BF. IT RESOLVED, by the Board of County Commissioners
of Weld County, Colorado, that they hereby approve the dedication
of the perpetual right- of-way over the public roads , streets ,
highways , and easements in behalf of the public in Lake Meadows
Subdivision, being a Subdivision located in the West i of the
Northwest a (A"zN1vj of Section 29 , Township 3 North, Range 68
West of the 6th P.M. , Weld County, Colorado, being more particularly
described as follows :
The South 918 . 5 feet of the Wz of the NW;, Section
29 , T3N, R68W of the 6th P.M. , in the County of Weld
State of Colorado , more particularly described as
follows :
Considering the West line of said Northwest Quarter of
Section 29 as bearing North with all bearings contained
herein relative thereto :
Beginning at the West Quarter Corner of said Section 29 ;
thence along the South line of said Northwest Quarter
of Section 29 N89°34 ' 24" E 1330 . 89 feet more of less to
the Southeast corner of said West half of the North-
west Quarter of Section 29 ; thence along the Fast line
of said West half NO°02 ' 49" E 918. 50 feet ; thence
parallel with said South line of the Northwest Quarter
of Section 29 S89°34 ' 24"W 1331 . 65 feet more or less to
said West line of the Northwest Quarter of Section 29 ;
thence along said West line South 918 . 50 feet more or
less to the place of beginning .
The above described tract contains 27 . 75 acres more or
less .
BE IT FURTHER RESOLVED, that the accompanying plat is
approved for filing, and the public roads , streets , highways and
easements thereon shown are approved, provided however , that the
County of Weld will not undertake maintenance of streets , roads ,
and right- of-way until they have been constructed by the subdivider
according to specifications and accepted by the County of Weld.

Gentlemen:
Please be advised that Longs Peak Water Association has
sold to Dr. Louis W. Belschner, Jr. , 3 memberships (taps)
for the purpose of furnishing water service to 3 lots as
platted in Lake Meadows Subdivision subject to and con-
ditioned upon the requirement that Dr. Belschner extend,
at his expence, the present 2" water line now located in
County Road 3 from the north line of Subdivision to the
south line of Subdivision.
Subject to the above stated condition, the obligation
o£ Longs Peak Water Association to service the 3 lots in
this Subdivision is firm.

I have attached a copy of a letter to Mr. Ken Goon, agent for Dr. Louis
Belschner, which verifies initiation of subdivision procedures prior to
March 19, 1973, the date the Weld County Zoning Resolution was revised
to increase the minimum lot size in the A-Agriculture zone from 40,000
square feet to 35 acres .

Dear Pair. Goon :
I have received the soil evaluation prepared by the Soil Con-
servation Service for the property located in the S2 W NW4
of Section 29 , T3N , R68W that you client is proposing to sub-
divide. The soil evaluation shows that the soils there have
"severe limitations " for septic tank filter fields . In such
cases , the burden of proof will rest upon the subdivider to
prove that the soils are suitable for the proposed septic
systems through on-site soil investigations certified by a
soils scientist. Also , the County Health Department will have
to approve any corrective measures proposed . (See Section 8-9 ,
Weld Count; Subdivision Regul.ations ) .
There is also an apparent problem of ground water at 5 -Feet .
Our regulations require a minimum depth of 8 feet from the
surface of the ground to the ground water surface (based on
the annual high water level ) for lots to be served by septic
systems . (Weld County Subdivision Regulations , Section 8-9 ,
A (3) ) .
I would suggest that these two problems be remedied before
you proceed with the platting of the property. In my opinion ,
the limitations created by the soils and high water table are •
severe , and the possibility of subdividing this property is
extremely . unlikely unless _these problems can be .remedied .

Covenants, restrictions and easements affecting property •
as hereinafter described, known as Lake Meadow Subdivision, Weld
:ou t; , Colorado.
h.ls declaration made this; 4th day of October, 1973, by LOUIS W.
i.LSC;HNER, JR. and ELIZABETH ANN BELSCHNER, hereinafter called the
declarants.
WITNESSETH:
WHEREAS, declarants are the owners of the real property
hereinafter described and are desirous of subjecting said property
to the restrictions, covenants and easements hereinafter set forth,
each and all of which is and are for the benefit of said property
and for each owner thereof, and shall inure to the benefit of and
pass with said property , and each and :every parcel thereof, and
which apply to and bind their successors in interest, and any
owner thereof; •
NOW THEREFORE,
LOUIS W. BELSCHNER and ELIZABETH ANN BELSCHNER hereby
declare that the real property hereinafter described is and shall
be, held, transferred, sold and conveyed subject to the restrictions ,
- covenants , and easements hereinafter set forth. The real property
hereinafter described is subjected to the covenants , restrictions
and easements hereby declared to insure the best use and the most
appropriate development and improvement of each building site
thereof, to protect the owners of building sites against such
inappropriate use of surrounding building sites as will depre-
ciate the value of the property; to preserve, so far as is prac-
ticable, the natural beauty of said property; to guard against
the erection of poorly designed structures, and structures built

of improper or unsuitable materials; to obtain, harmonious color
schemes ; to insure the highest and best development of said pro-
perty; to encourage and secure the erection of attractive buildings
and other permitted structures thereon, with appropriate locations
thereof on building sites; to prevent haphazard and inharmonious •
improvement of building sites ; to secure and maintain proper set-
backs from streets and adequate free spaces between structures and
in general to provide adequately for a high type and quality of
improvement on said property and thereby to enhance the value of
improvements on said property and thereby to enhance the value
of investments made by purchasers of building sites thereon.
PART B - AREA OF APPLICATION
B-1 FULLY PROTECTED AREA. The covenants herein con-
tained in their entirety shall apply to the following described
property, to-wit :
Lots 1 through 3 inclusive, in Lake Meadow Subdivision
Weld County, State of Colorado.
PART C - AREA COVENANTS
C-1 LAND USE, AND BUILDING TYPE. No building lot shall
be used, and no building; shall be erected, altered, placed or
permitted to remain on any lot other than buildings as are
permitted by the Weld County Zoning Codes .
C-2 DWELLING COST, QUALITY AND SIZE. No building shall
be permitted on any lot at a cost of less than *20,000 based upon
cost levels prevailing on the date these covenants are recorded,
it being the intention and purpose of this covenant to assure that
all buildings shall be of a quality of workmanship and materials
substantially the same or better than that which can be produced on
the date these covenants are recorded at the minimum cost stated
herein for the minimum permitted size. The ground floor area of any
building, exclusive of one-story open porches , garages , and basements,
shat: be not less than 1200-square feet. All foundations to be con-
structed must be designed and inspected by an engineer licensed in
the :Mate of Colorado , •

C-3 BUILDING LOCATION. No building shall be located
on any lot nearer than 350 feet to the front lot line. No
building shall be located nearer than 50 feet to an interior
side lot line for any residential use nor nearer than 25 feet
for any other permitted use , except as otherwise stated. No
building shall be located nearer than 50 feet to the rear lot
line, exclusive of garages and permitted accessory buildings .
A garage and permitted accessory building may be located in the
required side or rear yard for a principal building, provided
such garage and accessory buildings are located at least 15
feet from any principal building, garage or other accessory
buildings . For the purpose of this covenant eaves, cornices ,
canopies , walkways , ground level patios and similar architec-
tural features shall not be considered as part of a building,
provided however that this shall not be construed to permit
any portion of a building on a lot to encroach upon another lot.
C-4 EASEMENTS FOR UTILITIES. Easements for installation
and maintenance of utilities and drainage facilities are reserved
along certain side lot lines as indicated on the recorded plat.
Within these easements no structures , planting or other material
shall be placed or permitted to remain which may damage or inter-
fer with the installation and maintenance of utilities or which
may change the direction of flow of drainage channels in the
easements or which may obstruct or retard the flour of water
through drainage channels in the easements . The easement area
of each lot and all improvements in it shell be maintained con-
tinuously by the owner of the lot except for those improvements
for which a public authority or utility company is responsible .
C-5 EASEMENTS FOR GAS LINES. Easements for installation
and maintenance of gas facilities have been granted to ,bli c

utilities may cross said easements at approximately right angles,
but in no event shall any water meters, valves, street lights , power
poles, mail boxes, trees, shrubs or other structures be allowed in
said easements, except for concrete driveways and sidewalks which
may encroach onto said easements provided they cross at substantially
right angles and do not exceed a total width of 30 feet. The
easement area of each lot and all permitted improvements shall be
maintained continuously by the owner of the , lot, except for said
gas facilities for which said Public Service Company is responsible .
C-6 NUISANCES. No noxious or offensive activities shall
be carried on upon any lot , nor shall anything be done thereon which
may be or may become an annoyance or nuisance to the neighborhood. .
C-7 TEMPORARY STRUCTURES. No structures of a temporary
character, including but not limited to trailers , basements, tents,
shacks, garages, barns or other outbuildings shall be used on any
part of the above described property at any time as a residence,
either temporarily or permanently.
C-8 GARBAGE AND REFUSE DISPOSAL. No lot shall be used
or maintained as a dumping ground for rubbish. Trash, garbage or
other waste shall not be kept, except in sanitary containers . All
equipment for the storage or disposal of such material shall be
kept in a clean and sanitary condition.
C-y SEPTIC AND SEWER SYSTEMS. Any septic systems used
would be of the nature approved by Weld County and designed by an
engineer. The system presently approved for installation is called
the Nayadic Aerobic Waste Water Treatment Unit , said units instal-
lation is to be designed by an engineer licensed in and for the
State of Colorado.
C-10 MOVED-IN STRUCTURES, No structures shall be moved from
a point outside the real property hereinbefore described to within
the real property hereinbefore described without special written
permission from the Architectural Control Committee as hereinafter
provided.

C-11 INOPERABLE VEHICLES PROHIBITED. No inoperable, ,
unlicensed, or junked motor vehicles, trailers, boats or other
equipment shall be kept on any lot or about the premises in any manner
except that operable unlicensed farm equipment may be kept on the

premises .
C-12 WEED CONTROL. Each property owner shall be responsible
for control of weeds in order to prevent an unsightly appearance
in the neighborhood and no uncontrolled weed growth shall be per-
mitted.
PART D - ARCHITECTURAL CONTROL
D-1 ARCHITECTURAL CONTROL COMMITTEE. The Architectural
Control Committee is composed of the following persons : Louis W.
Belschner, Jr. , 800 Peoria Street, Aurora, Colorado, Elizabeth
Ann Belschner, 800 Peoria Strut, Aurora, Colorado and Michael
F. Scott, 12075 F. 45th Avenue, Denver, Colorado. A majority of
the committee may designate a representative to act for it. In the
event of death or resignation of any member of the committee the
remaining members shall have full authority to designate a successor.
At any time, the record owners of a majority of the lots shall have
the power, through an instrument duly recorded in the Weld County
Records to change membership of the committee or to withdraw from .
the committee or to restore to it any of its powers and duties.
C-2 PROCEDURE. No building shall be erected, placed- or
altered on any lot until the construction plans, specifications_ and
a plot plan showing the location of the structure on the lot has been
approved by. the Architectural Control Committee, or its designated
representative, as to quality of workmanship, quality and type of
materials, harmony of external design with existing structures, and
as to location of buildings with respect to topography and finished
grade elevation. The Committee 's approval or disapproval as required
in these covenants shall be in writing. In the event that the
Committee or its designated representative fails to approve or

disapprove said plans and specifications within thirty days after
the same have been submitted to it, or in any event , if no suit
to enjoin the construction has been commenced prior to completion
tnareof, approval will not be required and the covenants relating
to approval of said plans by the Committee shall be deemed to have •
been fully complied with.
PART L - GENERAL PROVISIONS
E-1 TERM. These covenants are to run with the land and
shall be binding on all parties and all persons claiming under them
for a period of thirty .years from the date these covenants are
recorded, after which time said covenants shall be automatically
extended for successive periods of ten years unless an instrument
signed by the record owners of two-thirds of the lots has been
recorded, agreeing to change said covenants in whole or in part .
E-2 ENFORCEMENT. Enforcement shall be by proceedings
at law or in equity , originated by any person or persons owning any
real property covered by these covenants against any person or per-
sons violating or attempting to violate any covenant to restrain
violation, compel compliance., or to recover damages, or any or all
of such remedies .
L-3 WLLD COUNTY STANDARDS. Notwithstanding any lesser
standards which might be inferred from these covenants, all con-
struction and usage of the real property shall also comply with
applicable Weld County building and zoning codes and other ordin-
ances.
E-4 SEVERABILITY. Invalidation of any one of these
covenants by waiver thereof, judgment or court order shall in no
way affect any of the other provisions which shall remain in full
force anti effect . 1
