RESOLUTION RE: GRANT APPEAL OF THE DECISION BY THE DEPARTMENT OF PUBLIC WORKS TO DENY ACCESS PERMIT FOR, RECORDED EXEMPTION, RECX18-0055 - TYLER AND BECKY LAURIDSEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Sections 2-4-10 and 12-5-100 of the Weld County Code, the Board of County Commissioners considered the appeal of the decision by the Department of Public Works to deny an Access Permit, for Recorded Exemption, RECX18-0055, submitted by the appellants, Tyler and Becky Lauridsen, and WHEREAS, the Board heard testimony and took evidence from Department of Public Works staff and the appellants, and WHEREAS, upon consideration of such appeal, including a review of all information submitted by the appellants and the Department of Public Works, the Board deems it advisable to grant the appeal of Tyler and Becky Lauridsen, reverse the decision of the Department of Public Works, and remand the issue back to staff with instruction to issue Access Permit, AP19-00066, conditional upon the applicant placing the access 1,135 feet north of County Road 96 and correcting to the original Recorded Exemption plat to show the newly approved access for Lot B. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the appeal of Tyler and Becky Lauridsen, be, and hereby is, granted, and the decision of the Department of Public Works to deny Access Permits is reversed and remanded back to staff with instruction to issue Access Permit, AP19-00066, conditional upon the applicant placing the access 1,135 feet north of County Road 96 and correcting to the original Recorded Exemption plat to show the newly approved access for Lot B. To Whom it May Concern, I am writing the appeals letter regarding the denial of an access variance to recorded plat RECX18-0055 and the Weld County Public Works Department. There is already an approved access to this recorded exemption but it must go through neighboring property to the north. The neighboring property is currently under a CRP contract and that owner has no intentions of taking that piece of property, which the current access must pass through, out of that CRP contract. Legally I cannot just put in a driveway through a piece of ground that is under a federal contract that states the ground cannot be disturbed. Also, I cannot force a landowner to remove this contract against his will. I have been told by public works that I can "just take it out of CRP" but I cannot as I am not the land owner. I also believe there is a safety issue as the sight distance to the south of the access is extremely short as there is a hill. You cannot see but about a 100' to the south from that access point. I have been told by employees from Weld County Public Works that they also believe there is a safety issue with this access point. I have also been told by Public Works employees that there is enough distance from current access to move my access but still has been denied. I understand there is an Access Control Plan for Weld County Road 29 but currently I am landlocked out of my own property. I have already started construction on my property and would like to get this matter resolved as soon as possible. The current access point is on the lot to the north of me where the current owner has that property under CRP contract and does not plan on taking it out of CRP anytime soon. Legally I cannot build an access or driveway to my property while it is under CRP. 2.) Where the current access is recorded the site distance to the south is blocked by a hill. I believe it is not safe to pull out on to CR 29 without being able to see any traffic coming from that direction. 3.) I have already ordered a house and it is currently under construction. My crawl space and foundation are going to be installed within a couple weeks. Without a solution to my access I fear I will not be able to continue work. Thank you for your consideration, Tyler Lauridsen MEMORANDUM TO: Board of County Commissioners DATE: February 13, 2019 FROM: Dawn Anderson, Public Works SUBJECT: Appeal of Access Permit Denial for Tyler Lauridsen Weld County Public Works received an access permit application from Tyler and Becky Lauridsen in January 2019. The permit application was in connection with a four -lot recorded exemption, RECX18- 0055. The access application requested a residential access for Lot B onto WCR 29. This request conflicted with the signed and recorded plat, dated September 13, 2018, that specifically permitted access to both lots A & B through a 30 -foot access and utility easement. Public Works staff denied the request for a residential access permit at the proposed location since access to this property was already addressed and approved during the Recorded Exemption process with a shared access easement specific to the Weld County Code sections as follows: 12-5-30.A, Access to a Single Parcel. Each parcel shall be allowed one access point for safe ingress and egress, which may be an existing or new shared access. Each parcel shall be limited to this single access, except as modified by the Board of County Commissioners; as a result of zoning requirements; consideration in land use applications; safety considerations; subdivision regulations; or the inability to meet minimum requirements as outlined in the Weld County Engineering and Construction Criteria document shown in Appendix 12-A. 24-8-40.C, Exemption Standards. An access is, or can be made, available that provides for safe ingress and egress to a public road. All accesses shall be in accordance with Chapter 12, Article V of this Code, and shall endeavor to achieve the goal of no "net increase" in the number of accesses onto adjacent County roads when accesses already exist. 1. Where the access is adjacent to a state highway, the Colorado Department of Transportation has jurisdiction over existing or proposed access points. The applicant shall be responsible for obtaining a new Access Permit from the Colorado Department of Transporation. 2. Contiguous lots created through the exemption process shall, when practicable, share access. 3. Existing or future public rights -of -way and additional access points on County roads shall be dedicated or reserved in conformance with Chapter 22 of this Code and any adopted intergovernmental agreements or master plans of affected municipalities. 4. A new access with a choice as to which County road it feeds onto shall choose the County road with the lowest traffic count. Upon being informed that the requested access was being denied, Public Works staff received a variance request and hardship, see Exhibit B. In summary, this letter states three points for requesting a separate residential access point as follows: • The current owner of the lot to the north, Lot A, has the property under CRP contract and there is concern as to whether an access or driveway can legally be constructed under this status. • The current access as shown on the recorded plat of RECX18-0055 has a safety concern as there is a small hill blocking site distance. • Applicant has already purchased a house and has the crawl space and foundation being installed. Without approval of the proposed access point the applicant fears that work on the house will have to cease. Although Public Works does not agree with the first and third bullet points as being a hardship considering that this recorded exemption was just completed recently, a site visit was conducted to address the second bullet point. Public Works staff does concur that the proposed access location has a better range of site distance and therefore recommends approval of the proposed access point on the following conditions: 2019-0714 1. The access is located 1,335 feet north from WCR 96, which will ensure that the spacing meets the arterial designation as well as the criteria set forth and approved in the WCR 29 Access Control Plan (ACP). 2. The applicant corrects the plat to show the access locations as approved by the Board of County Commissioners. WCR 29 is a gravel arterial road as identified on the County's functional classification map. The WCR 29 ACP calls out right-of-way at 100' except at five designated intersections that require 140' of right-of-way. The ADT is 133 with 24% of the vehicles per day being trucks.
