WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a proposed sale of a tract
of land more particularly described as follows, to-wit :
A tract of land situate in the SE4, Section 28,
Township 1 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado which considering the East
line of said SE4 as bearing South and with all
other bearings contained herein relative thereto
is contained within the boundary lines which begin
at the SE Corner of said Section 28 and run thence
along the South line of the said SEo; N89 °34 'W 261. 50 ' ;
thence N361.50'; thence S89°34 ' E 361.50 ' to the East line
of the said SE4; thence along said East line, South
361. 50 ' to Point of Beginning containing 3. 000 Acres more
or less and being subject to a road R.O.W. over the
Easterly 30. 0 ' thereof for County Road #19 and being
further subject to a road R.O.W. over the Southerly
30 .0 ' thereof for County Road #4 and being further
subject to all R.O.W. ' s and easements that are now in
place or are now of record.
to Continental Pipe Line Company, Rocky Mountain District,
for the purpose of constructing a Crude Oil Pump Station for storing
crude oil, gathered from surrounding leases, temporarily, to be pumped
to the mainline station at Fort Lupton, Colorado, does not come within
the purview or the definition of the terms "Subdivision" and "subdivided
land" as set forth im CRS 106-2-33, (3) (a) and (b) 1963, as amended,
and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of landupon the
recommendation of the Weld County Planning Director for the reasons as
stated and pursuant to its authority under CRS 106-2-33 (d) , 1963, as
amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove described
tract of land be used soley for the purpose of constructing and
maintaining thereon a Crude Oil Pump Station for storing crude oil,
gathered from surrounding leases, temporarily, to be pumped to the
mainline station at Fort Lupton, Colorado, be exempted from the definition
of the terms "Subdivision" and "subdivided land" as provided for in the
new Weld County Subdivision Regulations at Section 2-1, A. , (3) , adopted
August 30, 1972 .
The above and foregoing resolution was , on motion duly made
and seconded, adopted by the following vote on the 8th day of May,
1974.

Dear Ms Lee:
In reference to your December 6, 1973 telephone conversation with
Jack Oldrin, this letter will serve as our request for exemption from -
Colorado's State Senate Bill 35.
The legal description of the three (3) acre tract of.land in question,
as well as a plot map, is enclosed. As pointed out in our option, this -
land will revert back to the surface owner after Continental Pipe. Line
has abandoned it.
We will locate on this tract of land a crude oil pump station. Crude
oil will be gathered from surrounding leases, stored temporarily at
this station, and pumped to our mainline station at Ft. Lupton.
If we can supply you with any additional information, please don' t
hesitate to call. •
