HomeMy WebLinkAbout730569.tiff . ` RESOLUTION WHEREAS, a public hearing was held on August 13, 1973, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Panhandle Eastern Pipeline Com- pany, c/o George Minturn, P. O. Box 65, Greeley, Colorado 80631, re- questing approval of site for the construction of a liquid terminal site and compressor station on the following described property, to-wit: A tract of land, being the Southwest Quarter of the Southwest Quarter of Section 23, Township 2 North, Range 65 West, Weld County, Colorado, and more particularly described as follows: Beginning at the Southwest corner of the Southwest Quarter of said Section 23; thence South 89 Degrees 11 Minutes 50 Seconds East for a distance of 1320 feet; thence North 0 Degrees 14 Minutes 40 Seconds East for a distame of 1320 feet; thence North 89 Degrees 11 Minutes 50 Seconds West for a distance of 1320 feet; thence South 0 Degrees 14 Minutes 40 Seconds West for a distance of 1320 feet to the point of beginning, and containing 40. 0 acres, more or less, and, WHEREAS, the petitioner was present, being represented by Mr. John Ross, counsel of the company, and by counsel Walker Miller, of Greeley, Colorado, and WHEREAS, there was some opposition to the request of petitioner for the location of said liquid terminal site and compressor station facility, and WHEREAS, the said requested location for said liquid terminal site and compressor station facility is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (2) of the Zoning Resolution of Weld County, said location for said liquid terminal site and compressor station facility may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Panhandle Eastern Pipeline Com- pany, c/o George Minturn, P. O. Box 65, Greeley, Colorado 80631, to locate a liquid terminal site and compressor station facility on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect said construction of said liquid terminal site and compressor station facility and that it shall have up to one (1) year from date hereof to begin the construction of such facility; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. PL0758 730569 • 3. Subject to a suitable four-strand barb wire fence with in between stays being erected around the perimeter of the premises. 4. That such liquid terminal site and compressor station facility shall be limited to the items as shown on plans as submitted and which are attached hereto and made a part hereof by reference. 5. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Example : For the past two or three years , there has been a number of prospecting permits for uranium development on the grasslands issued . These are prospecting permits only . When it comes to extracting the materials , there would probably be open pit mining which the County might be in- terested in . This pertains to land under the Forest Service Act only . Mr. Connell stated that he would like some time to study the agreement , and possibly change some of the wording , mainly to read grasslands instead of forest land . SUBJECT: Personnel DISCUSSION : Mr . Adams stared that six months ago additional help had been requested to help with the field inspections and ( building inspections . Need someone almost full time to stay in the office and plan check and answer questions concerning construction of buildings . Mr. Adams submitted a list of the salaries presently being paid to employees of the Weld Co . Planning staff. He requested a reason for his salary not being raised at the end of the an- niversary date as he had been informed he would . Mr. Watson made a motion that if the present budget could afford $70 . 00 more a month immediately , then ok . Retroactive to June 1 . Mr. Nix felt that Mr. Lorenson should be given the responsibility of carrying through with the employees of the County that are under his direction . Secondly, the only assurance to give Mr . Adams , the Board will follow through with his request and- if _ at all possible to make the adjustment (retroactive to June 1 ) under the direction of Mr . Lorenson . Mr. Ohi stated that the salary survey would show that our highs were quite a bit under those of other counties . It was the general feeling that Mr. Adams should not have had to appear on his own behalf. Mr. Anderson read the letter from the Town that stated they were not in favor of the rezoning of this land at this time . Staff recommends denial because it does not agree with land use policy 907 and does not agree with surrounding ianc. _se and zoning and does not agree with LaSell ' s proposed future land use plan . CASE NUMBER: SUP #215 Tape 488 - / SUBJECT : Trap & Shooting Range with Game Preserve LOCATION : All NE4 North and West of Owl Creek Sec 19 T7 R64 DISCUSSION : This was tabled at the last meeting until after a field trip was made to the site . Said field trip was made at 11 a.m. June 19 , 1973 . One additional petition submitted by applicant. Mr . Connell stated that the basic thing to look at in any ap- plication was the immediate welfare and safety of the area . Mr. Nix stated that the applicant should provide ample security. Mr. Watson stated that the Board was told verbally that the shooting range would be over 600 ' over the ridge . They will also do all the dirt work and build as many bluffs as necessary . Mr . Anderson read the reasons listed on the petitions : 1 ) Bring too much traffic into the area ; 2) Gun ranges would imperil the people and livestock in the area ; 3 ) The gun fire would make too much noise ; and 4 ) It would bring too many hunters into the area . The question of dropping the game preserve was brought up as possibly helping alleviate some of the objections of the neighbors . Mr. Anderson read staff comments ( see minutes June 4) . The answer to petition against SUP ( Item #5 on staff recommenda- tions ) was suggested to be stricken since the approval to the satisfaction of" cannot be done as there is no criteria for it. Mr . Elliott stated that after making the field trip , there were only four or five houses actually in the area . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Planning staff ' s recommendations deleting Number 5 and also having some sort of liability in- surance coverage . Motion by Mr. Elliott , second by Mr . Rothe . A vote of "Aye " by Anderson , Watson , Nix , Rothe and Elliott . Motion carried . SUBJECT: Glen Douthit Tape 489-/ DISCUSSION : Has started building feed bunks about 7 ' from highway. He is presently in violation of County zoning regulations and has been tagged as such . Needs to be sent a letter of violation explaining what is wrong . Tabled until regular meeting . The regular meeting of the Weld County Planning Commission was held June 19 , 1973 at 3 : 00 P . Rosales came in for his building permit for the barns he should have been told at that time he would have to have a Special Use Permit before he could continue with his plans . Mr . Rosales does not comply with a farm existing feeding operation because he only has 40 acres of land and he can ' t raise enough roughage on 40 acres of land to feed 100 head of dairy cows , therefore he does need a Special Use Permit . If a person raises more than 50% of the roughage fed his cattle on what land he owns , then he does not have to obtain a Special Use Permit . This removes liquid impurities from liquid gas , and then pumps the gas on to be used in the Denver area . , This is a 40 acre site located in the sandhills , with no visible residences around . May put up a structure that would be of a more permanent nature . Planning staff recommends ap- proval because it agrees with land use policy and it agrees with surrounding land use and zoning . Approval should be sub- ject to Health Dept. comments and construction beginning with- in one year ' s time from date of approval and limited to plans submitted . West Hill -N-Park is an addition to the existing Hill -N-Park Mobile Home Park . There is a proposed 100 ' right of way on 47th Avenue . Do have lagoons on the site . Have been notified they will have to be brought up to standards . There is an agreement between Evans and Arrowhead for 450 taps to service some ground in which Hill -N-Park , is lo- cated . The contract reads that Arrowhead can supply any of the 450 taps to Arrowhead Subdivision or to the SZ Section 26 in which Hill -N-Park is located . There is a letter from Mr. Karowsky stating that there are 190 taps left and West Hill -N- Park can utilize these taps ., Will buy the water from Evans or Central Weld as it becomes available . For now the commitment from Central Weld to service West Hill -N-Park is adequate per Mr. Ohi . If the plat is approved they can go ahead and enter into a contract . Mr . Benson stated that they were in the pro- cess of updating the system (sewage ) . Benson wanted to know if this action would possibly make them lose the zoning on this property as there is a time limit . The matter of the half street needs to be clarified once and for all . APPLICANT: Parkland Associates DISCUSSION : Mr . Ohi stated that Parkland Associates requested they be postponed until a later agenda . APPLICANT : Gilbaugh ' s Appaloosa Acres CASE NUMBER: S-104 Tape 490 SUBJECT : Replat LOCATION : 411/2 SW 1/4 Sec 3.3 T7 R65 APPEARANCE : Dennis Messner , NHPQ DISCUSSION : The main reason they are asking for the replat is to delete 10 ' of right of way that was dedicated on the previous plat on Lot 16 . This lot has existing improvements on it that will extend over the county road right of way . Mr. Gilbaugh ' s house was built outside the original boundaries of Lot 17 . Wish to replat it so the house would be on Lot 17 . Will be a heavy traffic intersection (Lot 16 ) . If the 10 ` deletion were allowed , it would cause more problems in the future . Mr . Connell stated that there is the right of condemnation so there was no need to change the right of way now . It is presently a hazardous corner . Should comply with the County set backs . Really not necessary to have a Special Use Permit . Douthit in regards to moving the feed bunks back to 50 ' and not have to appear before the County Commissioners . Second by Mr . Rothe . DISCUSSION : Mr . Ohi requested that the Board of Adjustment option be made a part of the motion . It was decided that it would not be necessary as he had that right anyway . Ohi submitted a list of salaries of the Planning Office with comparable salaries across the counties . Took into consideration what education , experience , etc . was necessary to qualify for the different job classifications . Mr . Nix suggested there be a way to rate the performance of each employee . Need a brief job description of each employee . SUBJECT : Comprehensive Plan DISCUSSION : Mr .
