Home My WebLink About740023.tiff FINDINGS AND RESOLUTION CONCERNING CHANGE OF ZONE PETITION OF GABRIEL MARTINEZ The Petition of Gabriel Martinez, Box 103, Frederick, Colorado, requesting a change of zone from "A" Agricultural District to "B" Business District of a parcel of land more particularly described as follows, to-wit: The West 44. 64 feet of Lot 17 and Lots 18, 19, 20 , 21 and 22, all in Evans Addition, in the unincorporated town of Evanston, Weld County, Colorado, came on for hearing on May 20, 1974, and the Board of County Com- missioners of the County of Weld, State of Colorado having heard the testimony and evidence adduced upon said hearing and having considered the testimony, evidence, remonstrances and recommendations of the Weld County Planning Commission filed with said Board, and having carefully weighed the same, now makes the following findings: 1. The evidence discloses that the applicant failed to sustain the burden of proof as to the need for a change of zone or that the present zone is erroneous or that circumstances warrant a change of zone at this time. 2. The evidence and investigation show that the inhabitants of the immediate vicinity of the area sought to be rezoned are predominately opposed to the change of zone. 3. The evidence discloses that the present zoning is complementary to the surrounding area, and that rezoning of subject land would not be compatible with the surrounding land use and not in conformity with the Weld County Comprehensive Plan, 4. Rezoning of subject land would constitute spot zoning and that as such it would not be consistent with the Weld County Development policy and its comprehensive plan, 5. The evidence and investigation show that there is a need for further study and development of the comprehensive plan for the greater tri-area of Dacono, Frederick and Firestone, and therefore, any re- zoning of subject property at this time would be premature and not in the interest of good planning, 6. That each of the preceding findings in and of themselves and independent of each other constitutes a separate and individual ground for denial of the change of zone, RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, has heard the application of Gabriel Martinez, Box 103, Frederick, Colorado, for change of zone from "A" Agricultural District to "B" Business District, of a parcel of land as hereinabove recited and made a part hereof by reference, and WHEREAS, said Board has made its findings on the evidence and testimony submitted to it, which findings precede this Resolution and by reference are incorporated herein and made a part hereof, and 740023 WHEREAS, the Board has carefully considered the Petition, the evidence, testimony and remonstrances and the recommendations of the Weld County Planning Commission and have given the same such weight as in its discretion deems proper, and is now fully advised in the premises. NOW, THEREFORE, BE IT RESOLVED, that the petition of Gabriel Martinez, Box 103, Frederick, Colorado, requesting a change of zone from "A" Agricultural District to "B" Business District of a parcel of land in- dicated above be, and it hereby is denied on each of the grounds set forth in the Board's findings therein. The primary objections are : 1 . The residents of Evanston , a quiet community of homes located between the towns of Frederick and Firestone, wish to remain a quiet residential area and do not desire the intrusion of a business out— let in the community . 2 . There -presently are no businesses in Evanston , nor is there -any particular need for the type of busi- ness applicant intends to Locate on the above des- cribed property, i.e. , a service station, as the needs of the area are already adequately provided for by four existing service station operations in the Tri-Town area. 3 . A business of the type contemplated by applicant is by nature, noisy, dirty , polluting , and conducive to increased traffic , collection of junk cars , and oper— ation during the late evening hours , all of whicb. will infringe on the rights of Evanston residents to quiet enjoyment of their homes and protection of property values . 4. Business zoning of this small parcel of land totally within an area of strictly agricultural zoning and residential use is "spot zoning" and therefore wholly improper. ..')
