RE: AUTHORIZE FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO C.R.S
§38-1-101, AGAINST HEIN FAMILY REGISTERED LIMITED LIABILITY
PARTNERSHIP
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County is in need of acquiring additional property for the improvement
and expansion of the intersection at County Roads 17 and 54, in a portion of Section 29,
Township 5 North, Range 67 West of the 6th P.M., Weld County, Colorado, as more fully
described and depicted in the attached Exhibits, and
• Exhibit A, Legal Description, Depiction, and form of Public Right-of-Way (ROW)
• Exhibit B, Legal Description, Depiction, and forms of Permanent Easements for Xcel
Energy, aka Public Service Company of Colorado, and Poudre Valley Rural Electric
Association (PE)
• Exhibit C, Legal Description, Depiction, and form of Temporary Construction
Easements (TCE)
WHEREAS, in an appraisal prepared by Virginia Messick, Certified Appraiser, the value
of the Property to be acquired is established at $48,000.00, and
WHEREAS, said Property is owned by Hein Family Registered Limited Liability
Partnership, and
WHEREAS, negotiations with the Property Owner have included numerous phone calls,
letters, emails, in-person meetings, and site visits between and including: Weld County Right-of-
Way Agent Tiffane Johnson, Weld County Engineer Don Dunker, Weld County Engineers Mike
Bedell and Cinde Wright, Weld County Public Works Deputy Director Elizabeth Relford, and Phil
Hein, and between Assistant Weld County Attorney Karin McDougal and attorney for Hein Family
Registered Limited Liability Partnership, Carrie Bernstein, and
WHEREAS,Weld County made an offer to purchase the Property on September 25, 2019,
for the compensation amount of$55,000.00, and
WHEREAS, the County and the Property Owner have attempted to negotiate
compensation, but to date, the parties have been unable to reach an agreement for the purchase
of said Property, and

WHEREAS, the improvement and expansion of the intersection at CRs 17 and 54, as it
proceeds past the Respondent's property, is necessary for the public good to provide safety for
the traveling public due to historic and projected increased traffic at said intersection, and
WHEREAS, the Property Owner was notified by email addressed to counsel dated
October 14, 2019, of the place and time of the hearing at which the Board considered this
Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the Weld County Attorney be, and hereby is, authorized to file a proceeding
in eminent domain, pursuant to C.R.S. §38-1-101 et. seq., against Hein Family Registered Limited
Liability Partnership, in the Weld District Court to acquire the Property described and depicted in
the attached Exhibits.
BE IT FURTHER RESOLVED by the Board that the acquisition of such Property is
deemed necessary for the health, safety and welfare of the citizens of Weld County, Colorado.
BE IT FURTHER RESOLVED by the Board that the Controller shall cause to be paid
$55,000.00 into the Registry of the Court, being the amount that Weld County estimates is the
appropriate value of the property, including all damages, for the purpose of acquiring the
aforementioned Property upon the filing of a motion for possession of the Property, or if in
conjunction with a joint and stipulated motion for immediate possession or a stipulated Rule and
Order, payment may be made to Respondent as an alternative to depositing such sums into the
Registry of the Court.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 16th day of October, A.D., 2019.

The undersigned Grantor hereby acknowledges receipt of good and valuable consideration from PUBLIC SERVICE COMPANY
OF COLORADO (Company), 1800 Larimer Street, Suite 1100, Denver, Colorado, 80202, in consideration of which Grantor(s)
hereby grants unto said Company, its successors and assigns, a non-exclusive easement to construct, operate, maintain,
repair, and replace utility lines and all fixtures and devices, used or useful in the operation of said lines,through, over, under,
across, and along a course as said lines may be hereafter constructed in a portion of Recorded Exemption RE-2521., Weld
County Records, also being a portion of that Tract of land described in Reception Number 2722940, Weld County Records, in
the NE/4 of Section 29,Township 5N, Range 67W of the 6th Principal Meridian in the County of Weld, State of Colorado,the
easement being described as follows:
A 20 foot easement more particularly described in Exhibit B attached hereto and made a part hereof.
The easement is 20.00 feet in width. The side boundary lines of the easement shall be lengthened and shortened as necessary
to encompass a continuous strip of not less than the above width at all points on Grantor's property crossed by the above
described easement and extending to the boundaries of adjacent properties.
Together with the right to enter upon said premises, to survey, construct, maintain, operate, repair, replace, control, and use
said utility lines and related fixtures and devices,and to remove objects interfering therewith, including the trimming or felling of
trees and bushes, and together with the right to use so much of the adjoining premises of Grantor during surveying,
construction, maintenance, repair, removal, or replacement of said utility lines and related fixtures and devices as may be
required to permit the operation of standard utility construction or repair machinery. The Grantor reserves the right to use and
occupy the easement for any purpose consistent with the rights and privileges above granted and which will not interfere with or
endanger any of the said Company's facilities therein or use thereof. Such reservations by the Grantor shall in no event include
the right to erect or cause to be erected any buildings or structures upon the easement granted or to locate any mobile home or
trailer units thereon. In case of the permanent abandonment of the easement, all right, privilege, and interest granted shall
terminate,
The work of installing and maintaining said lines and fixtures shall be done with care;the surface along the easement shall be
restored substantially to its original level and condition.

GRANT OF TEMPORARY CONSTRUCTION EASEMENT
This Temporary Construction Easement (TCE), is made between Hem Family Registered
Limited Liability Partnership, (referred to herein as "Owner", whether one or more), and the
County of Weld,a body corporate and politic of the State of Colorado,through its Board of County
Commissioners(referred to herein as "County"):
WITNESSETH: That Owner, for and in consideration of payment made by County, the receipt
and sufficiency of which is hereby acknowledged, does hereby dedicate and convey unto County
a Temporary Construction Easement, covering that real property lying and being in the County of
Weld, State of Colorado,to wit:
The real property described and depicted on the attached Exhibit
Subject to the following conditions:
1. The TCE is conveyed from Owner to County immediately and shall expire and be of no
further force January 1, 2021 or upon the County's determination that the Project is
complete, whichever is earlier.
2. The right to use the TCE shall belong to the County and its agents, employees, designees,
contractors, guests, invitees, successors and assigns,and all those acting by or on behalf of
the County for the purpose of surveying, appraising, establishing, laying, constructing,
reconstructing, installing, realigning, modifying, replacing, improving, adding, altering,
substituting, operating, maintaining, accessing, inspecting, patrolling, protecting, or
repairing the roadway improvements, including the storage of materials related to said
roadway improvements.
3. County shall have the right of ingress, egress, entry and access in, to, through, on, over,
under, and across the TCE from any adjacent property to which County has legal access,
for any and all purposes necessary and/or incident to the exercise by the County of the
rights granted to it hereunder. At the expiration of the term of this TCE, County shall
promptly repair any damage to Owner's property caused by County, its agents,employees,
contractors,guests,invitees,and all those acting by or on behalf of County so as to maintain
the Owner's property in substantially as good or better condition as existed prior to use by
County.
4. County agrees that any current access to the property from the Right-of-Way shall remain
open throughout the term of the TCE.
5. Owner shall not erect or construct, or allow to be erected or constructed, any building or
other structures on the property described in Exhibit C which may interfere with County's
full enjoyment of the rights hereunder; this Easement includes all rights and privileges as
are necessary or incidental to County's reasonable and proper use of said easement.

6. Owner agrees to limit farming(plowing, planting, irrigating,harvesting, etc.) to the TCE.
The TCE will be utilized for construction staging, materials storage, stockpiling and
utilities relocation. In addition, these areas will be utilized to construct temporary earthen
berms and ditches to control storm-water runoff and irrigation tailwater from entering the
work zone. After all the work is completed these areas will be returned to their original
condition with a layer of topsoil.
