HomeMy WebLinkAbout20192756.tiffHEARING CERTIFICATION DOCKET NO. 2019-89.B RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR19-0013, FOR A USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (LANDSCAPE BUSINESS - INCLUDING THE STORAGE OF EQUIPMENT AND COMMERCIAL VEHICLES), PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT - BRANDON AND COLLEEN OLSON A public hearing was conducted on July 24, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Maxwell Nader Public Works Department representative, Hayley Balzano Health Department representative, Ben Frissell The following business was transacted: e I hereby certify that pursuant to a notice dated June 12, 2019, and duly published June 14, 2019, in the Greeley Tribune, a public hearing was conducted on July 17, 2019, to consider the request of Brandon and Colleen Olson, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0013, for a Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (landscape business - including the storage of equipment and commercial vehicles), provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, at which time the Board deemed it advisable to continue the matter to July 24, 2019, to allow the applicants to be present. Bob Choate, Assistant County Attorney, made this a matter of record. e Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal, and provided the hours of operation. He stated the owners are the only employees that will be onsite, and explained the types of vehicles which will be stored based on the season. He described the proposed buildings and indicated no correspondence had been received. He stated 11 referrals were sent out and seven (7) agencies responded, and noted the site is within the three (3) mile referral areas of the Cities of Dacono and Northglenn. He displayed images of the site and surrounding views and entered the favorable recommendation of the Planning Commission into the record as written. GG'.PLC(`nrlf TP),Pw(HB,g 1(gF.) ©a/(9(19 2019-2756 PL2668 HEARING CERTIFICATION - BRANDON AND COLLEEN OLSON (USR19-0013) PAGE 2 e Hayley Balzano, Department of Public Works, provided a brief overview of the transportation plans and requirements, stated the access is on County Road (CR) 8, provided the traffic counts and average speeds in the area, and presented the drainage and grading requirements. In response to Commissioner Conway, Mr. Nader stated several vehicles onsite are not related to the business and clarified the requirements of the Fort Lupton Fire Protection District. e Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions. He reiterated the two (2) owners will be the only employees to utilize the site. He stated the on -site residence is serviced by a domestic well and existing septic, there will be no on -site washing or maintenance of vehicles or chemical or fuel storage, and Development Standards (DS) #9-18 address Environmental Health (EH) items. • In response to Chair Kirkmeyer, Mr. Nader displayed the overhead view of the proposed USR, explained the application is for a 2.5 -acre strip of land, pointed out the location of the existing house and garage, and Ms. Balzano confirmed the applicant is not proposing to change the access location. Mr. Nader confirmed the non-commercial junk yard is on the north end of the property, and reiterated several vehicles are either not plated or did not appear to be business vehicles. e Brandon Olson, applicant, provided a brief the history of the property and explained he built a home and garage on the property and has been living there since January 2019. He indicated the USR application is solely to store equipment for his landscaping business, and stated his wife runs the business from an office in the home. In response to Commissioner Conway, Mr. Olson explained the non -plated vehicles came with the property when his father originally purchased it, and he is working on cleaning them up. In response to Commissioner Moreno, he clarified the equipment associated with the business that will be stored on the property. • No public testimony was offered concerning this matter. lEi In response to Chair Kirkmeyer, the applicant stated the equipment shed will be built in 2020, and he will screen the business vehicles from all existing residential properties, in and behind the three -car garage. He described the landscaping as being grass, confirmed all of the Fort Lupton Fire Protection District concerns had been addressed when the house was built, and reiterated no employees will be onsite. e Chair Kirkmeyer suggested deleting COA #1.A (fire district requirements), as it has been addressed, and confirmed Mr. Olson understood the requirements of the non-commercial junk yard. She suggested deleting "landscaping and" in COA #1.C.6 (screening), deleting COA #1.C.8 (delineate parking area on the map), COA #1.C.7 (delineate lighting on the map), and deleting the "s" from "locations" in COA #1.C.11. She further suggested deleting COA #1.C.12 (tracking control), COA #1.C.15 (parking and traffic circulation flow arrows), and COA #4.A (access and tracking control). Lastly, she suggested deleting DS #3 (hours of operation), DS #4 (number of employees), DS #6 (parking area maintenance), deleting "landscape and" in DS #7 (screening), deleting DS #13 (noise levels), DS #14 (drinking, handwashing, and toilet facilities), and DS #16 (review of existing septic system). The Board was agreeable to all of the above -mentioned changes. 2019-2756 PL2668 HEARING CERTIFICATION - BRANDON AND COLLEEN OLSON (USR19-0013) PAGE 3 No public testimony was offered with regard to changes made to the Conditions of Approval and Development Standards. el In response to Chair Kirkmeyer, Mr. Olson indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. e Commissioner Moreno moved to approve the request of Brandon and Colleen Olson for a Site Specific Development Plan and Use by Special Review Permit, USR19-0013, for a Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (landscape business - including the storage of equipment and commercial vehicles), provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended. The motion was seconded by Commissioner Conway, and it carried unanimously. There being no further discussion, the hearing was completed at 10:44 a.m. This Certification was approved on the 29th day of July, 2019.
