RESOLUTION RE: ACTION OF BOARD AT SHOW CAUSE HEARING, PCSC19-0002, TO SHOW WHETHER GOOD CAUSE EXISTS FOR REVOCATION OF USE BY SPECIAL REVIEW PERMIT, USR12-0019, FOR MINERAL RESOURCE DEVELOPMENT FACILITIES INCLUDING AN OIL AND GAS SUPPORT AND SERVICE FACILITY (OFFICE AND SHOP BUILDING AND OUTSIDE PARKING, STORAGE AND STAGING AREA FOR VEHICLES AND EQUIPMENT) IN THE A (AGRICULTURAL) ZONE DISTRICT - C&M RODRIGUEZ SERVICES, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on August 14, 2019, a Show Cause Hearing, PCSC19-0002, was conducted to consider whether good cause exists for revocation of Use by Special Review Permit, USR12-0019, for Mineral Resource Development Facilities including an Oil and Gas Support and Service Facility (office and shop building and outside parking, storage and staging area for vehicles and equipment) in the A (Agricultural) Zone District, issued to C&M Rodriguez Services, Inc., P.O. Box 677, Fort Lupton, Colorado 80621, and WHEREAS, C&M Rodriguez Services, Inc., is the current owner of the facility located on property being further described as follows: Lot B of Recorded Exemption, RE -4015; being part of the E1/2 NE1/4 of Section 7, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing of August 14, 2019, the Planning staff advised the Board of their recommendation for USR12-0019, to be either suspended or revoked, and WHEREAS, after hearing all testimony presented, the Board found the site to be out of compliance with Development Standards #1, 29, 36, and 37 due to the utilization of the site for an RV storage and towing business, along with banner signs that are not allowed per the County Code. Staff Finding • STAFF FINDS THAT THE APPLICANT IS NOT IN COMPLIANCE WITH DEVELOPMENT STANDARD #1, DEVELOPMENT STANDARD #29, DEVELOPMENT STANDARD #36 AND DEVELOPMENT STANDARD #37 • RV Storage along with a towing service/impound lot are still being advertised. The number on the attached advertisements (for the towing service and RV storage facility) are still working. I called the RV storage number and confirmed that they are leasing spaces on site. Neither RV storage or towing service were part of the USR1Z-0019 application and approved USR. • Additionally combustors have been moved onto the site in Spring of 2019. The height of this equipment is considerably taller than other equipment on the site and can only be partially screened from adjacent properties. Development Standard #29 refers to Section 23-240. Per Section 23-2-240 of the Weld County Code: Buffering or Screening of the proposed use from adjacent properties may be required in order to make the determination that the proposed USE is compatible with the surrounding uses. Buffering or screening may be accomplished through a combination of berming, landscaping and fencing. It is impossible to screen these combustors from adjacent properties and the combustors are located on the north side of the property. • The banner signs on the USR are not in compliance with the Weld County Code. • Staff has received no phone calls, e -mails or correspondence from the property owner despite repeated attempts to contact them since March 1, 2019. Our business is located on the North boundary of C&M Rodriguez property. For the last month or so, Rodriguez had two Sand Boxes on top of each other with a banner to hire CDL drivers. It blocks the view of our $38,000 business sign that we have along Highway 85. However, we thought that it was a temporary Thing. But the Sand Boxes are still there. And the banner has blown off. On Friday, April 26, they started bringing 70 foot tall towers (see enclosed pictures). They are starting to totally obscure the view of our store and display lot. And they are putting up even More today. They are not anchored down to protect against the wind, they are not grounded for protection against lightning strikes. If they blow over/fall over, they will land on our property and our assets. It is very unsafe. Are both of these tall obstructions permissible under their current USR? Are they allowed to Totally obscure an adjacent business that is dependent on a visual display lot? The attached pictures were taken Saturday, April 27, 2019.
