There was presented to the Board a petition purporting to contain the signatures of
the majority of the resident land owners within Township 7 , Range 59 , a territory not exceed-
ing 36 square miles , stating their desire to create and form said territory into a Pest
district for protection against prairie dogs and ground squirrels , under the provisions of
Section 3105 to 3116 inclusive , 1921 Compiled Laws of Colorado . Said petition being
verified by H . R . Ashbaugh , one of the signers thereto , On motion said petition was ordered
filed .

OF THE B :TIRD OF DIRECTORS OF
THE DENVER GR :ELEY VALLEY
IRRIGATION DISTRICT .
WHEREAS , S . J . Rhode has filed a petition with the Board of Directors of The Denver-
Gr, :eley Valley Irrigation District by and through his attorney , R . E . Winbourn , verified under
date of march 14 , 1924 , wherein he prays that said Board cancel and annul its certain order of
July 2 , 1918 , whereby said Board purported to include in the District the Northeast Quarter of
the Southwest Quarter ( NE4 SW) of Section 34 , Township 3 North , Range 66 West , 6th P .M. Weld
County , Colorado : and
WHEREAS , the fo-' lowing appears from said petition and the records of the Board of
Directors of said District , namely:
On the 25th day of February , 1919 , one Ben Roberts , being then and there the homestead
entryman of said land above described , entered into a contract with the Board of Directors of
The Denver-Greeley Valley Irrigation District for the purchase of water for the irrigation of
said land until patent therefor should issue , and for the inclusion of said land in said District
after the issuance of said patent ; that notice of the execution of said contract :R. as not published
as required by statute , nor was said contract recorded ; that patent was issued to the said Ben
Roberts for said Land on August 14 , 1913 , which was recorded December 11 , 1923 , in Book 396 ,
page 422 , Weld County Records : that on April 28 , 1917 , the said Ben Roberts conveyed said land
by warranty deed to one J . P .Monson and on W . Monson , which.•deed is recorded in Book 474 , page
580 , :veld County Records ; that on said 28th day of April 1917 , the said J . P . Monson and W . Monson
executed a deed of trust to the Public Trustee of Weld County coveri.n said land to secure their
promisory note for the principal sum of 03000 . 00 payable to the order of Ben Roberts ; that
thereafter , and before the maturity of said note , the same was assigned to the petitioner ,
S . J . Rhode , who at said time had no knowledge , constructive or otherwise , of the inclusion or
attempted inclusion of said land in said District ; that thereafter said trust deed was fore-
closed , and on February 6 , 1922 , said land sold by the Public Trustee of Weld County under said
trust deed , and on November 16 , 1922 , Public Trustee ' s deed issued to the said S . J . Rhode ,
which deed is recorded in Book 176 , page 539 , Weld County Records ; that on the 2nd day of July ,
1918 , the Board of Directors of The Denver-Greeley Valley Irrigation District , without any
other petition for the inclusion of said land having been filed other than the contr'Jct between
the District and Ben Roberts of February 25 , 1909 , entered an order purporting to include said
land in said District ; that at the time said petition of February 25 , 1909 , was acted upon and
said order of inclusion entered , the said Ben Roberts was not the holder or title or evidence __
of title to said land , but the same was then and there owned said J . P. Monson and . L."onson , who _—
filed no petition for or otherwise consented to the inclusion of said land in said
District .
And the Board , being now fully advised in the premises , DOES HEREBY FIND , that said
land was never properly or legally included in said District .
IT IS THEREFORE HEREBY ORDERED , that the order and resolution of to is Board of July
2 , 1918 , purporting to include said land in said District , be , and the same is hereby , can-
celled , annulled and set aside , with the same force and effect as if said resolution purporting
to include said land in said District had never been adopted .
IT IS r URTHER ORDERED , that the Board of County Commissioners of ►eld County , Colo-
rado , instruct the County irea._,urer of ':field. County , Colorado , to cancel all purported taxes ,
both past and future , for The Denver- Greeley Valley Irrigation District purposes , against
said land , and to instruct the County Assessor of Weld County to remove said land from the
assessment for Denver-Greeley Valley Irrigation District purposes is concerned .
IT IS FURTHER ORDERED , that a certified copy of this resolution shall be full authority
to the Board of County Commissioners , the County Treasurer , and the County Assessor of Weld
County for the cancellation of all Irrigation District taxes against the above described land
and the omission of said land from future taxation for Irrigation District purposes , unless
said land shall hereafter be legally included in said District .

1924 , concerning the NE4 SW4 of Sec . 34 , Tp . 3 N . , R . 66 W . of the 6th P . M. , Vield County ,
Colorado , in accordance with certified copy thereof attached hereto and made a part hereof , the
County Treasurer be and he hereby is authorized and instructed to cancel all purported taxes ,
both past and future , for The Denver-Greeley Valley Irrigation District purposes against said
land and the County Assessor be and he hereby is authorized and instructed to remove said land
from the assessment roll of Wield County so far as the assessment for the Denver-Greeley Valley

114 THE MATTER OF RESOLUTION OF
THE BOARD OF DIRECTORS OF THE
DENVER-GREELEY VALLEY IRRIGATION
DISTRICT .
WHEREAS , J . C . Otteson has filed a petition with the Board of Directors of The
Denver-Greeley Valley Irrigation District , sworn to under date of. March 18 , 1924 , wherein
he prays that said Board cancel and annul its certain order of July 2 , 1918 , whereby said
Board purported to include in the District the Southwest Quarter of the Boatheast Quarter
( SW4 NE4) and the Southeast Quarter of the Northwest Quarter ( SE4 NW-141 of Section 22 , Township
3 North , Range 66 rest , 6th P .M. , yield County , Colorado ; and
WHEREAS , the following appears from said petition and from the records of the Board
of Directors of said District , namely :
On February 27 ; 1909 , J . N . Morgan , being then and there the homestead entryman of the
West Half of the Northeast Quarter ( W2 NE4 ) and the East Half of the Northv. est Quarter ( E1 NW-14 )
of Section 22 , Township 3 North , Range 66 aest of the 6th P .M. ; entered into a contract with
the Board of Directors of The Denver-Greeley `,` alley Irrigation District for the purchase of
veater for the irri .Tation of said land until patent therefor should issue , and for the inclusion
of said land in said District after the issuance of said patent ; that notice of execution of
said contract was net published as r : quired by statute ; that the said J . N . Morgan , under the
name of James IT . Morgan , received patent for said land in the petition of J . C . Otteson de-
scribed , on March 13 , 1913 ; that on February 7 , 1916 , the said Morgan executed a deed of trust
covering said land to the Public Trustee of Weld County , Colorado , to secure the payment of
his promissory note for the principal sum of 81000 . 00 to the order of Lauretta Ingram , which
said deed of trust is recorded in Book 415 , page 390 , Weld County R{eciords ; that on or about the
22nd day of June , 1918 , one Nels Benson , to whom said land had been conveyed by said Morgan ,
and who was then and there the owner thereof , subject to said deed of trust , filed a petition
for the inclusion of said land first above described , in The Denver-Greeley Valley Irrigation
District , the fi lin of which and hearing on which were duly published as required by statute ,
and the Board , being satisfied that the said Nels Benson had no knowledge of the contract
between the District and the said Morgan mentioned above , did , on the 2nd day of July , 1918 ,
by resolution duly adopted , cancel said Morgan contract upon condition that the Southwest
Quarter of the Northeast Quarter ( SW NE4) and the Southeast Quarter of the Northwest Quarter
( SE4 NW4) of said Section 22 be included in said District , and this Board did , on said 2nd
day of July , 1918 , pursuant to the petition of said Nels Benson , adopt a resolution purporting
to include said SW4 o ' the NE4 and the SE4 of said Section 22 in said District ; that t; ' s
Board was not advised and did not know that at said time there was an outstandine deed of trust

on said property; that neither the said Trustee in said deed of trust mentioned nor the benefi -
ciary thereof joined in said petition; that it now appears that said deed of trust has been
foreclosed by the Public Trustee of Weld County under date of May 8 , 1923 , and Public Trustee ' s
deed , pursuant to such foreclosure sale issued to said petitioner , J . C . Otteson under date of
February 20 , 1924 .
And it further appearing to this Board that no District water has ever been used on
said land , and th; . t no Irrigation District taxes have ever been paid thereon .
THE BOARD DOES THEREFORE HEREBY FIND that said land , to-wit , the SWI of the NE4 and
the SE4 of the NW4 of Section 22 , Township 3 North , Range 66 West , 6th P .M. , Weld County ,
Colorado , was never properly or legally included in said District .
IT IS THEREFORE HEREBY ORDERED that the order and resolution of this Board of July
2 , 1918 , purporting to include said land in said District , be and the same is hereby cancelled ,
anulled and set aside with the same force and effect as if .paid resolution purporting to
include said land in said District had never been adopted .
IT IS FURTHER ORDERED that the Board of County Commissioners of ;'field County ,
Colorado , instruct the County Treasurer of Weld County , Colorado , to cancel all purported
taxes , both past and future , for The Denver-Greeley Valley Irrigation District purposes ,
against said land , and to instruct the County Assessor of Weld County to remove said land
from the assessment roll of Weld County so far as the assessment for ])enver-Greeley Valley
Irrigation District purposes is concerned .
IT IS FURTHER ORDERED that a certified copy of this resolution shall be full
authority to the Board of County Commissioners , the County Treasurer , and the County Assessor

cancel all purported taxes , both past and future , for The Denver-Greeley Valley Irrigation
District purposes against said land and the County Assessor be and he hereby is authorized and
instructed to remove said land from the assessment roll ,o.f ' eld County so far as the assessment
for The Denver-Greeley Valley Irrigation District purposes is concerned .
FURTHER that a certified copy of this order shall be the authority to said County
i'reasurer and said County Assessor for their actions in this matter .

This matter coming on regularly before the Court this day , upon report of commissioners
heretofore appointed by the Court and herein filed , and the Court finding from s aid, report that
said commissioners have ascertained that it is necessary for the petitioners to havb the right
of way for publics hi hway sought by them herein ; that a description of said right of way with
convenient certainty and accuracy is as follows :
A strip of ground 30 feet in width along the
east side of the Southeast Quarter of Section
19 , and along the east side of the Northeast
Quarter of Section 30 , Township 4 North of
Range 61 West of the 6th 2. M. in Weld County ,
Colorado .
That the value of said strip of land sought to be taken is $45 . 00 .
The damage to the residue of said Southeast Qt.arter of Section 19 and Northeast
Quarter of Section 30 caused by the taking of said 30 foot strip for public highway purposes
is $50 . 00 .
The benefit to the residue of said Southeast Quarter of Section 19 and Northeast

nothing .

STATEMENT
By the Commission
This proceeding arises upon the application of the Union Pacific Railroad Company ,
in compliance with Section 29 of the Public Utilities Act , as amended April 16 , 1917 , for the
closing of a public highway crossing at grade over the branch line of said railrvad between
Brighton and Boulder not located at a point 1867 feet west of Mile Post No . 13 in Section 7 ,
Township 1 North , Range 68 West ; and for the re- establishment of said crossing at a point on
the sectiob line between Section 7 and 8 , Township 1 North , Range 68 West , which point is 1165
geet west of said Mile post No . 13 .
The proposed change was presented to the County Commissioners of Weld County and to
the Railway Engineer fo this 6ommission prior to the filing of the application , and the approval
of the county commissioners was obtained in G letter addressed to the Commission , dated January ,
30 , 1924 . The Railway Engineer for the Commission , Mr . C . D . Vail , concured in the opinion that
the proposed change would improve the conditions regarding this crossing , having made a personal
inspection of the site with Mr . Lowther , Division Engineer of the Union Pacific Railroad Company ,
on August 29 , 1923 .
The proposed change ueing approved and recommended , as set forth above , and no object-
ion having been filed by and other interested px:rties , the Commission will , therefore , issue its
order granting permission for the proposed change as herein set forth .
ORDER
IT IS , THEREFORE , ORDERED , That in accordance with Section 29 of the Public Utilities
Act of the State of Colorado , as amended April 16 , 1917 , the pudic highway crossing at grade
now existing at a point approximately 1867 feet west of Mile Post No . 13 on the Union Pacific
Railroad , Boulder Branch , shall be , and the same is hereby , ordered to be closed ; and a public
hikhray corssing at grade , located at a point approximately 700 feet east of said old crossing
on the section line between Section 7 and 8 , Township 1 North , Range 68 %►est , being at a point
approximately 1165 feet west of said Mile Post No . 13 , shall be opened . Said crossing shall be
constructed in accordance with the plans and specifications prescribed in the Commission ' s
order in re Improvement of Grade Crossings in Colorado , 2 Colo . P. U . C . 128 ; and said new cross-
tmg shall be opened for travel before the crossing now in existence shall be closed to traffic .
IT IS FURTHER ORDERED , That the expense of construction and maintenance of grading the
roadway at said new crossing , including the necessary drainage therefor , shall he borne by `Weld
County ; and that all o ' her expense in the matter of installation and maintenace of said crossing
shall be borne by the petitioner , the Union Pacific Railroad Company .

The Board having carefully considered the report of the viewers herein , as well as
the object ons made thereto , and the 30 ft . strip of land southeast Quarter of Section 19 , Range
61 , belonging to George Stonoff , and the 30 ft . strip of land , northeast Quarter of Section 30 ,
' ownship , 4 , Ran've 61 , belonging to Christina C . Houston , being condemned as per Court order ,
and find ing the report correct as to form , and believing the public good requires the la:,i.ng
out of the road as recommendded by the viewers , it was on motion ordered that the report be
approved and adopted , and the road therein described and recommended by the viewers be and is
hereby declared a public highway . The clerk is directed to record and report , plat the road ,

Whereas Fred W . Steele , County Treasurer has submitted for approval the appointment
of W . C . Loney as Deputy County 'treasurer on compensation as hereinafter set forth ; Resolved
that said appointment is approved and the duties of said Deputy County Treasurer shall be as
follows :
He shall devote himself to collecting moneys and obtaining data for collections
hereinafter set forth through the records of County Treasurer , District , County and Justice
Courts ; He shall collect delinquent personal property taxes whether due in preceding years
or declared by the County Treasurer to be due in the current year , unpaid pauper costs and
maintenance , lunacy costs and maintenance , and criminal costs due the County , and shall make
monthly reports to the County Treasurer and County Commissioners ; and on August 1 and
January 1 hereafter shall make reports as to eighty per cent of the unpaid delinquent personal
property taxes due in preceding years , showing collection thereof , or as to individual
cases the reasons he has not been able to collect same ; he shall make collections of said
taxes without distraint if it seems wise , but by distraint when authorized by the County
Treasurer , and when distraint is made shall collect the expenses of said distraint and ten
per cent additional as provided by statute ; he shall forthwith pay over to the County
Treasurer all sums as received , whether for principal interest , penalties , commissions or
in any manner made part of such collections ; he shall devote himself continuously to the
County ' s business under direction of the County Treasurer until relieved therefrom by the
County Treasurer and County Commissioners ; he shall bear his own automobile , telephone , and
traveling expenses ; he shall not sue or compromise any claims without the approval of the
County Commissioners ; morz`thly upon accountings rendered for the preceding month he shall be
paid upon such collections as are realized , compensation as follows :
Where the claim is 025 . 00 or less he shall receive an amount equal to 20jo of the
sums collected where the claim is more than $25 . 00 and not more than $100 . 00 he shall
receive an amount equal to 15'20 of the amount collected ; where the claim is over $100 . 00
he shall receive an amount equal to 10i of the sum collected .

Comes now the Board of Directors of the above named school district and petitioning
the Honorable Board of County Commissioners of the County of Weld , State of Colorado , respect-
fully represents as follows , to-wit :
That heretofore and prior to the 1st day of November , 1923 , the Board of Directors
of the above named school district duly made a special levy of 11 . 4 mills for the purpose of
raising funds for the maintenance and operation of their district during the ensuing year ,
and 3 . 6 mills for the bond and bond interest purposes , such funds being a necessary and legal
levy on the estimated valuation of the district to raise the funds required by the budget of
such district . That the budget of said district , as certified by the Secretary thereof , was
as follows :
To pay outstanding warrants *3 , 312 . 00
Total teachers ' salaries 8 , 040 . 00
Other salaries 4 , 200 . 00
Repairs on buildings 500 . 00
General expense 6 , 150 . 00
Estimated expenditures 22 , 202 . 00

. That the Treasurer of Morgan County , Colorado , advised that it would require a levy
of 3 . 6 mills on the estimated valuation of the district to care for the bond , principal and
bond interest mataring during the year 1924 .
That the total mill levy required to be made upon the estimated valuation of said
school district to raise the necessary amount as shown by the budget of said district , is
15 mills divided as above shown .

That it has developed that the valuation of the taxable property with that portion
of said school district lying within the County of �yeld , state aforesaid , is greater than
the valuation as estimated by the Board .
That said budget and levy was duly certified to the County Superintendent of Morgan
County , Colorado , and in turn by her certified to the Board of County Commissioners of said
county and state , and that a levy of 15 mills as certified was made by said Board on the
property in said school district in Morgan County for special bond purposes . That said levy
was duly extended by the Assessor of Morgan County , Colorado , and the taxes are now being
paid upon that portion of the taxable property of said school district in Morgan County upon
basis of said mill levy .
That through mistake , oversight and inadvertence , no levy was made in the County of
. eld , State aforesaid , for special or bond purposes for said school district , except 3 mills
for bond and bond interest ; that in the event no further levy is made said school district will
have a deficiency in its Special Fund of approximately .S3759 . 00 .
That it appears that unless the County of eld makes an additional levy before
ovember , 1924 , so that the taxable property of that portion of said school district in Weld
County is subject to a total levy equal to that in Morgan County , to-wit : 15 mills ; that
said additional amount due from the taxable property in Weld County cannot be obtained .
That your petitioner feeling that it is only fair that the property of the entire
district pay its proportionate share of the expense of said district , and being convinced
that the residents and officials of ,� eld County share that belief and are desirous of doing
everything that is proper toward the relief of the present situation , and your petitioner
having fully considered the situation:
N(M , THEREFORE , your petitioner respectfully prays the Honorable Board of County
Commissioners of Weld County , Colorado , that you forthwith make an additional levy of 12
mills to be levied on all the taxable property located in the above named school district ,
said levy to b . divided as follows : . 6 of a mill for bond and bond interest purposes ,
and 11 . 4 mills for special purposes as set forth in the above budget of said district .

Commissioner D . C . Straight moved the adoption of the following resolution , which
II motion was duly seconded and on vote was unanimously carried .
WHEREAS , at a meeting of this Board on January 1924 , the Board of Directors of joint
school district No . 12/y-42 Morgan and Weld Counties appeared before this Board in person and
asked that the tax levy hereinafter set forthe be ordered and therefrom it became evident that
an oversight and misunderstanding had occured whereby there had been a failure of formal
earlier certification of the amount of money to b ; raised and the levy to be ordered against
the property of said school district in Weld County , so that only a levy of 3 mills had been
ordered extended on the assessment rolls against said property .
And whereas , at said time the County Assessor had not yet completed the extension
of the assessment of the rolls , nor delivered his tax warrant to the County Treasurer , and
the County Commissioners at that date resolved that a total tax levy should be ordered
against that district of 15 . mills divided as follows : 11 . 4 mills for special purposes and
3 . 6 mills for bond and bnd interest purposes , but by oversight such order was not entered
upon the records in the proceedings of the Board , and it thereby was hot understood by the
County Assessor such levy was finally ordered to be extended upon the rolls ; and only 3
mills for special purposes was extended , and whereas , the Board of Directors of said district
have now in writing certified their budget for 1924 and have certified an additional levy of
12 mills is necessary to be levied on the property located in the above named district , to
be divided as follows : . 6 of a mill for bond and bond interest purposes and 11 . 4 mills for
special purposes ;
AND WHEREAS , the County Superintendent of Schools of Weld County , on Lay 27 , 1924 ,
has filed with this Bo rd his certificate and certification of said Board of Directors of
said school district , and has likewise certified such levy to be made in order that said school
district may have. enough funds to meet its budget for special fund of the present school
year and to pay its bond and interest maturing in 1924 .

Whereas the Board of County Commissioners being of the opinion that the public good
did not require that the voting precinct heretofore known as Voting Precinct No . 19 the
boundry lines thereof being fully described . Therefore it was on motion ordered that said
Precinct No . 19 be and the same is hereby discontinued and it is hereby further ordered that
same is hereby added to and made a part of Precinct No . 4 .

There was presented to the Board a petition signed by numerous residents of voting
precinct # 27 asking that precinct be formed as a justice precinct . And the Board having
considered said petition and being of the opinion that it is for the best interests of the
Public that such a justice precinct be formed , on motion it was unanimously ordered that a
justice precinct be known as justice precinct # 58 be and hereby is formed and created com-
posed of a territory now included in voting precinct 27 , said territory having heretofore
been included in justice precinct 27 . 3 '

There was presented to the Board a petition signed by numberous resi d :nts of voting
Precinct # 4 asking that A . T . Ling be appointed as Justice of the Peace , and the Board

appointed as Justice of the Peace for said Precinct # 44 if he qualifies as provided by law
and file his Bond in the penal sum of $1000 . 00 with surety to be approved by the Board .

Range 63 West of the 6th P. M. Weld County , Colorado , upon receipt of $322 . 60 , together v:ith
his fees for making such assignment .

RESOLUTION TO CANCEL TAX
SALE CERTIFICATES ON RE-
VERTED STATE LANDS .
WHEREAS , the State Board of Land Commissioners has notified the County Treasurer
that certificates of purchase on the hereinafter described lands belonging to the State of
Colorado have been cancelled .
AND WHEREAS , the laws require that in case any state lands are reverted to the
State of Colorado , the Register of the State Board of Land Commissioners shall notify the
County Treasurer , and it shall be the duty of the County Treasurer to at once rebate all
taxes th°; t have been charged against the lands so reverted .
AND WHEREAS , the hereinafter described lands were sold at delinquent tax sale , and
for lack of other bidders , were strucy, off to Weld County , and by said reversion the tax sale
certificates thereon have become of no value and should : be cancelled .
THEREFORE , BE IT RESOLVED , The County Treasurer is directed to cancel tax sale

was an illegal sale , and under C . L . 1921 , 7444 it is the duty of the County to cancel same .

CERTIFIED COPY OF RESOLUTION OF THE BOARD
OF DIRECTORS OF THE DENVER-GREELEY VALLEY
IRRIGATION DISTRICT ADOPTED APRIL 2 , 1924 .
WHEREAS , action has heretofore been taken for the inclusion in The Denver-Greeley
Valley Irrigation District of the land hereinafter described ; and
WHEREAS , Chicago Title and Trust Company as Trustee , being the owner of the land
hereinafter described , has filed with the Board of Directors of said District its written
petition verified as pleadings are required to be verified , praying that said land be ex-
cluded from said District and relieved from assessment for Irrigation District purposes
by order of the Board of Directors of said District , and stating the ground or grounds upon
w/ ich such relief is asked , and showing that the said land has never been cultivated or
irrigated and is incapable of cultivation by irrigation from the irrigation system of said
District , and stating that said land from natural causes cannot be irrigated or is incapable
of cultivation ; and
WHEREAS , the secretary of said Board has caused notice of the filing of said
petition to be given and published once each week for at least three successive weeks in
the Greeley Tribune and Weld County Republican , a newspaper published in the County of Weld ,
and state of Colorado , which county is the same county in which the office of said Board is
situate , and also in the Brighton Blade , a newspaper published in the County of Adams , State
of Colorado , in which county some of the lands inch-_usded in said District are situate , and
which notice directed all persons interested to appear before said Board on the 1st day of
April , 1924 , at the office of the Board in Hudson , Colorado , to show cause , if any they had ,
why said petitichl shoudl not be granted : and
11 WHEREAS , the time so fixed for the hearing of said petition was on a regular
meeting day of said Board next after the expiration of the time of publication of said
notice , to-wit , the 1st day of April , A . D . 1924 ; and
WHEREAS , said meeting of April 1 , 1924 , was by action of said Board duly adjourned
to this the 2nd day of April , A . D . 1924 ; and
WHEREAS , said petition has been duly heard at said time and place last mentioned
and evidence introduced in support thereof ; and
WHEREAS , no protest in writing or otherwise has been filed against the grail ting of
said petition:
NOW , THEREFORE , BE IT RESOLVED , that the said Board hereby finds and declares that
the alleations made in said petition are true and correct , and that the land described in
said petition from natural causes cannot be irrigation or is incapable of cultivation; that
said land has never been cultivated or irrigated and is incapable of cultivation by irrigation
from the irrigation system from which said District obtains its supply of water ; and that
said petitioner did not participate in the organization of said District ; and
BE IT FURTHER RESOLVED , that for reasons stated in said petition and in this reso-
lution , said land hereinafter described in this resolution be , and the same is hereby , re-
lieved from all assessments now existing which have been made against the same for the pur-
poses of said District , and from all assessments which may be made against the same for the
purposes of said District , and excluded from said District ; that the said land covered by
this resolution , so excluded from said District and relieved from said District assessments ,
is described as follows : The west half of the west half of the northwest quarter (W2 W- NW4)
of Section 15 , Township 2 North , Range 65 West , 6th P .M. , ;veld County , Colorado : and
BE IT FURTHER RESOLVED , that before this order shall go into effect the owner of
said land shall pay to the County Treasurer of said Weld County all taxes other than taxes for
Irrigation District purposes , levied or assessed thereon , together with such interest , penalties
and fees as are or may be by law properly chargeable thereon ; and
BE IT FURTHER RESOLVED , that a copy of this resolution , certified by the president
and secretary of this Board , be delivered to the County Assessor of Weld County , and that
said Assessor be , and he is hereby , directed to omit said land from any assessment which may
be or has been made by him for the purposes of said District ; that the Board of County
Commissioners of 'Eield County be , and it is hereby requested to direct the Treasurer of said
County to cancel all existing taxes which have been heretofore levied against said land for
the purposes of this District , and to cancel and redeem all existing tax sales against said
land for Irrigation District purposes .

IN THE MATTER OF PENALTY
ON PERSONAL PROPERTY.
During the summer of 1919 your petitioner sold the personal property which was assessed
to him for that year to C .V . Owens under the contract whereby Owens assumed and agreed to pay the
taxes thereon for 1919 due in 1920 . The taxes assessed against your petitioner on personal
property for the year 1919 amounted to $543 . 05 , which taxes fell due in the year 1920 .
Your petitioner assumed that the taxes were paid by Owens when due , Your petitioner
received no notice that said taxes were not paid until approximately one month ago , when he was
notified that his personal taes for the year 1919 due in 1920 in the sum of $543 . 05 had not
been paid . The principal portion of said personal taxes consisted of cattle on the ranch of
petitioner located near Roggen , which he sold to Owens in the summer of 1919 . The cattle
remained there subject only to ordinary shipments to market until 1922 when they were sold under
mortgage and your petitioner re-purchased a portion of the cattle . Prior to such mortgage
sale the mortgagee paid all taxes due thereon as your petitioner was informed and believer ,
but through oversight in the Treasurer ' s office the taxes for 1919 were not paid .
Your petitioner respectfully represents that under the circumstances it would be
equitable and just to allow him to pay said taxes in the amount of $543 .05 with interest thereon
at the rate of 6 % per annum compounded instead of the statutory rate on defaulting taxes .
Your petitioner has not paid said taxes . Wherefore , your petitioner prays that the
interest on said taxes be reduced to 6% per annum and compounded to date of payment .

Township and Range .
The Board having carefully considered the report of the viewers herein , as well as
the objections made thereto , and finding the report correct as to form and believing the
public good requires the laying out of part of the road as recommended by the viewers , it was
on motion ordered that the report be approved and adopted and the road beginning at the
southwest corner of section twenty six in Township seven north of range fifty six , west of the
6th P . M. thence east on said section line two miles to the southeast corner of section twenty
five in said Township and Range . The clerk is directed to record and report , plat the road ,
draw warrants in favor of parties for damages awarded , and cause notices to be posted of
opening of said road , and notify the Road Overseer of proper District to open the same to
traven in sixty days as required by law .

R E S O L U T I O N .
WHEREAS , there is due , delinquent and owing from CHARLES L . ROBERTS to the County of
Weld , principal taxes on personal property for the years 1918 , 1919 , 1921 and 1922 , in the sum
of Six Hundred Seventy five and 98/100 Dollars ( $675 . 98 ) , with lawful interest and penalties
due thereon , which sum the , said Charles L . Roberts is wholly unable to pay ; and ,
WNEREAS , E . T . Larson and E . T . Larson , as Executor of the Estate of Eric Larson ,
Deceased , hold a chattel mortgage on all of the property , subject to said tax , which said
chattel mortgage appears of record in Book 723 at page 80 of the County Records of Weld County ,
Colorado , and are willing that certain of the personal property so taxes and held under said
chattel mortgage he sold for the purpose of realizing sufficient funds with which to pay said
delinquent taxes , if a settlement the lien upon said personal property can be made upon a basis
of the payment of the principal of said taxes plus six per cent interest for the said years
1918 , 1919 , 1921 and 1922 ; and ,
WHEREAS , the Board of County Commissioners of the County of Weld , sitting as a
Board of Equalization or Review of said matters are of the opinion that it is to the best
interest of said County to release the tax lien ui)on all of said personal property described
in said chattel mortga::e , upon the basis of the payment of said principal sum , with interest
at six per cent and that proper receipts be issued therefor;
NOW THEREFORE , BE IT RESOLVED that the proposition of the said Charles L . Roberts ,
taxpayer , E . T . Larson , and E . T . Larson , Executor of the Estate of Eric Larson , Deceased ,
mortgagees , to pay in full satisfaction and discharge of the tax lien upon all the property
described in said chattel mortgage , by reason of the taxes assessed against the said Charles
L . Roberts for the years 1918 , 1919 , 1921 , and 1922 , amount th the sum of Eight Hundred Thirty-
one and 69/100 Dollars ( $831 . 69 ) , which said sum was paid to the County of Weld , on or about
the 15th day of Oecember , A . D . 1923 , be accepted and the same is hereby accepted in full
settlement of all tax liens of said property for said years , and that the tax lien held by the
County against said property , and the whole thereof , by virtue of the payment aforesaid for
taxes for the years 1918 , 1919 , 1921 and 1922 , be , and the same is hereby forever and fully
discharged ; and ,
BE IT FURTHER RESOLVED that the County Treasurer be instructed to issue proper re-
ceipts for the settlement of the liens of said taxes for said years but not in discharge of
such taxes in full , all in accordance with this resolution .
Upon vote being taken , the foregoing resolution was unanimously adopted .

WHEREAS , many persons interested as land owners , creditors , bond holders and
reorganizing co :.:r.:itte of The Greeley Poudre Irrigation District have appeared before the Board
of County Commissioners this day regarding the action hereby taken , among them: J.E. Shafer
a member of the Board of said District , Honorable Dolph E . Carpenter Attorney for the District ,
R. E . Winbourn representing Bond holders of the district , Walter E. Bliss , representing
creditors and lien holders of the district , G . F . Smith , Secretary , H. D . Parker President
of the reorganizing committe and of the Greeley Poudre Bond holders committe , Homer F . Bedford
County Assessor , Jesse Patterson representing the County Treasurer .
AND WHEREAS , it appears that practically the entire lands of said district have been
sold for taxes beginning with those of the year 1920 and there have been no bidders therefore ,
and practically no redemptions thereof , and the County has realized almose no money therefrom ,
and large sums are uncollected on account thereof , and the same have had to be struck off to
the County and to the district and it is evident that though financial difficulties and
uncompleted works present unpaid taxes are unlikely for many years to be collectable , and
said irrigation system is unlikely to be completed unless by co -operation of the County and
all those interested said enterprise be rehabilitated .
AND WHEREAS , it is to the interest of the County that some concession be made in
realizing collection upon said taxes so as to accomplish a greater assessed valuation of said
lands and some revenue from tax certificates it holds .
Be it resolved that to furnish a basis of co-operation and reorginization , The Board
of County Commissioners now give such persons assurance that it is disposed to extend to actual
land owners in said district the opportunity to purchase the interest of the County in tax
sale certificates on said lands at a reasonably early date , and until th , furth ::r order of this
Boar , at the amount of the original tax as it was certified by The County Assessor to the
County Treasurer .
BE IT FURTHER RESOLVED , that as to such tax sale certificates where land has been
sold in one subdivision or subdivisions and redemption is sought to be made of a lesser
acreage than that included in the tax sale in question , and without insisting that the entire
tract be , redeemed at the one transaction.
Motion duly seconded and 011 vote unanimously carried .

Commissioner Straight moved the adoption of the following resolution :
RESOLVED ; That the Board of County Commissioners of Weld County , Colorado ,
is of the opinion that the 1924 assessment of the properties of the Union Pacific Rail-
road C mpany , Chicago , Burlington & Quincy Railroad Company , the Mountain States Telephone
and Telegraph Company , as made by the Colorado Tax Commission are erroneous , because too
low , inadequate and insufficient , and that the descrepancy as to the standing and the
basis of valuation thereof is such as to materially effect the uniformity in taxation
required by the Constitution of the State , and that a complaint agatsnt said assessment
be forwarded to the Colorado Tax CommiJsion , as to said assessment and as a petition that
said assessment be corrected by increasing same , so as to place them on equality with all
other properties assessed .

Gentlemen :
Your petitioners , John Clay & Company , respectfully show that under Schedule
number Add 38 for 1923 , the Treasurer of Veld County purported to make an assessment against
your Petitioners for thee hundred seventy- five ( 375 ) range cattle ( for five months ) and three
hundred forty ( 340 ) calves ( for four months ) of a total valuation fo Forty- four hundred sixty
Dollars ( $4460 . 00 ) and upon which there has been a so-called tax charged against your petitioners
of Seventy-nine and 12/100 Dollars ( 79 . 12 ) .
Your Petitioners show that they did not own or have the possession of said cattle
referred to in .Veld County during said period , or at all , and said assessment and tax are wholly,
erroneous and without authority .
Your Petitioners further show that they are informed and verily believe and so state ,
that the cattle attempted to be assessed against your Petitioners for said year , were cows and
calves belonging to and in the possession of Albert F . Linger as Administrator of the Estate
of George . Linger , Deceased ; that said estate has a ranch and cattle herd located in Alamosa ,
County , Colorado , and that the cattle attempted to be assessed in ' Weld County were situate in
Alamosa County , Colorado , during all that portion of the year 1923 and untillJune 1st , 1923 and
were assessed and taxed by the duly constituted authorities of Alamosa County , Colorado ; that
about June 1923 the cattle referred to were shipped from Alamosa County , Colorado , with billings
to the Missouri river , but with the privilege of feeding in transit and were taken into Weld
County in June '_ Dr the forepart of July for feeding , and remained there until about the 15th
day of November 1923 , when they were shipped out by the Administrator .
Prior to the time of shipping the cattle from ', e id County , the County Treasurer
claimed a right to assess the same and threatened to distrain the cattle fcr tax , whereupon Mr .
Linger , through his Attorney , on to -wit : November 13th , 1923 wrote to the County Treasurer
stating all of the facts as to the ownership and movement of the cattle referred to , pointing
out that the attempted assessment was illegal . Whereupon the Treasurer permitted the cattle
to be shipped out .

We assume that this assessment was attempted under Section 7461 , Compiled Laws of
1921 , the same being Section 5763 , Revised Statutes of 1906 , as amended by the laws of 1911 ,
page 553 , Section 1 .
Your attention is called to the fact that the Supreme 6ourt of this State has held
the statute referred to unconstitutional and void and that no assessment can be made there-
under , all of which was fully explained in Mr . Linger ' s letter to the County Treasurer of
November 1 .- , 1923 , and the following cases in the Supreme Court were referred to , wiz :
Carbon County Sheep & Cattle Co . v Routt Co . 60 Colo . 224 ;
County Commissioners V Wilson , 15 Colo . 90 ;
Hutchinson V . Herrick 70 Colo . 534 ;
The last case referred to is under the syme statute and the facts very similar to those in
this case .
We enclose herewith the affidavit of Mr . Albert F . Linger showing the location of
the cattle at the various times referred to .
Said assessment is erroneous as agattst your Petitioners because the cattle did not
belong to Petitioners , nor did Petitioners have any possession thereof , nor were theyacting
as the Agents fo the owner ; aloe because the cattle were not assessable for said year in
Weld County .
Your petitioners therefore ask that said assessment be cancelled .

ALBERT F . LINGER being first duly sworn upon his oath states :
That during the months of July , August , September and October and a portion of the
month of November , he , as Administrator of the Estate of George W . Linger , deceased , was in
possession of and had removed to and was grazing in Weld County , Colorado , approximately
three hundred sevent -five ( 3750 cows and approximately three hundred forty ( 340 ) calves
following the cows .
That John Clay & Company did not have possession of the cattle and had nothing to
do with them except that Clay and Company held a mortga -e upon the cattle .
- The ranch of the Estate operated by this Administrator is located in Alamosa , County
Colorado , and the cattle in question were in Alamosa County , Colorado , during the months of
January , February , March , April , May and a pcbrtion of June 1923 and for such year were assessed
in Alamosa county for taxation , and affiant as such Administrator paid the taxes thereon in
said county ; that about June 1923 affiant shipped the cattle from Alamosa County , Colorado ,
billed to the Missouri river , with the privilege of feeding in transit , and about the latter
part o June or first of July of said year , rented pasture for teem and grazed them in Weld
County until about the 15th day f November 1923 , when your affi _nt shipped said cattle out
of Weld County .
Affiant further states that before the cattle were shipped out and in November , the
County Treasurer , F . W. Steele purported to make an assessment upon the cattle and threatened
to distrain them for the same tax referrred to in the petition of John Clay & company , and
affiant then through his Attorney made a full statement of the matter by letter of November
13 , 192 to said F . W . Steele , County Treasurer , showing that said assessment was wrroneous
and illegal , and said County Treasurer then permitted the cattle to be shipped from Weld
Cunty , and did not attempted to distrain same .
Affiant further shows that John Clay & company had no possession ro right of
possession to cattle , nor did they stand in any position where the cattle could be assed1ed
to them in any event .
Wherefore affiant asks that the assessment be dancelled .

$79 . 07 to Ivers Investment Company , and certificate No . 1151 issued thereon and no taxes
was due thereon at the time .

corpon . tion of the State of New Jersey authorized to do business in the State of Colorado ,
and owns and operates a certain beet sugar factory and plant at or near the cities of Greeley ,
Eaton and ;rindsor , in the County of Weld , and State of Colorado , and is engaged at said
factories and at other factories owned by it in the manufacture , extracting , refining and
purifying of beet su,gar .
1 . That on or before the 20th day of Ilay 1924 , your petitioner filed with the
Assessor of said County its tax schedule for the -ear 1924 , describing the aforesaid beet
sugar factory and plant and stating the full cash value thereof , to-wit , the sum of 0800 , 000 . 00 .
each. That thereafter said Assessor , without the consent of your petitioner , arbitrarily
raised the valuation and assessment of said beet sugar factory and plant and assessed the same
at $1 , 280 , 000 . 00 each , as will more fully appear from the records of the office of said
Assessor , to which reference is hereby made .
Your petitioner states that the said increased assessment and valuation of said
factory and plant for the year 1924 so made by said Assessor , is not in uniformity with ,
and is out of proportion to the assessments upon other property in said County and elsewhere
in said State of Colorado , and is in excess of and not in uniformity with assessments upon
like property owned by other tax payers in said State , and is in excess , of the true cash
value thereof , and places a larger burden of taxation upon your petitione:r ' s aforesaid pro -
perty than is relatively placed upon any other kind of property ass ssed for the purposes
of taxation in said County and State ; and said increased as essment is discriminatory ,
excessive , unjust and contrary to law .
WHER FO ;E , the Great Western Sugar Company hereby protests the aforesaid increase
of ° 480 , 000 . 00 each in the assessment and valuation by said Assessor of your petitioner ' s
said factory and pl.._nt as Greeley , Eaton and Windsor , Colorado , and respectfully asks that
said factory and plant at Greeley , Eaton and Windsor , Colorado , and respectfully asks that
said increased assessment and valuation thereon be set aside and vacated , and that the tax
schedule , with the valuations as therein stated and returned by your Ceti tioner , be accepted
and reinstated , and that said factory and plant be assessed and valued for the purposes of
taxation , as in said tax schedule returned and stated by your petitioner , and not otherwise .
2 . Your petitioner further states that on or before May 20th , 1924 , year petitioner
made and delivered to the Assessor of said County , upon blanks furnished it by said Assessor
for such p:zrpose , a full and correct schedule and description of all the personal property
o f said Comoany subject to assessment in said County for the year 1924 , and stating the
true value thereof for the purposes of taxation all in full accordance with the statutes of
the State of Colorado in such case made and provided .
That in its said schedule your petitioner returned for taxation for said year 1924
92 , 940 bags of beet sugar manufactured and refined by it at its daid factory at Greeley ,
112 , 870 bags of beet sugar manufactured and refined by it at its said factory at Eaton ,
29 , 148 bags of beet sugar manufactured and refined by it at its said factory at Windsor ,
Colorado , during the twelve months ending with the ;1st day of March 1924 , and in its said
chedlile stated the value thereof to be the sum of $5 . 00 per bag .
That thereafter , without the consent of your petitioner , the assessed valuation
of said number of bags of sugar was arbitrarily raised and the same assessed at the sum of
c6 . 00 per bag by said Assessor .
That the said increased assessment and valuation of said sugar is in excess of the
average amount of money invested in said property and in excess of the average value thereof ,,
is not in uniformity with and is out of proportion to the assessments upon other property in
said County and elsewhere in said State of Colorado for said taxable year 1924 , and places a
larger burden of taxation upon the aforesaid property than is relatively placed upon any other
kind of property ass ssed for purposes of taxation in said County and State for said year ; and
said increased assessment is excessive , unjust , discriminatory and contrary to law and the
statutes of the State of Colorado in such case made and provided .
WHEREFORE , Your petitioner hereby protests the aforesaid increase of said assess-
ments and valuations by said Assessor on the aforesaid number of bags of sugar manufactured
and refined by your petitioner as aforesaid , and respectfully asks that said increased,
assessment and valuation be set aside and vacated , and that the valuation of said number of
bags of sugar as stated and returned by your petitioner in its said tax schedule , be
accented and reinstated , and that said property be assessed and valuaed for the purposes
of taxation as in said tax schedule returned and stated by your petitioner , and not other-

The Board of County Commissioners sitting as a Board of Equalization , had under
consideration on September 2 , and September 3 , the matter of equalization of assessments on
properties in the County , and the protest and petition of The Great Western Sugar Company
for reduction of the 1924 assessments upon its Greeley , Eaton and Windsor factories and
sugar .
At the conclusion the following resolution was duly made and seconded and unanimously
carried . ,
WHEREAS , it appears the value for assessment purposes for 1924 as fixed by the

member Hewitt moved the adoption of the following resolution :
RESOLVED , That the hearing on the matter of the equalization and on the objection
filed by The Rocky Mountain Fuel Company and The Car.'on Securties and Investment Company
be continued to September 5th , 1924 , and that the County Assessor and the representatives
of said companies be advised of said continuance .
