HomeMy WebLinkAbout20193240.tiffFINDINGS AND RESOLUTION RE: FINDINGS AND RESOLUTION CONCERNING APPLICATION OF IHRF, INC., FOR AN OPTIONAL PREMISES (COUNTY) LIQUOR LICENSE, AND AUTHORIZE CHAIR TO SIGN The application of IHRF, Inc., 6736 East 123rd Place, Brighton, Colorado 80602, for an Optional Premises (County) Liquor License, was presented in a public hearing on the 22nd day of July, 2019, at 9:00 a.m., and the Board of County Commissioners of Weld County, Colorado, having considered the testimony, evidence and remonstrances filed with said Board, and having carefully weighed the same, now makes the following findings: 1. The evidence discloses that the applicant has sustained the burden of proof as to the desires of the inhabitants. 2. The applicant is of good character and reputation. 3. The applicant has proven the reasonable requirements of the neighborhood. RESOLUTION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to C.R.S. §44-3-310, and Section 12-2-70 of the Weld County Code, the Board has the authority to issue an Optional Premises (County) Liquor License, and WHEREAS, the Board has considered the application of IHRF, Inc., 6736 East 123rd Place, Brighton, Colorado 80602, for an Optional Premises (County) Liquor License, to be issued at the address of 18233 County Road 96, Pierce, Colorado 80650, for the sale of malt, vinous, and spirituous liquors, for consumption by the drink on the premises only, in compliance with all applicable rules and regulations found in Article 3, Title 44, C.R.S., and WHEREAS, pursuant to Exhibit 5-H of the Weld County Code, said applicant has paid to the County of Weld the sum of $1,075.00 for the hearing fee, in addition to the other required fees, and WHEREAS, due to the Findings of the Board of County Commissioners in this matter as stated herein, the Board deems it advisable to approve said application for an Optional Premises (County) Liquor License for IHRF, Inc., and SOC RS1un/ctc3,c.PPL cacec) O8i(9/Iq 2019-3240 LC0057 APPLICATION FOR AN OPTIONAL PREMISES (COUNTY) LIQUOR LICENSE - IHRF, INC. PAGE 2 WHEREAS, the Licensee shall host "responsible vendor" training every six (6) months as agreeable to the Colorado Department of Revenue Liquor Enforcement Division, and this training shall be open to other area licensees. Each employee shall be "responsible vendor" trained, and the Licensee shall provide documentary evidence that each employee has been "responsible vendor" trained to the Weld County Sheriff's Office within thirty (30) days of the fist available "responsible vendor" class after hiring. Evidence of such shall be included in the referral report submitted by the Sheriff's Office at the time of annual renewal. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that having examined said application, the qualifications of the applicant, and the testimony of those present at the hearing, does hereby grant License Number 2019-17 to said applicant for an Optional Premises (County) Liquor License, for the sale of malt, vinous, and spirituous liquors, for consumption by the drink on the premises only, at retail at said location; and the Board does hereby authorize and direct the issuance of said license by the Chair of the Board of County Commissioners, attested to by the Clerk to the Board of Weld County, Colorado, which license shall be in effect until August 1, 2020, providing that said place where the licensee is authorized for the sale of malt, vinous, and spirituous liquors, for consumption by the drink on the premises only, shall be conducted in strict conformity to all of the laws of the State of Colorado and the rules and regulations relating thereto, per Article 3, Title 44, C.R.S., heretofore passed by the Board of County Commissioners of Weld County, Colorado, and any violations thereof shall be cause for revocation of the license. Dear Applicant: On Friday, July 19, 2019, I traveled to the proposed licensed premises known as IHRF, Inc., located at 18233 County Road 96, Pierce, Colorado 80650. While there, I made an on -site inspection regarding the Liquor License and Dance Hall License applications filed. The Liquor License application is for an Optional Premises (County) Liquor License. These items will be heard by the Board of County Commissioners as the Liquor Licensing and Dance Hall Licensing Authority for Weld County on Monday, July 22, 2019, at 9:00 a.m. My inspection revealed the following: 1. The proposed licensed premises is not directly connected to a different licensed premises, pursuant to C.R.S. §44-3-301(3)(a). 2. The diagram of the proposed licensed premises is correct. 3. There are no other license types located in the immediate area. 4. There are no public or parochial schools, or principal campus of any college, university, or seminary within 500 feet of the proposed licensed premises, pursuant to C.R.S. §44-3-313(1)(d)(l). 5. The premises is equipped with sufficient water, lighting, parking and restroom facilities to accommodate the number of persons expected to attend dances thereon. The premises is not in such a state of disrepair that it is more likely than not to be a safety hazard to persons expected to attend dances thereon. The premises do not consist of an enclosed structure; however alcohol will be served out of an enclosed structure. PAGE 2 safely accommodate the number of persons expected to attend dances therein, and all requirements of the applicable fire department, district or authority have been met. The sign noticing the place, date, and time of the hearing for the Liquor License application and Dance Hall License was posted by the applicant in such a manner that the notice was conspicuous and plainly visible to the public, when I was there at approximately 1:30 p.m. on July 19, 2019. In reference to gambling, the Colorado Attorney General has released the following (please also see the attached "Illegal Gambling Activities News Release"): Q: What is "social gambling"? A: State law allows "social gambling" among participants who have a "bona fide social relationship" and in which all moneys wagered goes out in prizes. A "bona fide social relationship" means that the parties must have an established social relationship based upon some other common interest other than the gambling activity. Further. participants cannot directly or indirectly participate in "professional gambling." which is defined as "aiding or inducing another to engage in gambling, with the intent to derive a profit therefrom." This generally means that no one other than the players can profit from the game or activity in any manner. The profit does not need to be direct profit. For example, if a liquor establishment or other commercial enterprise derives increased sales or revenues by attracting customers, even without charging a cover or other direct consideration, as the result of gambling taking place at that business, the business is considered to have profited from the activity and the activity would no longer fall under the social gambling exception. These two criteria —a bonafide social relationship and no profit motive must be present for a gambling activity to be considered legal "social gambling." According to Leichliter v. State Liquor Licensing Authority. Dept. of Revenue. 9 P.3d 1153, 1155 (2000), `'incidental to a bona fide social relationship,' refers to a game or wager which is made available to participants who have some legitimate common relationship to one another other than to engage in 1 gambling. For example, a typical office sports pool, although all participants usually are not friends, would likely fall into this category by virtue of the shared business purposes of the office employees. Hence, the critical inquiry is whether the participants here came together for any shared purpose other than gambling." (Citations omitted.)
