Home My WebLink About730558.tiff . t H/ f' RESOLUTION WHEREAS, a public hearing was held on December 26, 1973, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Fred Gibbs, Route 2, Box 6A, Eaton, Colorado, requesting permission to locate a cattle and sheep feeding operation on the following described property, to-wit: A parcel of land more particularly described as being all that part of the North Half of the North Half (NI-N-1) of Section Four (4), Township Six (6) North, Range Sixty-Three (63) West of the Sixth P. M. , Weld County, Colorado, said tract lying North of the Drury Reservoir Ditch, and, WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner to locate said cattle and sheep feeding operation on the above-described premises, and WHEREAS, the said requested cattle and sheep feeding operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said cattle and sheep feeding operat ion may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners that the application of Fred Gibbs, to locate a cattle and sheep feeding operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to construct said cattle and sheep feeding operation and shall have up to one year from the date hereof to begin construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That when said cattle and sheep feeding operation is completed same shall be limited in pen size as indicated on plans as submitted. 4. Gibbs DISCUSSION : Located just west of Cornish , they propose to enlarge the feedlot by 300 cattle and 10 ,000 lambs . Would like to request at this time an increase of 20 ,000 cattle and 25 ,000 lambs . Drainage goes into a drainage ditch on their own land I and never leaves their property . Reason for asking for the larger increase is that they feel the land has potential to be irrigated under sprinkler systems and would be able to I feed more livestock then what they had originally thought . Have one sprinkler system in and will put in three more . \ Planning staff recommends approval as it agrees with the ` Comprehensive Plan ; agrees with surrounding land use and zoning ; Health Dept . recommends approval and Extension Office anticipates no pollution problems . Mr . Lorenson stated they would be willing to approve the additional 946 r . animals requested , but it would be subject to the review of the Health Dept . again and the facilities would need to be reappraised . Also subject to standard items, which would be limitation of construction to the plans as proposed and con- struction beginning within one year of approval . SUBJECT : 1974 Highway Construction Recommendations Tape 507 & 508 DISCUSSION : Mr . Chotvacs and Mr . Dwight Bower were present to answer any questions the Board may have concerning the recom- mendations . Mr . Lorenson read the Proposed Primary Projects listed . The Board felt that Item #6 (four land U . S . 34 Business Route from 47th Avenue to Junction at Colorado 257 ) should be changed to read 35th Avenue instead of 47th Avenue , as it was felt to be crucial . RESOLUTION : Be it therefore resolved to recommend to the Board of County Commissioners that Item #6 of the Proposed Primary Projects be changed to read 35th Avenue instead of 47th Avenue . Motion by Mr . Anderson , seconded by Mr . Nix . A vote of "Aye" by Watson , Nix , Anderson and Heitman . Motion carried . DISCUSSION : Mr . Lorenson then read the Proposed Secondary Projects ; Proposed Urban Projects ; Urban Arterials ; Topics ; and Addi - tions to State Highway System . Anderson . A vote of "Aye " by Watson , Nix , Anderson and Heitman . Motion carried . SUBJECT : Harvey Weber Tape 508 DISCUSSION : Mr . Lorenson stated that Mr . Weber had a parcel of ground in the southwest part of the county . Mr . Weber was subdividing his land illegally . Planning Commission has taken some action against this by withholding building per- mits . SUBJECT : Building Permits Tape 508 DISCUSSION : Mr . Lorenson introduced the Chief Building Inspector , Mr . Virgil McKee , to discuss the problem of issuing the building permits . It seems to be going too fast and the proper legal description follow up is not getting done , there- by creating some illegal splitting with building permits being issued that should not have been issued . Would like to develop a list to be used as a guide for filling out building permits . The time period of obtaining a building permit was discussed and a three day time period was con- sidered a good length . This would allow the checking of any property in question , and then mail the permit to the applicant . Mr . Lorenson stated that he would like the 947 J authorization to change the building permit procedure to include a reasonable amount of time in which to check it out by a guideline to be set up . Miss Telep requested the list be sent to their office to look over before put into use . The checklist will be used for internal review . MOTION : By Mr . Heitman , To authorize the change in building permit procedures to allow a seven day waiting period before a building permit will be issued ; and all building permits will be mailed . Second by Mr . Anderson . DISCUSSION : On industrial and commercial building permits , there may be a longer waiting period . Restrict motion to resi - dential buildings . VOTE : A vote of "Aye" by Mr . Watson , Nix , Anderson and Heitman . Motion carried . SUBJECT : Greeley Comprehensive Plan Tape 508 DISCUSSION : City would like County ' s concurence on work program. East Greeley area will be studied along with Monfort ' s re- quest . The consulting firm would like a group created of County and City Planning members and maybe a representative from the Ag Council to go over all the alternatives . The Planning staff had planned to provide some manpower , but no provision was made in the budget for actual monies for this study . Mr . Lorenson is scheduled for a meeting with the consultants to discuss monies . It was decided to reschedule the decision until after the meeting . SUBJECT : Park Land Estates Tape 508 DISCUSSION : Mr . Paul stated that the Health Dept . was sill not satisfied with the septic tanks . As it stands now , an engi - neer may have to draw up plans for the septic system( s ) and the Health Dept . will review them . MOTION : By Mr. Anderson , To postpone decision until after the meeting set up with officials of the Town of Erie . Seconded by Mr . Nix . A vote of "Aye" by Watson , Nix and Anderson . Mr . Heitman abstained as he was not present at field check earlier today . SUBJECT : Lochbuie Tape 508 & 509 DISCUSSION : Their plan of augmentation has been approved . Mr . Nix asked for the rereading of the reasons for denial . They are : ( 1 ) State and County Health Depts . have approved the location of the sewage lagoon , but further review will be required . In a letter received from the Health Dept . ( State ) , it says , " . . . They will concur in this project as long as proper central waste treatment facilities are provided for Lochbuie sub- division and for the existing Space City development . Numerous septic tank leach field problems are now being experienced at Space City , and provision for an area waste disposal facility would greatly reduce the inconveniences , hazards and the water pollution problems associated with too many septic tanks . The new Colorado Water Quality Control Act requires for treatment works intended to serve more than 20 people , that site location and construction expansion be approved and designs reviewed by the Water Quality Control Commission . Therefore , a site appli - cation and final plans for construction will have to be sub- mitted to and reviewed by the Commission before construction 948 s • can start . The Act and Federal Law also requires the issuance of a Discharge Permit . Therefore , an application for such a permit should be submitted immediately to the Environmental Protection Agency because there is always a time delay in processing such applications . " ( 2 ) Does not agree with land use policy ; ( 3 ) Town of Hudson opposes it ; (4 ) Two wells have not been reclassified yet ; ( 5 ) Still need letter of commitment from Mountain Bell ; (6 ) Problems with Highway Department and County Public Works Office still not resolved ; (7 ) School District is very much opposed . Counsel stated that since the Comprehensive Plan was now adopted , it would have to be adhered to . RESOLUTION : Be it therefore resolved to recommend denial to the Board of County Commissioners as the State Highway Dept . promises no interchange on I -80 at the south boundary at this time ; there is strong opposition from the citizens in this area ; town of Hudson opposes development ; agreement with Public Service Co . to use 200 ' right of way has not been obtained yet ; the two wells that required reclassification have not been taken care of ; letter of commitment from Mountain Bell has not been obtained yet ; the water is non- adjudicated ; and the school district is opposed . Motion by Mr . Heitman , seconded by Mr . Nix . A vote of "Aye" by Watson , Nix , Anderson and Heitman . Motion carried . DISCUSSION : They do have area designated for open space , but still have to designate the acreage . If their zone change/subdi - vision application is approved by the County Commissioners , their Final Plat would have to comply with all other subdi - vision requirements . Mr . Simpson , Northern Colorado Water Conservancy District , stated they still have to go through courts to change use of wells . (At this time the motion was made and seconded by original resolution movers to amend the resolution to include non-adjudication of water and school district opposition . Evaluation is to determine the feasibility of the area for a cattle feedlot and working area. The soils in this area are deep, well drained with moderately coarse textures on the ridges and moderately fine textures in the lower lying areas.
