A public hearing was conducted on August 28, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair - EXCUSED Commissioner Mike Freeman, Pro -Tern Commissioner Sean P. Conway - EXCUSED Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Selena Baltierra Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman The following business was transacted: El I hereby certify that pursuant to a notice dated June 25, 2019, and duly published June 28, 2019, in the Greeley Tribune, a public hearing was conducted on July 31, 2019, to consider the request of Front Range Landfill, Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR19-0032, for any Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (office and maintenance building along with fuel storage and fuel station for company vehicles, truck parking and storage (including dumpster and roll -off container storage), a container shop and a truck wash) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. At said hearing the matter was continued to August 14, 2019, to allow adequate time for the attorney representing the surrounding property owners to be present, and then again to August 28, 2019, to allow for review by a full quorum of the Board. On August 28, 2019, Bob Choate, Assistant County Attorney, made this a matter of record. e Chris Gathman, Department of Planning Services, stated staff was requesting the case be continued to October 2, 2019, and explained all parties involved could attend the proposed date to allow for review of the matter by a full quorum. • No public testimony was offered concerning this matter. ca:PL(CC,(TP), PcoceP), E.HCBF) (O(09((9 2019-3798 PL0306 HEARING CERTIFICATION - FRONT RANGE LANDFILL, INC. (USR19-0032) PAGE 2 le Commissioner James moved to continue the request of Front Range Landfill, Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR19-0032, for any Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (office and maintenance building along with fuel storage and fuel station for company vehicles, truck parking and storage (including dumpster and roll -off container storage), a container shop and a truck wash) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, to October 2, 2019, to allow the matter to be reviewed by a full quorum of the Board. The motion was seconded by Commissioner Moreno, and it carried unanimously. There being no further discussion, the hearing was completed at 10:08 a.m. This Certification was approved on the 4th day of September, 2019.
