HomeMy WebLinkAbout20190916.tiffHEARING CERTIFICATION DOCKET NO. 2019-28 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0114, FOR MINERAL RESOURCE DEVELOPMENT FACILITIES INCLUDING OIL AND GAS SUPPORT AND SERVICE (INCLUDING FOUR (4) GAS COMPRESSORS, A CONEX CONTAINER OR SMALL BUILDING TO STORE SPARE PARTS AND MATERIAL STORAGE AND A SMALL MOTOR CONTROL CENTER BUILDING AND RELATED EQUIPMENT), UP TO FOUR (4) CONSTRUCTION OFFICE TRAILERS AND SIX (6) CONEX CONTAINERS FOR USE DURING THE CONSTRUCTION OF THE FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - BLACK MOUNTAIN LAND COMPANY, LP, C/O CURETON MIDSTREAM, LLC A public hearing was conducted on March 6, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro -Tern Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle Public Works Engineer representative, Evan Pinkham Health Department representative, Ben Frissell The following business was transacted: • Chair Kirkmeyer explained the Board will only be available to hear land use items until 2:30 p.m., due to other commitments of the Board, and whatever is not completed by then will have to be continued to another day. • I hereby certify that pursuant to a notice dated January 28, 2019, and duly published February 1, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Black Mountain Land Company, LP, do Cureton Midstream, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0114, for Mineral Resource Development Facilities including Oil and Gas Support and Service (including four (4) gas compressors, a conex container or small building to store spare parts and material storage and a small motor control center building and related equipment), up to four (4) construction office trailers and six (6) conex containers for use during the construction of the facility in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. • Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, reviewed the site location, and noted state and local agencies were contacted regarding the application. He indicated there are three (3) surrounding property owners (SPO) and no Gc. He stated, once constructed, the site will be revegetated. He explained the proposed use, noted light will be turned on manually when needed, noise impacts are limited due to the remote location, and the applicant had submitted a noise report for facility. Mr. Ogle stated referrals were sent to nine (9) agencies, and two (2) commented. He entered the favorable recommendation of the Planning Commission into the record as written. • Evan Pinkham, Public Works Engineer representative, provided a brief overview of the transportation plans and requirements, explained the access is on County Road (CR) 386, and there are no traffic counts available for this area. He shared the traffic information submitted by the applicant, stated the Department of Public Works will require tracking control and a Road Maintenance Agreement during construction, and presented the drainage and grading requirements. • Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions and stated bottled water and portable toilets will be used during construction. He indicated a small amount of fuel will be stored on the site, Development Standards (DS) #17-32 address Environmental Health (EH) items, and a light industrial noise standard is being recommended due to the location of the site. • Nick Holland, applicant, explained his outreach to SPOs, included sending letters. He displayed images of the site, including the access on CR 386, showed a depiction of the proposed compressor station, and described surrounding land uses. CI Andrew Truitt, Behrens and Associates Environmental Noise Control, Inc., provided results of the Acoustical Engineering Analysis encompassing an Ambient Sound Study, Noise Modeling Methodology, and a Noise Contour Map, and stated the facility will comply with the DS for the proposed site, based on the results. El Chair Kirkmeyer stated she would like the excerpt of comments from the previous land use hearing, Docket No. 19-29 for USR18-0115, to be incorporated into this case and is as follows: "Mr. Holland provided examples of Cureton Midstream, LLC's, safety standards evidenced in their mechanical design, testing, control systems, and hiring and training process. He discussed compliance with regulatory oversite agencies, and their community involvement." (CLERKS NOTE: To listen to audio of the safety presentation by Mr. Holland, please reference the Hearing Certification for Docket No. 2019-29, USR18-0115.) • No public testimony was offered concerning this matter. e In response to Chair Kirkmeyer, Mr. Holland indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as entered into the record. • Commissioner Moreno moved to approve the request of Black Mountain Land Company, LP, c/o Cureton Midstream, LLC, for a Site Specific Development Plan and Use by Special Review 2019-0916 PL2644 HEARING CERTIFICATION - BLACK MOUNTAIN LAND COMPANY, LP, C/O CURETON MIDSTREAM, LLC (USR18-0114) PAGE 3 Permit, USR18-0114, for Mineral Resource Development Facilities including Oil and Gas Support and Service (including four (4) gas compressors, a conex container or small building to store spare parts and material storage and a small motor control center building and related equipment), up to four (4) construction office trailers and six (6) conex containers for use during the construction of the facility in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously. There being no further discussion, the hearing was completed at 11:37 a.m. This Certification was approved on the 11th day of March, 2019.
