WHEREAS, Weld County, Colorado, is the owner of or has an interest
in two tracts of real property describred as follows, to-wit:

WHEREAS, Tracts I and II above described are within an area pro-
posed to be annexed to the Town of Ault, and
WHEREAS, it is a policy of Weld County to encourage growth
around and near the existing population centers of Weld County, and
WHEREAS, the commissioners have determined that the annexation
proposed, including Tracts I and II, would encourage the adopted policy
of Weld County, and
WHEREAS, upon investigation, the County Commissioners have
determined that it would be desirable and in the best interests of Weld
County to annex the land proposed, including Tracts I and II, to the
Town of Ault.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the Board be authorized
to sign on behalf of Weld County, Colorado, a petition requesting that
certain land, including Tracts I and II, be annexed to the Town of Ault.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 13th day of March,
A.D, , 1974, nunc pro tunc as of March 6, 1974.

( 1 ) It is desirable and necessary that such territory be
annexed to the Town of Ault.
(2) Not less than 1 /6th of the perimeter of said property is
contiguous with the Town of Ault.
(3) A community of interests exists between the territory
proposed to be annexed and that of the Town of Ault .
(4) The territory proposed to be annexed is urban or will
be urbanized in the near future .
(5 ) The territory proposed to be annexed is integrated or
is capable of being integrated with the Town of Ault .
( 6) The requirements of Sections 139-21 -3 and 139-21 -4
Colorado Revised Statutes Annotated ( 1963 ) , as amended , exist or
have been complied with .

(7 ) The signers of this petition comprised the landowners
of 100 percent ( 100 %) of the above described property exclu-
sive of streets and alleys .
(8) The mailing address of each signer , the legal descrip-
tion of the land owned by each signer , and the date of signing of
each signature are all shown on this petition .
(9) Accompanying this petition is the original and ten ( 10)
prints of an annexation map containing as a part thereof , the
following information :
(a ) A written legal description of the boundaries
proposed to be annexed .
(b) A map showing the boundary of the area proposed
to be annexed .
(c) Within the annexation boundary map is also shown
the location of each ownership tract of unplotted land , if
any , and if part or all of the land is plotted , then the
boundaries and plat numbers of blocks or lots and blocks are
shown .
(d) Next to the boundary of the area proposed to be
annexed is drawn the contiguous boundary of the Town of
Ault .
(e) The dimensions of the contiguous boundaries are .
shown on the map .
( 10) The above described territory is not presently a part
of any incorporated city , city and county, or town .
( 11 ) The owner will comply with all lawful requirements and
conditions of the Town of Ault .
(12) There are no limitations on said annexation as outlined
or stated in Section 139-21 -4 Colorado Revised Statutes Annotated
1963 , or as amended .
( 13 ) Your petitioner desires to have the property proposed
to be annexed zoned R.U.D. - C.U.D. — R1
and asks that the
official zoning district map of the Town of Ault be amended to

denote the change to be made by this annexation and zoning . And
in support of the within request for zoning change , it is submitted
that :
(a ) The requested zoning classification will permit
the property to be utilized for its highest and best use ;
(b) Granting the request will permit a consistent and
proper development of the Town of Ault in the area in which
the property is situated ; and
(c ) The property is not reasonably suitable for any
other zoning classification at the present time .
WHEREFORE said petitioners request that the Town of Ault
approve the annexation of said territory. And said petitioners
