RESOLUTION
WHEREAS, a public hearing was held on August 9, 1971, in the
chambers of the Board of County Commissioners of Weld County, Colorado,
for the purpose of hearing a petition of Jonathon Wenzel, Route 1, Box
198, Brighton, Colorado, requesting a change of zone from "A-1" Agri-
cultural District to "C" Commercial District, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the change of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
•
WHEREAS, the Board of County Commissioners has studied the
request of the petitioner, and studied the recommendations of the Weld
County Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS, that the petition of Jonathon Wenzel, Route 1, Box 198,
Brighton, Colorado, for change of zone from "A-1" Agricultural District to
"C" Commercial District, said area being more particularly described as
follows:
A parcel of land in the NW+ of Section 19, Township 1 North,
Range 65 West of the 6th P. M. , Weld County, Colorado,
being more particularly described as follows: "1„

Beginning at the NW Corner of said Section 19; thence South
89° 58' 30" East, on an assumed bearing along the North
line of said Section 19 a distance of 320. 00 feet; thence,
South 00° 28' 30" West, a distance of 320. 00 feet, thence,
North 89° 58' 30" West, a distance of 320. 00 feet to a point
on the West line of said Section 19; thence, North 00° 28'
3,0" East along the West line of said Section 19, a distance
of 320. 00 feet to the point of beginning, except the North
30. 00 feet and West 30. 00 feet thereof for County roads,
containing 1. 931 acres, more or less,
is hereby granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. All applicable subdivision regulations and zoning regulations
shall be followed and complied with to the satisfaction of the Board of
County Commissioners, Weld County, Colorado.
3. That said change of zone herein granted from "A-l" Agricultural
District to "C" Commercial District is conditional and shall exist only so
long as subject property is used and occupied as a general repair and black-
smith shop and as storage for said farm equipment and/or machinery while
in the process of being repaired only. When said blacksmith and/or repair
shop, in the opinion of the Board of County Commissioners, ceases to be
used as such, then such area herein rezoned shall revert to "A-1"
Agricultural District as originally zoned, and any,'related enterprise or
business in connection therewith shall be removed from the premises forth-
with.

RESOLUTION
WHEREAS, a public hearing was held on September 13, 1971 in
the chambers of the Board of County Commissioners of Weld County,
Colorado, for the purpose of hearing the petition of Harold H. Pfeif,
Route 2, Box 176, Fort Collins, Colorado, requesting permission to
locate a cattle and sheep feeding operation on the following described
property, to-wit:
The East 400 feet of the South 1000 feet of the Southwest
Quarter (SW- ) of the Northeast Quarter (NE4) of Section
Five (5), Township Five (5) North, Range Sixty-four (64)
West of the 6th P. M. , Weld County, Colorado, and
WHEREAS, the petitioner was present, and

WHEREAS, there was no opposition to the request of petitioner
to locate a cattle and sheep feeding operation, and
WHEREAS, the said requested cattle and sheep feeding operation
is located in an agricultural zone as set forth by the Weld County Zoning ),°)
Resolution, and
WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution
of Weld County, said cattle and sheep feeding operation may be authorized
upon the approval of the Board of County Commissioners of Weld County,
and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the request of
the petitioner and studied the recommendations of the Weld County
Planning Commission, and having been fully informed;

under the conditions following:
1. Any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. That petitioner shall proceed with due diligence to effect
said cattle and sheep feeding operation and that he shall
have up to one year from date hereof to begin construction
of same.
3. That when said cattle and sheep feeding operation is
completed, same shall not contain more than 400 head
of cattle at any one time and not more than 3, 000 head
of sheep at any one time.
4. That the manure accumulating as a result of the cattle
and sheep operation conducted herein shall be removed
from the premises at least annually.
5. That all applicable subdivision regulations and zoning
regulations shall be followed and complied with in
accordance with the Zoning Resolutions of Weld County,
Colorado.

for a dog kennel operation on the following described property, to-wit:

25 dogs at any one time.
3. That petitioner shall proceed with due diligence to effect said
dog kennel operation and that he shall have until December 25 , 1971 to
complete the construction of any and all facilities therefore, otherwise,
the Board may, for good cause shown, on its own motion,. revoke the
permit herein granted.
4. That all applicable subdivision and zoning regulations shall
be followed and complied with in accordance with the Zoning Resolutions
of Weld County, Colorado.

RESOLUTION
RE: APPOINTMENT OF MEMBER FROM WELD COUNTY TO THE
ADVISORY BOARD OF LARIMER-WELD REGIONAL PLANNING
COMMISSION.
WHEREAS, pursuant to rules and regulations adopted by the
Larimer-Weld Regional Planning Commission, there has been created
an Advisory Board of said Regional Planning Commission, and
WHEREAS, in accordance with directive from the Regional
P'anning Commission and the Board being sufficiently advised
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Pio,/ Commissioners, Weld County, Colorado, that Wayne Miller, Windsor,
Colorado, be, and he hereby is appointed as the first appointee of Weld
County to serve on the Advisory Board of the Larimer-Weld Regional
Planning Commission. That the term of office of said appointee shall
be two years, and that such member may be reappointed.
The above and foregoing Resolution was, on motion duly made

RE: EXTENSION OF:
WINDSOR-SEVERANCE PEST CONTROL DISTRICT,
JOHNSTOWN PEST CONTROL DISTRICT,
ST. VRAIN PEST CONTROL DISTRICT,
MILLIKEN-LA SALLE-KERSEY PEST CONTROL DISTRICT,
ADDITION OF LEAFY SPURGE AS A NOXIOUS WEED FOR
EXTERMINATION.
WHEREAS, heretofore and in 1966 the above-entitled pest control
districts were either extended or organized, and
WHEREAS, it has now been recommended by the four advisory
committees of said above-entitled pest control districts to extend term-
ination dates of same to December 31, 1976, and to add leafy spurge as
a noxious weed for extermination, and
WHEREAS, the Board of County Commissioners, Weld County, )1
Colorado, believes it to be in the best interests of Weld County to extend / ,
said termination dates as requested and to add leafy spurge as a noxious Y
weed to be exterminated.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the following:

Milliken-LaSalle-Kersey Pest Control District
be, and the same are hereby granted leave to proceed pursuant to statute
providing for any extension or extensions thereof, and that leafy spurge

RESOLUTION
WHEREAS, a public hearing was held on September 22, 1971,
at 2:00 P. M. , in the chambers of the Board of County Commissioners
of Weld County, Colorado, for the purpose of hearing the petition of
Weld County Landfill, Inc. , Box 596, Evans, Colorado, requesting
approval of site for a sanitary landfill, also known as a solid and/or
liquid waste disposal business on the following described property, to
wit:
West Half of the Southwest Quarter (WZSWQ) and the
Southeast Quarter of the Southwest Quarter (SE.SW4)
of Section 32, Township 5 North, Range 66 West of
the 6th P. M. , Weld County, Colorado, and
WHEREAS, the petitioner was present and represented by
Earl Moffat, and
WHEREAS, there was some opposition to the request of petitioner
for the location of a sanitary landfill at said location, and AV
WHEREAS, the said requested sanitary landfill operation is
located in an agricultural zone as set forth in the Weld County Zoning V
- Resolution, and
WHEREAS, according to Section 3. 3(2) of the Zoning Resolution
of Weld County, said sanitary landfill operation may be authorized upon
the approval of the Board of County Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of
the petitioner; and studied the recommendations of the Weld County
Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the application of Weld
County Landfill, Inc. to locate a sanitary landfill on the premises indicated
above, be, and it hereby is granted under the conditions following:
1. That any sanitary landfill facility to be installed shall be
approved by the State Health Department.
2. That all applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the Zoning Resolutions
of Weld County, Colorado.

A regular meeting was held by the Board of County Commissioners of Weld
County, Colorado, at 10:00 o;clock A. M. , with the following present:
The minutes of the 6th instant were read, and there being no corrections
or objections thereto, same were approved.

RE: FUNCTIONS, DUTIES AND RESPONSIBILITIES OF THE WELD
COUNTY ACCOUNTING OFFICER.
WHEREAS, heretofore and on December 31, 1969 the Board of
County Commissioners, Weld County, Colorado, did pass a Resolution
outlining the functions, duties and responsibilities of the Weld County
Accounting Officer, and
WHEREAS, it is now desirous that such Resolution be amended
to reflect more accurately said functions, duties and responsibilities
of the Weld County Accounting Officer.
NOW, THEREFORE, BE IT RESOLVED that until further order
of the Board, the functions, duties and responsibilities of the Weld County
Chief Accounting Officers shall be as follows:
I
Accounting functions (all County funds)
•
A. General accounting:
1. Responsible for maintaining a general ledger on all
County funds.
2. Responsible for processing (receiving, verifying,
posting) of all purchase orders and vouchers.
3. Responsible for the posting of all warrants.
B. Payroll:
1. Responsible for maintaining personnel files,
individual payroll records and all required forms
for all County personnel (except hospital employees).
2. Responsible for approving all payroll vouchers and
preparing all warrants.
3. Responsible for the filing of all quarterly and annual
payroll reports, including W-2's.
II.
Accounting Reports
A. Responsible for preparing monthly financial statements to
Commissioners and departments.
B. Responsible for recording all monthly departmental "Fee
Fund" reports.
C. Responsible for the preparation of special costs studies
and reports.
III.
Budget Officer
A. Responsible for all matters relating to preparation, review
request, making recommendations and filing necessary
forms.

Central Purchasing
A. Responsible for control of all purchase of supplies,
equipment and maintenance agreements.
B. Responsible for specific control over mimeo and
communication departments.
V
Other duties
A. Responsible for implementation of all accounting systems
including all automated systems.
B. Responsible for adequate insurance and bond coverage on
County property and personnel.
C. Responsible for equipment accident reports and state
compensation accident reports.
D. Responsible for all financial surveys, road and bridge
reports, motor fuel reports, State Highway Department
reports and complete year-end financial statements on
all funds and departments.
E. Responsible for promoting accounting and statistical
systems which measure performance.
F. All other duties which may be assigned by the County
Commissioners.

RESOLUTION
WHEREAS, a public hearing was held on Wednesday, October 6,
1971 at 2:00 o'clock P. M. in the chambers of the Board of County
Commissioners of Weld County, Colorado, for the purpose of hearing
a petition of Cesare E. Morganti, Sr. , Route 2, Box 165A, Greeley,
Colorado, requesting a change of zone from "A" Agricultural District
to "B" Business District, and
t' y WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the change of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied
the request of the petitioner and studied the recommendations of the
Weld County Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County

3 . 3 Uses Permitted in the "A" Agricultural Zone District
1 . Purpose of Zone
The purpose of the Agricultural zone district is to
allow all agricultural and related uses . Residential
and urbanizing uses are excluded . The requirements
of many of the conditional uses are required to pro-
tect the rural environment and to prevent all types
12 of pollution . Any interpretation of this resolution
should consider foremost that all uses are intended
tl to be agriculturally oriented .
y/ 2 . Exclusions
A. No junk or waste shall be stored outdoors .
B . No junk material , wastes or trash shall be re-
moved from one parcel of property and disposed
of by depositing. upon another parcel of property
or in the streets or public rights-of-way except
by being delivered to an authorized dump site .
C . On corner lots , no planting of shrubs , trees or
flowers or the erection of any solid fence or
structure over 30 inches above level of roadway
or street which obstructs the view of traffic
shall be permitted within the triangle measured
from the point of intersection of the lot lines
abutting the streets a distance of 150 feet along
each such lot line .
D . It shall be unlawful to sell any products at re-
tail or wholesale from any temporary stand , temp-
orary structure , motor vehicle or trailer except
agricultural products grown on the premises upon
which the stand is located .
3 . Permitted Uses
A. Farm dwelling or building appurtenant to agri -
cultural use .
B . Crop production
C . Foster family care
D . Grazing
E . Greenhouse
F . Hydrocarbon storage - All condensation tanks ,
storage tanks used in , or are essential to ,
the production of oil , gas , or any hydrocarbon
element shall be located not less than 100 feet
from any established county right-of-way center
line or 100 feet from any section or township
line within the boundaries of Weld County. No
loading or unloading of hydrocarbons shall be
permitted within the County right-of-way.

I . Public Utility mains , lines and substations -
where no public office and no repair or storage
facilities are maintained , subject to the approv-
al of the Weld County Utility Coordinating Board .

4 . Permitted Accessory Uses - all listed permitted uses
and permitted accessory uses are representative and
are not all inclusive . Unlisted uses may be subject
to review by the Planning Commission and requirements

5 . Conditional Uses
A. The Planning Commission is authorized to recommend
to the Board of County Commissioners approval or
denial of the following uses and to set require-
ments for the operation of said uses . Any expan-
sion or enlargement of a permitted use shall be
treated as a new application under the provisions
hereof. The Planning Commission and the Board of
County Commissioners shall consider the following
in making their determination : compatibility with
the surrounding area , harmony with the character
of the neighborhood , need for the proposed use ,
its effect upon the immediate area , its effect on
future development of the area , and the health ,
safety and welfare of the inhabitants of the area
and the County
B . Application for conditional use shall be accomp-
anied by the following :
1 . Certified boundary survey of the property for
which application is made
2 . Plot plan showing location of all proposed
buildings , parking areas , ingress and egress ,
waste disposal areas , other constructional
features and landscaping
3 . Description of proposed operation in sufficient
detail to indicate effects of operation in
producing air and water pollution , odor , noise ,
glare , fire or other safety hazards , and traffic
congestion
4 . Plans for disposal of sewage or other wastes
5 . Plans for water supply
6 . Plan to show drainage and drainage facilities
7 . All plans or plot plans , as require, , ;,•u�

6 . Temporary Uses
• A. A temporary permit may be obtained from the Plan-
ning Department upon the filing of an application
requesting a temporary use and accompanied with a
$10 . 00 application fee . Temporary stands , struct-
ures , motor vehicles , and trailers shall be re-
moved on the date of termination of the permit un-
less a specific date is stated herein . Temporary
structures shall be shown to be so constructed as
to not constitute a fire hazard or hazard to the
health or safety of the public prior to issuance
of the permit . Materials which have substantially
deteriorated will not be permitted .
B . The following may be operated as uses by temporary
permit and need not be enclosed within a building .
1 . Temporary construction yard or building for
construction materials and equipment , mobile
home for office use , and concrete batch plants ,
incidental and necessary for construction in
Agricultural zone districts . Each permit shall
specify the location of the building , mobile
home office , yard or batch plant. No area
'more than two miles distant shall be served
by such temporary building , mobile home office
or yard . Each permit shall be valid for a per-
iod of not more than six calendar months and
may be renewed for. three successive six-month
periods at the same l ocat o,' .
2 . Temporary office incidental and necessary for
the sale of new construction by the permittee .
Each permit shall specify the location of the
office and the area within which such sales may
be made . No area more than two miles distant
from the office shall be served . Each permit
shall be valid for a period of not more than six
calendar months and may be renewed for three
successive six-month periods at the same location .
3 . Mobile homes may be used for temporary living
quarters incidental and necessary for the con-
struction of a residence on the property . A
temporary permit for the above said use shall
not be issued without approval in writing from
the Weld County Health Department . Before a
temporary permit to use a mobile home for living
quarters during the construction of a permanent
residence is issued , a building permit shall have
been obtained . The temporary permit shall be
valid for a period of not more than six calendar
months and may be renewed for an additional six
calendar months by application to the Planning
Department , provided that the exterior walls and
roof of the residence are completed . Under all
other circumstances , application for extension of
a temporary permit to use a mobile home for a
residence shall be made to the Board of Adjustment .
4 . The number of temporary mobile homes on a farm-
stead may be varied upon approval by the Board of
Adjustment based upon proof of need for the effect-
ive and economic operation of a farm unit . Said
variance must be shown to have a direct relation-
ship to the agricultural or animal production of
the farming unit . A temporary permit shall be re-
quired for each mobile home and shall be valid for
not more than one year and may be renewed by app-
lication to the Planning Department by showing
that the mobile home is still being used as initi -
ally being required .

5 . Temporary Assemblages
a . Intent .113 F
1 . It is the purpose of the Weld County Zoning
Resolution to regulate the assemblage of
large numbers of people , in excess of those
normally needing the health , sanitary , fire ,
police , transportation and utility services
regularly provided in this County , in order
that the health , safety and welfare of all
persons in the County , residents and visitors
alike , may be protected .
2 . It is the intent of this resolution that all
sections and provisions of this resolution
have an independent existence , and , should
any section or provision be declared invalid
or unconstitutional by a court of competent
jurisdiction , it is the intent of this Weld
County body that any section or provision so
declared shall be severable from and shall
not affect the validity of the remainder of
the resolution .
b . License required
1 . No person shall permit , maintain , promote ,
conduct , advertise , act as entrepreneur ,
undertake , organize , manage , or sell or give
tickets to an actual or reasonably anticipat-
ed assembly of 500 or more people which con-
tinues or can reasonably be expected to con-
tinue for 2 or more consecutive hours ,
whether on public or private property ,
unless a license to hold the assembly has
first been issued by the Weld County Plan-
ning Office , application for which must be
made at least 30 days in advance of the
assembly. A license to hold an assembly
issued to one person shall permit any person
to engage in any lawful activity in con-
nection with the holding of the licensed
assembly .
2 . As used in this Resolution :
a . Person means any individual natural
human being , partnership , corporation ,
firm , company , association , society or
group .
b . Assembly means a company of persons
gathered together at any location at
any single time for any purpose .
3 . A separate license shall be required for
each day and each location in which 500 or
more people assemble or can reasonably be
anticipated to assemble ; the fee for each
license shall be $100. 00 .
4 . A license shall permit the assembly of only
the maximum number of people stated in the
license . The licensee shall not sell tickets
to nor permit to assemble at the licensed
location more than the maximum permissible
number of people .
5 . The license shall not permit the sound of
the assembly to carry unreasonably beyond
the enclosed boundaries of the location of
the assembly .
6 . This legislation shall not apply to any
regularly established , permanent place of
worship , stadium , athletic field , arena ,
auditorium , coliseum , or other similar
permanently established place of assembly
for assemblies , provided said places are
being used for the established and normal
use , which do not exceed by more than 250
people the maximum seating capacity of the
structure where the assembly is held .
}1 .
7 . This legislation shall not apply to govern-
ment sponsored affairs held on regularly
established fairgrounds nor to assemblies
required to be licensed by other laws and
regulations of Weld County.
C . Conditions for issuing license - before he may
be issued a license the applicant shall first:
1 . Determine the maximum number of people which
will be assembled or admitted to the location
of the assembly , provided that the maximum
number shall not exceed the maximum number
which can reasonably assemble at the location
of the assembly in consideration of the nat-
ure of the assembly and provided that , where
the assembly is to continue overnight , the
maximum number shall not be more than is
allowed to sleep within the boundaries of
the location of the assembly by the zoning
or health ordinances of the County.
2 . Provide proof that he will furnish at his
own expense before the assembly commences :
( a ) A fence completely enclosing the pro-
posed location , of sufficient height
and strength to prevent people in excess
of the maximum permissible number from
gaining access to the assembly grounds ,
which shall have at least four gates , at
least one at or near four opposite
points of the compass .
(b) One Dint of potable water per person ,
per hour , at the maximum estimated hour-
ly attendance , potable water , meeting
all federal and state requirements for
purity , sufficient to provide drinking
water for the maximum number of people
to be assembled at the rate of least
one gallon per person per day and water
for bathing at the rate of at least 10
gallons per person per day .
(c) Separate enclosed toilets for males and
' females , meeting all state and local
specificiations , conveniently located
throughout the grounds , sufficient to
provide facilities for a maximum number
of people to be assembled at the rate
of at least one toilet for every 100
females and at least one toilet for
every 100 males together with an effi -
cient , sanitary means of disposing of
waste matter deposited , which is in com-
pliance with all state and local laws
and regulations ; a lavatory with run-
ning water under pressure and a contin-
uous supply of soap and paper towels
shall be provided with each toilet .
(d) A sanitary method of disposing of solid
waste , in compliance with state and local
laws and regulations , sufficient to
cispose of the solid waste production
of the maximum number of people to be
assembled at the rate of at least 2 . 5
lbs . of solid waste per person per day ,
together with a plan for holding and a
plan for collecting all such waste at
least once each day of the assembly and
sufficient trash cans with tight fitting
lids and personnel to perform the task
and for cleaning the premises and im-
mediate surrounding properties within
48 hours after an event .
(e) Physicians and nurses licensed to pract-
ice in Colorado sufficient to provide
the average medical care enjoyed by res-
idents of Colorado for the maximum num-
ber of people to be assembled at the
rate of at least one physician for every
1 ,000 people and at least one nurse for
every 1 , 500 people , together with an en-
closed covered structure where treat-
ment may be rendered . containing sPn-

arately enclosed treatment rooms for
each physician , and at least one emer-
gency ambulance available for use at all
times . Food service facilities , in-
cluding 'mandatory dispensing of liquids
in single service cups , shall be pro-
vided to serve reasonably anticipated
requirements and shall meet applicable
state and local physical and operation-
( f) If the assembly is to continue during hours
of darkness , illumination sufficient to light
the entire area of the assembly at the rate
of at least five foot candles , but not to
shine or reflect unreasonably beyond the
boundaries of the enclosed location of the
assembly.
(g ) A free parking area inside of the assembly
grounds sufficient to provide parking space
for the maximum number of people to be assem-
bled at the rate of at least one parking
space for every four persons ;with parking
area provided at a rate of no more than 100
passenger cars or 80 busses per usable acre .
( h ) Telephones connected to outside lines suffi -
cient to provide service for the maximum
number of people to be assembled at the rate
of at least one separate line and receiver
for each 1 ,000 persons .
(i ) If the assembly is to continue overnight ,
camping facilities in compliance with all
state and local requirements as set forth in
the ordinances of this County , sufficient to
provide camping accomodations for the maximum
number of people to be assembled .
(j ) Security guards , either regularly employed ,
duly sworn , off duty peace officers or
private guards , licensed in Colorado suffic-
ient to provide adequate security for the maxi -
mum number of people to be assembled at the
rate of at least one security guard for every
750 people , permitted for internal security
only .
( k ) Fire protection , including alarms extinguish-
ing devices and fire lanes and ecapes , suf-
ficient to meet all state and local standards
for the location of the assembly as set forth
in the laws of the State of Colorado and re-
solutions of Weld County and sufficient emer-
gency personnel to efficiently operate the re-
quired equipment.
( 1 ) All reasonably necessary precautions to in-
sure that the sound of the assembly will not
carry unreasonably beyond the enclosed bound-
aries of the location of the assembly . Amp-
lifying equipment shall control the noise
level at the perimeter of the site to no more
.than to decibels on the A scale of a sound
level meter which meets the specifications of
the American National Standards Institute .
(m) A bond , filed with the clerk of this County ,
either in cash or underwritten by a surity
company licensed to do business in Colorado
at the rate of $1 . 00 per person for the maxi -
mum number of people permitted to assemble ,
which shall indemnify and hold harmless this
county or any of its agents , officers , servants
and employees from any liability or causes of
action which might arise by reason of granting
this license , and from any cost incurred in
cleaning up any waste material produced or
left by the assembly or any public liability
and property damage insurance in such form
and amount as shall be determined by the Plan-
ning Office to be reasonable in relation to
the risks and hazards relating to the event.

D . Application
1 . Application for a license to hold an actual or anti -
cipated assembly of 500 or more persons shall be made
in writing to the Planning Office of this county at
least 30 days in advance of such assembly .
2 . The application shall contain a statement made upon
oath or affirmation that the statements contained
therein are true and correct to the best knowledge
of the applicant and shall be signed and sworn to or
affirmed by the individual making application in the
case of an individual , natural , human being , by all
officers in the case of a corporation , by all partners
in the case of a partnership or by all officers of an
unincorporated association , society or group or , if
there be no officers , by all members of such associ -
ation , society or group .
3 . The application shall contain and disclose :
(a ) The name , age , residence and mailing address of
all persons required to sign the application by
4 . b and , in the case of a corporation , a certi -
fied copy of the articles of incorporation togeth-
er with the name , age , residence and mailing add-
ress of each person holding 10% or more of the
stock of said corporation ; together with proof of
financial resources sufficient to execute plans ,
as submitted , and provide such further assurances
as may be required .
(b ) The address and legal description of all property
upon which the assembly is to be held together
with the name , residence and mailing address of
the record owner ( s ) of all such property .
(c ) Proof of ownership of all property upon which the
assembly is to be held or a statement made upon
oath or affirmation by the record owner ( s ) of
all such property that the applicant has permission
to use such property for an assembly of 500 or
more persons .
( d) The nature . or purpose of the assembly .
(e) The total number of days and/or hours during
which the assembly is to last .
( f) The maximum number of Persons which the applicant
,shall permit to assemble at any time , not to ex-
ceed the maximum number which can reasonably
assemble at the location of the assembly , in con-
sideration of the nature of the assembly , or the
maximum number of persons allowed to sleep within
the boundaries of the location of the assembly by
the zoning ordinances of the County if the assem-
bly is to continue overnight .
( g ) The maximum number of tickets to be sold , if any .
( h ) The plans of the applicant to limit the maximum
number of people permitted to assemble .
( i ) The plans for fencing the location of the assem-
bly and the gates contained in such fence .
( j ) The plans for supplying potable water including
the source , amount available and location of
outlets .
( k ) The plans for providing toilet and lavatory fac-
ilities' including the source , number and location ,
type , and the means of disposing of waste deposit-
ed .
( 1 ) The plans for holding , collection , and disposing
of solid waste material . •
(m) The plans to provide for medical facilities in-
cluding the location and construction of a struct-
ure , the names and addresses and hours of avail -
ability of physicians and nurses , and provisions
for emergency ambulance service .
( n) The plans , if any , to illuminate the location of
the assembly including the source and amount of
power and the location of lamps .

(o ) The plans for parking vehicles including size
and location of lots , points of highway access
and interior roads including routes between high-
way access and parking lots .
( p) The plans for telephone service including the
source , number and location of telephones .
(q ) The plans for camping facilities , if any , includ-
ing facilities available and their location .
( r) The plans for fire protection including the num-
ber , type and location of all protective devices
including alarms and extinguishers , and the num-
ber of emergency fire personnel available to
operate the equipment .
( s ) The plans for security including the number of
guards , their deployment , and their names , add-
resses , credentials and hours of availability.
(t ) The plans for sound control and sound amplifi -
cation , if any , including number , location and
power of amplifiers and speakers .
( u ) The plans for food concessions and concessioners
who will be allowed to operate on the grounds in-
cluding the names and addresses of all concess-
ioners and their license or permit numbers .
4 . The application shall include the bond required in
3 . b . 13 , and the license fee .
E . Issuance
The application for a license shall be processed within
20 days of receipt and shall be issued if all conditions
are complied with .
F . Revocation
The license may be revoked by the governing body of this
county at any time if any of the conditions necessary for
the issuing of or contained in the license are not com-
plied with , or if any condition previously met ceases to
be complied with .
G . Enforcement
1 . The provisions of this legislation may be enforced
by injunction in any court of competent jurisdiction .
2 . The holding of an assembly in violation of any pro-
vision or condition contained in this legislation
shall be deemed a public nuisance and may be abated
as such .
3 . Any person who violates II-a or who violates any con-
dition upon which he is granted a license may be
fined not less than $100 . 00 nor more than $1 ,000 . 00 .
Each day of violation shall be considered a separate
offense .
7 . Special Uses
A. The Planning Commission is authorized to recommend to
the Board of County Commissioners approval or denial of
the following uses and to set conditions and requirements
for the operation of said uses . Any expansion or enlarge-
ment of a Special Use shall be treated as a new applica-
tion under the provisions hereof. The Planning Commiss-
ion and the County Commissioners shall consider the fol -
lowing in making their determination : compatibility with
the surrounding area , harmony with the character of the
neighborhood , need for the proposed use , its effect upon
the immediate area , its effect on future development of
the area , and the health , safety and welfare of the in-
habitants of the area and the County.
B . Application for Special Use Permit shall be accompanied
by the following :
1 . Certified boundary survey of property for which
application is made .
2 . Plot plan showing location of all proposed buildings
parking area , ingress and egress , waste disposal
areas , other constructional features , and iandscapir,
3 . Description of proposed operation in sufficient de-
tail to indicate effects of operation in producing
air and water pollution , odor , noise , glare , fire
or other safety hazards , and traffic congestion .
4 . Plans for disposal of sewage or other wastes .
5 . Plans for water supply.
6 . Plan to show drainage and drainage facilities .
7 . Proposed number of shifts to be worked and maximum
number of employees .
8 . All plans or plot plans , as required , must be sub-
mitted to the Weld County Planning Department for
approval at least 20 days prior to the Planning Com-
mission hearing date .
9 . Soil study of site .
10. Application fee of $25 . 00 except where indicated
otherwise .
11 . A public hearing is required .
C . Sand and gravel pits , etc . . . .
Before the County Planning Commission shall approve or
disapprove a special request for the location of a sand
or gravel pit , rock crusher , quarry or open mining oper-
ation , concrete and asphalt plants in any "A" or "A-1 "
Agricultural District or in any " I " Industrial District ,
the applicant shall supply the required information and
shall be subject to the following conditions :
1 . Application
a . Plan . When the application is filed , the app-
licant shall provide a plan showing the land
from which the sand and gravel will be excavated
and a plan providing for rehabilitation of the
excavated area . These plans prepared by a reg-
istered engineer shall show the contour intervals
and any improvements thereon and a distance of
300 feet irr all directions from the subject prop-
erty . The plans shall be placed on a 24" x 36"
sheet and shall contain the legal description ,
acreage , scale of the drawing , vicinity sketch
and the written and graphic details of the
rehabilitation .
D . Rock crushers and concrete and asphalt mixing
plants may be allowed . However , the Planning
Commission may set out additional conditions
under which these operations may be permitted ;
and said conditions may vary by location due
to abutting land uses .
2 . Operation Standards
a . No excavation or processing of sand and gravel
shall be permitted nearer than 10 feet to the
boundary of adjacent property , easement , or
irrigation ditch or right-of-way , nor nearer
than 125 feet to any existing residence , unless
by written agreement the owner or owners of such
adjacent property consent to a lesser distance
and the Planning Commission approves such lesser
distance . The Planning Commission may set a
greater distance than mentioned above when , in
their opinion it is justified .
b . The operation shall maintain haulage roads in
a reasonable dust-free condition if within
one-fourth mile of a residential subdivision .
c . The hours of operation shall be unlimited unless
the operation is located within one-fourth mile
of a residence in which case they shall be from
6 : 00 A . M . to 10 : 00 P . M. or longer as the Plan-
ning Commission may specify .
d . All wet pits (definition : any pit excavated be-
low existing water table or subject to underground
seepage where water would accumulate and pond ) be
excavated in such a manner as to leave an average
of not less than eight inches of undisturbed sand

or gravel , as evenly as possible , over the entire
excavation tract to provide a water bearing strata
for any existing ground water , unless rehabilita-
tion plans provide for a permanent lake .
e . In no event shall a slope of less than 2 : 1 be left
when operations are complete .
f . In all pits , whether known as dry pits or wet pits s ,
the floor of the pit shall be graded in a reason-
ably smooth condition so that excavated areas will
not collect or permit stagnant water to remain
therein ; however , where the rehabilitation plan
for the subject property , as approved by the Plan- ,
ning Commission , provides for a permanent lake .
g . Prior to starting excavation in certain specific
instances as first determined by individual in-
vestigation by the Board of County Commissions or
their duly authorized representatives , where excav-
ations within one-fourth mile of a residential sub-
division are considered hazardous , the Board of
County Commissioners may require the excavations to
be fenced by standard field fence C F & I Special
fence #1047-12-i22 with openings of 3" at the bot-
tom , graduated to 8" openings at the top or equal ,
with 3 strands or barbed wire spaced 8" apart give-
ing the fence a total height of 6 ' . Steel posts
not more than ten feet apart shall be used to sup-
port the fence . The excavated area shall remain
fenced unless removal of all or any part thereof
is authorized by the Planning Commission .
3 . Permit requirement
a . Permit fee . An annual permit fee shall be paid .
The fee shall be paid annually upon the anniver-
sary date of the permit .
b . Insurance . The operator shall furnish evidence
he is insured to the extent of not less than
$100 ,000 . 00 against liability for any negligent
act or omission by the operator from the operation
or maintenance of the sand and gravel and all acti -
vities connected with or incidental thereto .
c . Bond . The operator shall post a bond in the form
prescribed by the Board of County Commissioners
in a sum equal to the number of acres covered by
the permit muliplied by $500. 00 to insure full
compliance with all of the terms and conditions
of the permit and the rules and regulations of the
Board of County Commissioners pertaining to ex-
traction and processing of sand and gravel . The
minimum amount of such bond shall be $2 ,500 . 00 ;
the maximum amount , $15 ,000 . 00
d . Time of permit . All permits shall be in force
until the operation is completed unless the annual
permit is not renewed by the operator .
e . Cancellation of permit . The Board of County Com-
missioners shall have the power to cancel permits
for violation of any of these regulations or con-
ditions imposed by said Board . The Board of County
Commissioners shall cause to be served written
notice upon the permittee at the address contained
in the permit , setting out a clear and concise
statement of the violations , and directing the
permittee to correct such violation within thirty
days . If the violations have not been corrected ,
then the Board of County Commissioners shall dir-
ect the permittee to appear at a time certain be-
fore the Board of County Commissioners , not less
than ten days nor more than thirty days after the
date of service of notice . The Board of County
Commissioners shall have the power , upon good
cause being shown , to cancel or revoke the permit
heretofore issued to the, permittee , to require
certain corrective measures to be taken or to dir-
ect the County or it ' s agents to enter upon the
premises and to take the corrective measures re-
quired by the Board of County Commissioners , the
cost to be assessed against the permittee and his
surities .
D . Sanitary land fill - applicants for certificates of
Designation for Solid Waste Disposal Sites shall make
such application or a prescribed form , supplying the
additional information :

1 . Copies of the information supplied to the State Health
Department as required by "Solid Waste disposal sites
and facilities " Chapter 35 , Article 23 - C . R. S . 1963
( Volume II ) amended 1971 by Senate Bill 132 , effective
date July 1 , 1971 .
E . Outdoor shooting ranges , subject to conditions set forth
below :
1 . Special permit to operate an outdoor shooting range
may be issued for a period up to five years .
2 . Application for a permit to operate an outdoor shoot-
ing range shall be accompanied by the following in-
formation :
a . Topography at two-foot intervals .
b . Plan of range with supporting data on safety
factors .
; . The following minimum standards shall apply to all
outdoor shooting ranges :
a . Minimum land requirements shall be set by the
Planning Commission for each application .
b . Shooting ranges shall be located to take advantage
of natural terrain barriers . The entire range
( including danger area .if range is not of the
"Safety Range" type) shall be fenced and warning
signs posted every 200 ' .
c . Line of fire shall be as nearly horizontal as is
practicable and never below horizontal . Ranges
may be constructed so that the firing point is
below the target , provided the gradient between
the firing point and target does not exceed 2%.
d . Perimeter of range shall be landscaped to provide
natural noise barriers . The remainder of the range
shall be planted and maintained with grass or other
suitable ground-cover .
e . Shooting shall be conducted by a range office or
instructor qualified by National Rifle Associa-
tion or military service .
f . In addition to firing lines or fields , adequate
space for danger areas , parking , equipment stor-
age building , clubhouse and/or latrines shall be
provided .
4 . Provisions for pistol , small -bore and high-caliber
rifle ranges .
a . "Safety Range" requirement. If range is construct-
ed in a built-up area , or when area is developed ,
or when natural terrain does not offer adequate
protection , overhead safety baffles may be required .
b . No fewer than 16 firing points shall be available
on rifle or pistol ranges . Firing points shall be
four to five feet apart for shooting distances up
to 200 yards .
c . Rifle or pistol ranges shall not be permitted witr
out bullet stops . Natural or artificial bullet
stops shall be provided .
1 . Natural bullet stops . Only slopes of hills
shall be used for natural bullet stops . The
crest of the hill used for a bullet stop shall
be at least 30 feet above the level of the
firing point for a 100-yard range . An addi -
tional ten feet of hill shall be provided for
each additional 100 yards of range . The slope
of the hill shall not be less than two to one .
A vertical cut shall be taken out of the face
of the hill -side used for a backstop to pro-
vide a nearly perpendicular face to catch
bullets and prevent richochets .

2 . Artificial bullet stops . For up to a 300-yard
range , an earth embankment at least 25 feet in
height , well sodded to retain slope of 35°
from perpendicular and topped by an earth-filled
timber barricade at least 15 feet high , shall
be provided . Stones shall be removed from the
face of the embankment to a depth of 18 inches .
For each additional 100 yards of range , ten
feet in over-all height of the bullet stop
shall be added . Bullet stop shall extend
approximately 160 feet beyond the ends of the
target line for high-caliber ranges ; 25 feet
for small -bore rifle and pistol ranges .
5 . (Jrovisions for trap and skeet fields .
a . A 100 by 300-yard danger zone shall be provided
for trap fields .
b . A 300 by 600-yard danger zone shall be provided
for skeet fields .
c . Trap and skeet fields may be combined ( traps lay-
out super-imposed on skeet field ) where 300 by
600-yard zone shall be required .
d . The trap field layout shall meet the requirements
of the American Trap Association .
e . The skeet field layout shall meet the requirements
of the National Skeet Shooting Association .
F . Feed lots : cattle , sheep and swine
1 . Shall not be located closer than 2 , 640 feet to any resi -
dential zone district or subdivision , nor nearer than 660
feet ( 1 /8 mile ) to any existing residence not located on
the site , without the written approval of the fee owner of
the structure .
2 . Manures shall be handled and disposed of in a sanitary
manner , approved by the Weld County Health Department.
3 . Suitable chemical and scientific controls are provided
for rodent and insect control .
4 . Concrete or other suitable aprons adjacent to the perm-
anently affixed feed bunks , water tanks , and feeding de-
vices are provided .
5 . Adequate mechanical means for scraping , grading and
cleaning of area is provided at all times ; and that
scraping , grading , and cleaning of the area be accomplished
as approved by the Weld County Health Department.
6 . Drainage facilities or improvements shall be constructed
to protect any adjacent rivers , streams or other bodies
of water from pollution .
G . Poultry Production : chickens , ducks , geese , turkeys
1 . Shall not be located closer than 2 ,640 feet to any resi -
dential zone district or subdivision nor nearer than 660
feet (1 /8 mile ) to any existing residence not located on
the site without the written approval of the fee owner
of the structure .
2 . Manures shall be handled and disposed of in a sanitary
manner approved by the Weld County Health Department ,
without creating public health hazard or nuisance .
3 . Chemical and scientific controls shall be provided for
rodent and insect control .
H . Sewage System : pumping station , sludge drying bed , treat-
ment plant , lagoon - applicants for site approval shall also
submit copies of the information supplied to the State Health
Department.

I . Fertilizer (organic ) storage and sale , where the fertilizer
is stored for longer than one year , provided the following
conditions are met :
1 . Shall not be located closer than 2 ,640 feet to any
residential zone district or subdivision , nor nearer
than 660 feet ( 1 /8 mile ) to any existing residence
not located on the site without the written approval
of the fee owner of the structure .
2 . Storage of fertilizer shall not be permitted closer
than 300 feet to any public right-of-way or lot line .
3 . Rodents and insects shall be controlled in accordance
with standards set by the Weld County Health Depart-
ment.
4 . Upon termination of permit , all fertilizer shall be
removed .
J . Dog kennels
1 . ;,hall not be located nearer than 2 ,640 feet to any resi -
dential zone district or subdivision nor nearer than 660
feet ( 1 /8 mile ) to any existing residence not located on
the site .
8 . Minimum area , Lot width , Yard requirements
Minimum area - 20 acres
Minimum lot width - 660 feet
Front yard - 50 feet
Side yard - 20 feet , except on corner lots ; then the side yard
shall be 50 feet
Rear yard - 20 feet
Height - 40 feet in airport zone
6 . 1 ( 2 ) Mobile Homes
(A) Mobile homes shall be permitted in the MN , Mobile Home
District as a use by right subject to the provisions
of the MH , Mobile Home District .
(B ) Mobile homes shall be permitted as an accessory use
limited to one mobile home per lot in any B , Business
District , C , Commercial District or I , Industrial
District where a mobile home is needed to house an
employee on the property for purposes of protection or
control of the principal use of the lot .

IN THE MATTER OF PLACING ALL WELD COUNTY EMPLOYEES ON A UNIFORM
PAYMENT, VACATION , SICK LEAVE , INJURY LEAVE AND RETIREMENT BASIS,
AND ESTABLISHING A PERSONNEL RECORDS FILE:
WHEREAS, the Board of County Commissioners , Weld County, Colorado,
deems it advisable to have uniformity in a payment, vacation and sick leave
policy for all Weld County employees, and including a complete Personnel
Records File in the County, and
WHEREAS, this Board has determined that Weld County should have a
uniform and complete personnel record file and a definite and consistent
policy relative to payment, vacation and sick leave , that all County officials
and departments can follow;
NOW, THEREFORE , BE IT RESOLVED, that all Weld County personnel
shall be subject to and abide by the following payment, vacation and sick
leave policy, to-wit:
(a) PAY PERIODS: Employees paid on a monthly basis shall be paid
on the last day of each month. In cases where the last day falls on Saturday
or Sunday or any of the officially established holidays , the employee shall
be paid on the last working day of the month.
(b) VACATION LEAVE: Paid vacation leave is given so that regular,
full-time employees may have a chance to relax from the everyday work
routine and yet not suffer any loss of pay. All regular, full-time employees
shall be allowed one day of paid vacation for each twenty-six days of
continuous employment, however, all employees shall have worked continuously
for six months before he shall be entitled to any of the vacation time he may
have accumulated. In no event shall more than ten working days of vacation
leave be accumulated and same shall be taken in the same calendar year in
which it is earned or as soon as it is practicable, however, under no circum-
stances shall accumulated vacation time be payable on termination of employ-
ment, unless recommended by the Department Head.
Official holidays occurring during a vacation period may be added to
the employee's vacation. Seasonal, temporary or emergency employees shall
not be eligible for vacation leave with pay. During the month of January of
each year Department Heads shall develop vacation schedules for employees
under their supervision which shall take into account the seasonal demands
upon their respective activities. Such schedules shall spread vacations over
as wide a period as possible in order to avoid any marked reduction in available
personnel. Vacation leave for all Road and Bridge employees shall not be
permitted during the months of July and August, except by special permission
of the Board of County Commissioners.
(c) OVERTIME AND/OR HOLIDAY PAY: Employees who are required
to work overtime in excess of regular hours and/or to work on the following
national holidays: New Years Day, Memorial Day, Fourth of July, Labor Day,
Armistice Day, Thanksgiving Day or Christmas Day, shall be considered to
be entitled to additional compensatory time . Such overtime shall be treated
as part of a subsequent day's work and may be accumulated as extra time off.
In no instance shall cash remuneration be made to any employee or employees
for overtime actually worked.
(d) SICK LEAVE: Sick leave is a privilege given by the County
to the employee to provide him with a feeling of financial security and to
prevent his endangering his health or the health of his fellow employees .
Sick leave shall not be considered as a privilege which may be used at
his discretion , but shall be allowed only in cases of actual illness . The
wise employee always tries to save it for a real emergency. County
Officials and all employees shall guard against use of sick leave without
proper justification, thereby guarding the continuance of sick leave
privileges to all employees.
Sick leave benefits shall apply to all regular full-time employees
of the County paid on a monthly basis . Sick leave shall accrue at the
rate of one working day of leave for each full calendar month of the
employee's service, but in no case shall such accumulation exceed sixty
(60) working days . Under special circumstances , long-time and worthy
employees may be granted additional sick leave beyond the sixty (60) day
limit by a Department Head with the approval of the Commissioners. A
doctor's statement shall be required if an employee is ill more than five
days or frequently. Accumulated sick leave shall not be payable upon
termination of employment and same shall not be used as vacation leave .

An employee may be granted sick leave because of personal illness
or physical incapacity resulting from causes beyond the employee's
control when not otherwise caused by being gainfully employed by persons
or firms other than the County of Weld.
An employee not reporting for work on account of illness shall
inform his supervisor of the fact and reason thereof as soon as possible
and prior to the time the work period begins. Failure to do so within
the above time limit may be considered as just cause for denial of sick
leave with pay for the period of absence unless the employee furnishes
a just, reasonable explanation as to why it was impossible to give such
notice. Continued absence without permission shall be sufficient cause
for forfeiture of all rights and privileges earned while employed, or the
employee may be considered to have resigned.
(e) INJURY LEAVE:
(a) An employee injured on the job while working within
the scope of employment shall be placed on one-half salary
the day following the injury. This shall continue for a period
of six months.
(b) During the time an employee is off work due to such
injury, he shall not accumulate sick leave or vacation leave .
(c) If an injured employee is desirous of obtaining a full
paycheck, he may do so by utilizing accumulated sick leave
and vacation leave.
(d) If an employee is off work due to injury incurred on
the job for a period of time in excess of six months, he shall
be removed from the payroll.
(e) Such injured employee will be allowed to keep the sum
or sums of money received from the State Compensation
Insurance Fund.
(f) Before such an injured employee is allowed to return
to work, a written release shall be required from his doctor
stating the employee's condition and when he will be able to
assume full responsibility of his work.
(f) SPECIAL LEAVE: Upon approval of the Department Head, an
employee may be granted special leave with pay to attend professional and
technical conferences , meetings , and short course schools relating to his
duties , or to visit other counties to obtain information and observe
practices related to his duties with the County of Weld.
An employee shall be permitted a leave with pay at the death of
a member of the employee's immediate family, including the husband or
wife, son or daughter, father, mother, brothers , sisters, father-in-law,
mother-in-law, brother-in-law or sister-in-law, but not to exceed three
days which shall not be deducted from the accrued sick leave or vacation
leave.
A leave of absence for any emergency may be granted by a Depart-
ment Head with the approval of the Commissioners .
(g) PAYMENT FOR LEAVE: Before any payment is made for sick
leave, vacation leave or other leave , the employee shall make written
application therefor on forms to be furnished by the Chief Accounting
Officer. The application must be certified to by his supervisor. Sick
leave pay in excess of five working days shall be granted only after
presentation of a written statement by a reputable physician certifying
that the employee's condition prevented him from performing the duties
of his position. Any employee fraudulently obtaining sick leave , or a
Department Head falsely certifying to sick leave payments or for absence
from work for other reasons, may be suspended or dismissed . Whenever
sick leave exceeds the amount accrued and authorized, the pay of an
employee shall be discontinued until he returns to work.
(h) RETIREMENT: From date of this Resolution and until further
Order of the Board, it shall be the policy of Weld County not to employ any
person sixty-five (65) years of age or older. Hereafter, on and after
January 1 , 1972 , every County employee reaching his or her sixty-fifth
birthday will be notified in writing of his or her employment status regarding
this policy and his or her employment shall be terminated within thirty (30)
days of such notification.

(i) PERSONNEL RECORD FILE: Adequate personnel forms , records
and reports are essential to the efficient functioning of a personnel
system. It is also necessary that the personnel records be centrally
maintained and readily available that they may be of maximum use . The
Chief Accounting Officer shall cause to be maintained a complete personnel
file of each employee which will include a folder for each full-time employee,
filed alphabetically. The file shall contain the employee's application for
employment, all memoranda and correspondence, seniority record , sick leave
and injury reports, performance records, data relating to promotions ,
demotions, lay-offs and dismissals , record of outstanding service , violations
of rules if any, acts of recklessness , and any other data pertinent which will
aid in developing a complete history record of the employee's service with
the County. The Chief Accounting Officer shall develop such forms as are
necessary to carry out the provisions of these regulations .

health insurance for all Weld County officials and employees , and
WHEREAS, it has been determined that such County group health
insurance be purchased under the most reasonable terms and conditions ,
and
WHEREAS, the GREELEY ASSOCIATION OF LIFE UNDERWRITERS has
offered its services to the County to procure such group health insurance
coverage, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado believes it to be in the best interests of the County to accept
the offer of the Greeley Association of Life Underwriters to aid the County
in purchasing such insurance coverage.
NOW, THEREFORE , BE IT RESOLVED, that until further order of the
Board, the Greeley Association of Life Underwriters, be and it hereby is

CONCERNING RETAIL 3 .2 FERMENTED
MALT BEVERAGE LICENSE OF
STANLEY SOMERS
The application of Stanley Somers for retail 3.2 fermented malt
beverage license came on for hearing October 20, 1971 , and the Board
of County Commissioners of the County of Weld having heard the testimony
and evidence adduced upon said hearing and having considered the testi-
mony, evidence and petition filed with said Board, and having carefully
weighed the same, now makes the following findings:
1 . The evidence discloses that the applicant is the owner of said
premises sought to be licensed within the meaning of the statutes .
2 . That no question was raised nor objection offered as to the
applicant concerning the standing, character or motives of said applicant.
3. The applicant has proven a prima facie case as to the reason-
able requirements of the neighborhood.
4 . The desires and needs of the inhabitants of the immediate
neighborhood, as well as the needs of the traveling public and customers
of the petitioner are not fulfilled, inasmuch as there presently is no retail
3.2 fermented malt beverage license, for consumption off the premises
only, in the area designated as the neighborhood.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of
Weld, has heard the application of Stanley Somers for a retail 3 .2
fermented malt beverage license , for consumption off the premises only,
at a location described as follows:
All that part of the SE 1/4 of Section 31 , Township 1 North,
Range 66 West of the 6th P.M. , Weld County, Colorado,
described as follows:
Beginning at the southeasterly corner of that part of the
SE 1/4 of said Section 31 lying west of the right of way of
the Union Pacific Railway Company; thence west along
the south line of said SE 1/4 of Section 31 , 184 feet;
thence north 256.3 feet to a point, thence east to a
point on the west side of said right of way; thence
southwesterly along the west line of said right of way
264 feet, more or less to the point of beginning, and
WHEREAS, the said Board has made its findings on the evidence,
testimony, petitions and remonstrances submitted to it, which findings
precede this Resolution and by reference are incorporated herein and made
a part hereof, and
WHEREAS, the said Board has carefully considered the application,
evidence, testimony, petitions and remonstrances and given the same such
weight as it, in its discretion deemed proper, and is now fully advised in
the premises;

WHEREAS, Weld County, has been required by a Supreme Court decision
to pay twenty percent of its Welfare Costs; the use of approximately $400,000.00
surplus cash from the General Fund; the costs created by the new statutes
requiring the Road and Bridge Fund to reimburse cities and towns; the costs
involved in the creation of a full time District Attorney Office and staff; the
needs created by the growth of the County to serve the needs of the County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of Weld County, Colorado, that the Chairman be and he is hereby authorized to 11
sign the application for the increase of levy for Weld County, Colorado, a ,l-✓

AMENDMENT TO SANITARY LANDFILL CONTRACT
THIS AMENDMENT, made to that certain SANITARY LANDFILL CONTRACT
dated July 2 , 1969, by and between WELD COUNTY , COLORADO and WELD
COUNTY LANDFILL, INC. , WITNESSETH:
WHEREAS, heretofore pursuant to resolution by the Board of County
Commissioners , County of Weld, State of Colorado, passed July 16, 1969,
the parties did enter into a Sanitary Landfill Contract dated July 2 , 1969; and
WHEREAS, certain recommendations relative to the contract have been

4q. made to the Weld County Board of County Commissioners by the County
Auditor; and
WHEREAS , in the course of operating the Landfills or dumps since
the date of the contract, both parties have acquired some experience and
knowledge , as to the proper operation and management thereof; and
WHEREAS, in order to meet the Sanitary Landfill needs in the Greeley
area , Weld County Landfill, Inc. is in the process of acquiring a new site
for future operations and to justify the necessary expenditures , will need
additional time under the contract in order to economically recover the cost
of such site.
NOW, THEREFORE, in consideration of the foregoing and in consid-
eration of the continued operation of the Sanitary Landfill Contract of
July 2 , 1969 , the parties hereto mutually agree as follows:
1 . The period of time or term of Sanitary Landfill Contract between
the parties shall be extended to July 1 , 1976.
2 . Paragraph 10 of the Sanitary Landfill Contract is amended to
read as follows:
10. So long as Landfill shall operate its certified dumps
in accordance with this agreement, County shall guarantee a
gross revenue of Five Thousand Dollars ($5 ,000. 001 per dump
per calendar year, or pro rata on partial year operation; said
guarantee to be payable quarterly; however, only after exam-
ination of the records of Landfill as soon as possible after
the end of each quarter by the County Finance Officer or
persons designated by the Board of County Commissioners .
Any such payment, or payments , made by the County shall

be done immediately after thirty days following the end of each
calendar quarter of operation of each dump or as soon thereafter
as it is practicable.
3. Paragraph 13 of the Sanitary Landfill Contract is amended to
read as follows:
13 . Landfill shall furnish the County a certificate
evidencing that it has in force insurance with the following
mimimum amounts: $100 ,000.00 liability per person ,
$300,000 .00 per accident, and $25 ,000 .00 property damage ,
for the period of this agreement. In addition, to assure
prosecution of the within contract, a performance bond in
the amount of $10, 000. 00, guaranteeing that Landfill will
meet the requirements of the contract, will be furnished.
4 . Except as expressly modified or amended by this amendment,
the original Sanitary Landfill Contract of July 2 , 1969 shall remain in full
force and effect.
IN WITNESS WHEREOF, the parties have hereunto set their hands
and seals this 3rd day of November, 1971 .

RE: AGREEMENT BETWEEN WELD COUNTY AND NORTHERN
COLORADO DETECTIVE AGENCY INC. , NORTHERN ARMOURED
SERVICE, INC. , AND AMERICAN DISTRICT TELEGRAPH
COMPANY FOR BURGLARY ALARM SERVICE.
WHEREAS, it is apparent to the Board of County Commissioners,

Weld County, Colorado, that there is an urgent need for a more
adequate and efficient security service system for the Weld County
Welfare Department in connection with its food stamp program, and
WHEREAS, Northern Colorado Detective Agency, Inc. has sub-
mitted a proposal for security protection for the Weld County Welfare
Department, and
WHEREAS, the Northern Armoured Service, Inc. has submitted
a proposal for armoured car service for the Weld County Welfare
Department, and
WHEREAS, American District Telegraph Company has submitted
a proposal for a burglary alarm system for the Weld County Welfare
Department; and

WHEREAS, the Board believes it to be in the best interest of
Weld County to enter into the aforementioned agreements as proposed
and submitted by each of the parties, and upon the basis recited in each
agreement.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that said agreements hereinabove
mentioned providing for security protection for the Weld County Welfare
Department, per copy of each proposal attached hereto and made a part
hereof by reference, be, and thephereby are approved.
BE IT FURTHER RESOLVED that the Board be, and it hereby is
authorized to execute the agreements as submitted by Northern Colorado
Detective Agency Inc. , Northern Armoured Service, Inc. , and American
District Telegraph Company, and to make each of said agreements
effective forthwith.

price of One Thousand Six Hundred Seventy Five Dollars ($1 , 675.00) .
NOW, THEREFORE , BE IT RESOLVED, that the Board of County

BUDGET MESSAGE

The accompanying budget has been prepared on forms we have designed, and the chart of accounts we are using is in
accordance with the Local Government Audit Law. More progress has been made this past year toward centralization
of all accounting and purchasing functions. Most departmental final budgets were pared from the original requests
of the department heads. However, we feel all departments are adequately funded if operated efficiently.
The Road and Bridge Fund cost accounting system has been completed and centralization of this fund partially com-
pleted. Some comparison in this fund is not possible at this time, but in future years it will be.
The Public Works County Building Fund provides funds for engineering for construction of a new county office complex.
The Hospital Building Fund provides funds toward a planned $7 million expansion.
Because of a Supreme Court decision whereby Weld County was required to fund a full 20 per cent of all welfare costs,
a deficit estimated at $401 ,121 results. The 6.9 mill levy for welfare purposes includes this deficit plus funding
total operation of the Welfare Department for 1972.
The line headed, "Assessed Valuation - County Funds" on the following two pages shows the continued uninterrupted
increases in valuation for the years 1969 tc 1972.
