HomeMy WebLinkAbout720333 N RESOLUTION WHEREAS, a public hearing was held on June 12, 1972, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Kenneth L. Andersen and Audrey J. Andersen, 2871 North 107th, Layfayette, Colorado, requesting approval of site for a dog kennel operation on the following described property, to-wit: A tract of land located in the West z of the South- west 4 of Section 2, Township 3 North, Range 68 West of the 6th P. M. , Weld County, Colorado, more particularly described as follows: Beginning at a point on the South line of said Sec. 2, from which the Southwest corner thereof bears S. 89° 45' W. 50. 0 feet, thence N. 89° 45' E. 253, 0 feet along the South line of Sec. 2, thence N. 00° 15' E. 575. 0 feet, thence N. 58° 18' E. 287. 95 feet, thence S. 85° 38' E. 649. 8 feet, thence S. 31° 43' E. 250. 0 feet more or less to the East line of the West z of said Southwest 4 of Sec. 2, thence N. 00° 15' E. 534. 5 feet along said East line, thence S. 89° 46' W. 1281. 76 feet, thence S. 00° 02' W. 994. 2 feet more or less to the true point of beginning, containing 13. 39 acres more or less, and WHEREAS, the petitioners were present, and WHEREAS, there was some opposition to the request of petitioners for the location of a dog kennel operation, and WHEREAS, the said requested location for a dog kennel operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3) of the Zoning Resolution of Weld County, said dog kennel operation may be authorized on the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioners and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Kenneth L. Andersen and Audrey J. Andersen, 2871 North 107th, Layfayette, Colorado, to locate a dog kennel operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That said dog kennel operation shall not contain more than forty (40) dogs at any one time. 3. That petitioners shall proceed with due diligence to effect said dog kennel operation and that they shall have one (1) year from date hereof to complete the construction of any and all facilities therefor, otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. SUBJECT : Letter regarding pollution control A letter from the Weld County Health Department was read asking cooperation by not issuing building permits for new businesses , industries , etc . , which anticipate using any device which does require controls for air pollution , until such time as they have received authority to construct from the Air Pol - lution Control Division . Mr. Paul stated he has received the necessary information and does approve the application . There was discussion regarding the entrance to the property. Mr. Bowles stated his entrance should be on the east/west road and not a road cut on the Keenesburg road . The plot plan was drawn for a previous application at another location . Motion carried . 775 SUBJECT : Minutes DISCUSSION : Mr. Heitman proposed to amend the minutes of the last regular meeting regarding the presentation by Jim Ohi and Gary Eastman on zoning and land use policy criteria to state "there were some objections by several members to the studies being made" : This was an informational item and no action was required and none taken . MOTION : By by Mr. Nix to approve the minutes of the last regular meeting . Second by Mr. Watson . A vote of "Aye" by Bowles , Clark , Heitman , Nix and Watson . Abstain by Rothe . Motion carried . SUBJECT : Contract with Windsor DISCUSSION : Mr. Lorenson stated a contract had been prepared between Weld County and the Town of Windsor for planning services for a 3 month trial at $200. 00 per month . Miss Telep read the con- tract. Contract has been signed by the County Commissioners . Mr. Lorenson explained that eventually there would be contracts with other incorporated towns to pay for their planning services . MOTION : By Mr. Watson to approve the contract. Second by Mr. Nix . They have a water tap from the Little Thompson Co. The nearest residence is 900 ' to the south and they also have dogs . Next nearest residences are 14 to 11/2 mile. Owners have no objections . Soil Conservation Services anticipates no pollution problem. If approved it should be subject to construction within one year of the County Commissioners resolution and a maximum of 40 dogs . A petition has been presented from other property owners objecting to the kennel . Mr. Paul stated the Health Department is giving their approval and will be presented in writing . Mr. Bowles stated the criteria of the board has been a minimum of 2 mile from any other residence for a kennel . MOTION : By Mr. Heitman that the application be taken under advisement. The land is not the best farmland . Acreage contains 9. 5 acres and there will be 8 sites . Water will be from the North Weld Water District. It complies with the Plann4 -- Commission Ler'i Use Policy. Street and water improvements have been made . Explained there is a pos- sibilities of two other independent filings which are adjacent to the subdivision . If sewer system is available at a future date , developers should be encouraged to obtain the service . It should be subject to some type of agreement for share cost of a 6" wa2r main and hydrant at the intersection of State #37 and Sandy Knoll Blvd. extended 600 ' south from County Rd . 54. There is a 6" main through the middle of the subdivision. Housing Unliminted has property adjoining on the east and directly across the road is a mobile home park which is in the city limits . Felt a joint effort could give the three entities the required fire protection . Glen Paul has approved the septic system. Water will be from Central Weld Water District . Mr. Dickerson , Mayor of Kersey-, was present and stated at this time , if annexation occurrea , the sewer system of Kersey would not be adequate. Mr. Paul stated for this reason , the Health Department has recommended septic systems . Mr. Dickerson 777 stated he had no objection to the septic systems . However, there had been a misunderstanding among the town board members and the other four were opposed to them. Mr. Lorenson stated there is a question of drainage , fire protection and sewage that need to be taken into consideration and worked out before the preliminary plat is approved . Mr. Freese stated a drainage report had been filed . Mr. Lorenson stated the developer and the City of Kersey should come to an agreement if city service should come 4bout and work out the agreements in that area after annexation occurs . Mr. Bowles requested a letter fron, the ditch company stating they will aLept tH run-off. Mr. Lorenson stated the fire protection would include the extension of the 6" line and place a fire hydrant on the north-south road out of Kersey which would provide some semblance of fire protection to the mobile home area . Mr. Freese stated he thought the city plans to extend the line in the fall , and could get a letter from the town of Kersey to this effect. MOTION : By Mr. Heitman that the preliminary plat of Sandy Knolls Estates be approved subject to drainage , fire district approval , and approval of the sewage disposal by the Town Board and possibly the inclusion of Housing Unlimited in the plat. Shore and Sullivan had planned to develop 8 lots , however at this time they are requesting two building permits and will plat at a later date. They are pre- senting a dedication of ROW at this time for acceptance. ROW has also been obtained from Harvey Mathias on 38th Avenue between 20th street and property owned by Dr. Shore and Dr. Sullivan . They have also agreed to install all improvements up to the first cul -de-sac. They have signed a subdivision agreement for the improvements . They will install septic systems until such time as they have annexed to the City and sewer is available. All im- provements must meet the City of Greeley' s standards . Mr. Fedrizzi explained he bought the original 120 acres and his intention was to sell 4 parcels , one of which , was sold to Mr. Staley who in turn divided his parcel . There was discussion regarding what constitutes an original parcel . MOTION : By Mr. Watson to give conditional approval for the building permits subject to a legal opinion from the County Attorney. APPLICANT : Guy Akins Jr. CASE NUMBER : Z-197 tape 425 SUBJECT : Zone change A - MH-UD LOCATION : SEi Sec 28 T1 R68 APPEARANCE : Mr. Akins DISCUSSION : Mr. Lorenson stated the planning staff recommends to the Planning Commission that the request for a zone change be denied for the following reasons : a letter from School District Re-1J stating there were no school facilities to take the student load from this project. There is strong objection from the Weld County Health Department . It does not lend itself to the Weld County Comprehensive Plan concept. It is too large and poorly located in regard to Regional housing analysis as presented May 1972 page 32 Sec II Item C. Water is to be obtained from Left-Hand Water Co . which is pressed to serve existing needs . New facilities are con- templated but would require a complete review. It does not fit the Boulder County plan . Lafayette has no comprehensive plan to accomodate such a large development, Potential conflict with ad- jacent land use , namely Ranch Eggs Subdivision . The application is premature in that service for sewer , fire protection , and schools are not available at this time . The letters from the Health Dept . and the school district were read. Petitions from surrounding property owners were read . Mr . Bowles asked Mr. Akins what Left- Hand Water Company had committed at this time . Mr. Akins stated they had committed service , however , the service will not be forthcoming for at least two years and there will be additional pumping stations , storage facilities as well as a new line . This development is geared to a new sewage treatment facility which Lafayette has applied for federal funds for, Mr . Akins presented 768 his plans for the proposed park . Plans have been presented to the Town of Lafayette and the Lafayette Planning Commission and both have given their approval : MOTION : By Mr. Nix that the matter be taken under advisement. DISCUSSION : Mr. Bowles asked if there was anyone in the audience appearing for or against the application . Mrs . Harrison stated four of them were present from the Ranch Eggs Subdivision and they are opposed to the development. She stated the water pressure is not adequate at times . The people in Ranch Eggs moved to that area because they desired country living and this development would change all of that . The City of Greeley has approved the request , it will fill a definite need and requirement for public services . It is on the periphery of Greeley and can be served with sewer and water . It is in accordance with the County plan for growth . If approved it should be subject to : adequate ROW being granted ( 100' on the west side of 35th Avenue) or as required by the City of Greeley. Adequate parking facilities of one space per 2 employees . All ditch lines to be preserved . Limitation of access to 35th Ave . to one entrance and exit point. Mr. Propp presented the proposed plot plan . This building will house the long distance facility , employing approx- imately 40 people . It is being placed at this location because of the micro-wave tower. They can comply with the request regarding the access point on 35th Avenue. It will be a three story building . Because of the water table it will all have to be above ground , approximately 56 ' and about 24 ,000 square feet on each floor. The City of Greeley has approved the zone change . It allows a use in keeping with the County and City plan and the grow- ing character of the surrounding land use , Eliminates some access points on 20th St . , eliminates some poorly planned platting and allows NHPQ to expand their facilities and eliminating temporary trailer offices . 769 If approved iL should be subject to street, improvements , utility improvements including drainage , landscape proposal especially . around the parking lots , final platting , vacation of streets in existing plat and any relocation of utility lines be at the expense of the developer. Mr. Britzman explained the proposed zone changes and the uses in each . The density of the H-UD area not to exceed 12 units per acre . Most of the R area is used as a nursery and will continue to be used that way. Open space will be approximately forty percent. Mr . The wells must be relocated , for which they have permits . Mr. Bowles read the recommendations of the planning staff. If approved it should be subject to : con- ditions set forth in zoning regulations Sec . 6 . 1 Paragraph ( 3) . No junk in and around grounds , prevention of pollution of the river , collection of cement dust and fencing to prevent children in an un- attended area during shut down periods to comply with the regulations . Mr. Downey stated they have applied to the State Air and Water Pol - ution for a permit and they will meet their requirements . Wailes and Ray Rothe DISCUSSION : Mr. Lorenson recommended the application be approved . It will relieve the area immediately north of Greeley from intensive feed-lot operations . Site is well adapted to support th-is use,. Site and use fits the existing land use policy, zoning and the development policy of the Planning Commission . It can be well drained and sufficient water is available . It is in a sparsely settled area . It has been recommended for approval by the Health Department and a letter of approval by the School District has been received. It should be subject to a land swap arrangement with the Highway Department for ROW or the granting of 220 ' of ROW to the north of existing Highway 34 . A green belt 50 ' wide along the south of lot screening of Highway 34 with suitable type of vegetation . Both lagoons should be sealed and the north lagoon being protected from the flood plain, Dr. Flack presented the proposed plans and maps of the area involved . The ground to be used is all optioned at this time . This site has been selected because of the availability of water, railroad , highways etc . There will be 250 pens and approx- imately 140 ,000 head of cattle . An elevator will be constructed . The Home Light & Power Company is desirous of serving the electrical power for the operation . Gas will be furnished by Greeley Gas Co . Engineering has been done by Mountain Bell to service the area . Water will be provided by Central Weld Water District. There will be wells also . A greenbelt will be built in accordance with the plans of the Highway Department. Dr. Flack explained how the reten- tion ponds will be constructed . Philip Schlagel stated he owns a ,Jacent land to the south and if the highway route is changed il1 'rase one portion he farms and some buildings . Wm. Wailes voiced his objections . His farm is approx- imately 1 mile south of the Kuner store . He operates a dairy and stated the odor would affect the milk. Also stated the highway in its present state would not be adequate . Roy Rothe stated he and his brother have a 300 cow dairy and objected to the feedlot oper- ation . Mr . Rothe stated if they plan to drain the lagoon into the ditch , they would have to dig one of their own as the ditch belonged to him. MOTION : BY Mr. Anderson to take the matter under advisement. SUBJECT : Aristocrat Ranchettes DISCUSSION : Mr. Lorenson stated a group of people in this area made an application for community water for a grant. The com- munity which does not have a legal standing in the eyes of the Federal Government . When this application came before the Reg- ional Planning Commission , after being informed of the conditions in the area , recommended denial . It was indicated at a previous meeting the subdivision be rezoned to mobile homes . Mr. Glen reported on meetings with FHA and NHPQ and the people in the area and the feasibility report is favorable and thought there are enough people to get an FHA loan . Marshall Anderson stated there was no one present at the Regional meeting to represent the ap- plication . Mr. Heitman suggested the Planning Commission make a field trip to the area . There was further discussion on rezoning the subdivision and how it could be implemented . Marshall Anderson stated the same situation existed in Wattenburg and the Spanish Colony . Mr . Bowles suggested the people in the area interested in getting the water could form a nucleus to get something done and would police themselves . Mr. Paul will meet with them next week and discuss the problem. SUBJECT : Comprehensive Plan--progress report DISCUSSION: Mr. Lorenson reported Mr. Voorhees doesn ' t think he can get the Comprehensive Plan printed by the end of the month . He is -going to be asked to redo some of the zoning regulations . The Subdivision Regulations were from the model regulations the State Land Use Commission put out in Dec. The dead line to have Subdivision Regulations is Sept. 1 . 1972. It was agreed to have a special meeting to review the regulations on Monday , 6/12/72 at 1 :00 P. M. in the County Commissioners office . SUBJECT : Greeley Urban Renewal Authority DISCUSSION : Mr. Lorenson stated he had made a recommendation for 772 . approval . Copies have been sent to the City Manager, the Mayor, Rev . Mueller , Oblinger & Smith and the State Planning Office. The necessary information was supplied as requested . The area affected was presented on a map . SUBJECT: Zoning and Land Use Policy DISCUSSION : Mr. Lorenson stated the planning staff is making some comparisons with the regulations proposed by Bob Leigh of Allan Voorhees and Associates and some of the concepts of the staff, and have a generalized proposal . Jim Ohi and Gary Eastman pre- sented these proposals . Mr. Ohi stated they had tried to imple- ment the Weld County Planning Commission ' s Land Use Policy into the zoning resolution . The second purpose is to integrate the County Planning with the Town Planning, and help them implement their plans . Thirdly to simplify the Zoning Resolution by util - izing the Special Use Permit procedure . They have reduced the zones to three , the "A" Agriculture zone , the "U" zone (urban zone) and the Conservation - open zone . Mr . Eastman presented the basic criteria for allowing any residential permits . Meeting adjourned . Municipalities partially solve this problem by ordinance for water rationing. We propose to experiment by requesting our customers to adopt a system of irrigation hours, on a voluntary basis as follows: If your house faces the north or east side of the road: irrigate only on even dates--for example: June 2-4-6 etc. If your, house faces the south or west side of the road: irrigate only on odd dates--for example: June 1-3-5 etc. 31st of month--no irrigation Between hours of 9:00 P.M. and 4:00 A.M.--unlimited irrigation We hope that if most customers will cooperate in this plan, service will be greatly improved.
