Site Plan Review, which led to discussion between Mr. Pickett, Chair Kirkmeyer, and staff about the specifics of the requirement. • No public testimony was offered concerning this matter. In response to Chair Kirkmeyer, Mr. Pickett confirmed he was aware the access will be reevaluated with the Site Plan Review, and Ms. Balzano confirmed that would be the same time the need for a Road Maintenance Agreement would be evaluated. In response to Commissioner Conway, Mr. Gathman described what the Site Plan Review entailed, including the application cost and timeframe. Mr. Gathman suggested adding new Conditions of Approval (COA) #1.C.1 (Site Plan Review application for the existing Oil and Gas Support facility on the property) and #1.C.2 (evidence that the Oil and Gas Support facility has been removed from the property), and the Board agreed. • In response to Chair Kirkmeyer, Mr. Pickett indicated he had reviewed, and agreed to abide by, the Conditions of Approval, as amended. �--- No public testimony was offered with regard to the changes made to the Conditions of Approval. Chair Kirkmeyer suggested adding the definition for the intent of the I (Industrial) Zone District to the Findings under#2.B.1. • Commissioner Moreno moved to approve the request of Chester Thompson for a Change of Zone, COZ19-0003, from the A (Agricultural) Zone District to the 1-3 (Industrial) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval, as amended, and included the language added to the Findings by the Board. The motion was seconded by Commissioner Conway, and it carried unanimously.
