RESOLUTION
WHEREAS, a public hearing was held on September 22, 1971,
at 2:00 P. M. , in the chambers of the Board of County Commissioners
of Weld County, Colorado, for the purpose of hearing the petition of
Weld County Landfill, Inc. , Box 596, Evans, Colorado, requesting
approval of site for a sanitary landfill, also known as a solid and/or
liquid waste disposal business on the following described property, to
wit:
West Half of the Southwest Quarter (WzSW}) and the
Southeast Quarter of the Southwest Quarter (SE,'—SW,'--)
of Section 32, Township 5 North, Range 66 West of
the 6th P. M. , Weld County, Colorado, and
WHEREAS, the petitioner was present and represented by
Earl Moffat, and
WHEREAS, there was some opposition to the request of petitioner
for the location of a sanitary landfill at said location, and
WHEREAS, the said requested sanitary landfill operation is
located in an agricultural zone as set forth in the Weld County Zoning
Resolution, and
WHEREAS, according to Section 3. 3(2) of the Zoning Resolution
of Weld County, said sanitary landfill operation may be authorized upon
the approval of the Board of County Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of
the petitioner; and studied the recommendations of the Weld County
Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the application of Weld
County Landfill, Inc. to locate a sanitary landfill on the premises indicated
above, be, and it hereby is granted under the conditions following:
1. That any sanitary landfill facility to be installed shall be
approved by the State Health Department.
2. That all applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the Zoning Resolutions
of Weld County, Colorado.

DISCUSSION : Mr . Lorenson stated n ad mac with rile Agricultural
Council They would like to c . ..cuss the make-up of the Planning
Commission , and were told on the approval of the Planning Co -
mission , they could attend a Planning Commission meeting and
discuss their problems . Mr. Anderson suggested a copy of the
proposed 11A" zoning amendment be sent to the members of the
council .
SUBJECT : Comprehensive Plan - progress report
D:SCUSSIO : Mr . Lorenson reported the consultant has begun on the
housing study in both Counties . The Planning Commission has
provided a good bit of information and he is now waiting 'or the
census tapes . Jim Ohl and the two interns will start housing
inspections . Reports will be submitted to each community on
how they are to handle their housing problem. Some meetings viii
be scheduled with F . N.A. They know likely sources for funding o
housing in the smaller communities . An analysis has been made c
all subdivisions , showing the amount of acreage , the number of
parcels , average size etc . This type of information i5 being re
quired by the state Land Use Commission.

Ft . Lupton ' s town board and planning commission stating they
have no objections to the proposed development , it also meets

unable to supply water to this development .

DISCUSSION : Mr. Lorenson stated a drainage report has been submitted
which was to have been evaluated by the County Engineer. App-
lication has been made to the Health Department which has been
approved . The subdivision design meets the requirements of the
"A" zone . Mr . Foster is willing to work out a contract with
North Weld Water District to serve the area . Mr. Lorenson stated
this is counter to our developmental Doi -icy. He would like to
have considered, a moratorium on subdivisions in the County for
90 days , until the "A" zone is completed and adopted and that
the developmental standards for subdivisions be adopted and put
in force . Mr . McRae stated he had a letter from the Lakely
Lateral Company stating they will accept into the Lakely Lateral
the drainage water as they have in the past as long as it comes
in at selected points . Mr . Foster stated through a negotiated
contract with the water company , they will install a storage
tank and booster .
MOTION : By Mr . Anderson to table this matter until Mr. Lorenson can
check on the legality of a moratorium on subdivisions . Second
by Mr. Watson . A vote of "Aye " by Anderson , Watson , Weigand ,
Bowles and Heitman .

lower level . They have indicated that if this is a requirer,edt ,
they will proceed with this plan . The application for approval
of septic tank systems has been approved by Glen Paul . Mr . Ewing
stated the realignment of the road proposed by the developers
would eliminate a traffic problem that now e.:ists . Mr . Lorenson
stated if the preliminary plat is approved , the drainage study
would be made before the final plat is approved . The City of
Greeley has indicated they would not be able to serve this are�.
with water or sewer in the near future .

SUBJECT : Amendment to "A" zone regarding gas inseellations
DISCUSSION : Mr . Ewing presented his p. orosed amendment regarding
installations along the County Right-of-Way. Stated the key
word in the amendment is "producton " . The set-back requirement
would be 300 feet from any R/W and 330 feet from any section lire .
One advantage would be safety . The Highway Dept . stated it would
be an advantage them in in aquiring ng right-of-way . Mr. Ewing
stated they would like to eliminate the loading and unloading of
trucks on the highway . Mr . Robert Houtchens , representing th .
Greeley Gas Company , recommended that the companies supplying gas
should 'ae expressly eliminated . Setting L. e lines back 300 feet
would create quite a hardship. smear ,i ; ices , representing the
Panhandle Western Gas Company , stated they are willing to work
out reasonable regulations . Felt th2 proposed set-back would be
a hardship on the companies , also the land owners . Mr . Bowles
stated no structure , according to the present regulations , is
allowed less than 50 feet from the right-of-way. Asked if the
50 feet set-back would be agreeable . Mr. Bart Giles of Amico
Corporation stated they have been drilling in Weld County durirg

proposed set-backs become a regulation , tray felt there should L
some exceptions , especially where they would interfer with
sprinklers . Mr. Bowles stated he thought some of the metering
stations in the past have been set too close to the road , caul -
traffic problems . Mr. Ray Fouts with the Greeley Gas Company ,
stated they are more concerned with farm taps . They come off Ji

Gentlemen:
It has come to the attention of certain residents of Dos Rios, Inc. , a Subdivision
of Weld County, Colorado, that a Hearing is to be held today before you concerning
the Application of Weld County Land Fill, Ins. , for a Special Use Permit in connection
with the West Half of the Southwest Quarter and the Southeast Quarter of the South-
west Quarter of Section 32, Township 5 North, Range 66 West of the 6th P. M.
Evidently the Application is to obtain permission to use the land above described for
a Sanitary Land Fill.
Dos Rios Subdivision lies adjacent to the above described land, but for reasons
which the residents cannot explain, they were totally unaware of the fact that an
application had been made for the purpose described above and that the Planning
Commission has apparently acted on the Application favorably. To the best of my
knowledge from the information available, no individual resident of Dos Rios has
ever received a Notice of any kind concerning the Application.
I think it is necessary to bring to your attention that under the Official Zoning Re-
solution of Weld County under Section III, Paragraph 3. 3 (2) concerns itself with
land fills and indicates the necessity for a Special Use Permit. Procedural Guide
adopted by the County effective March 15, 1971, provides in Paragraph (1) (g)
the Application must be signed by the Fee Owner. The Fee Owner in this instance
is Dos Rios, Inc. and I am advised that Dos Rios, Inc. has not signed said Application.
It would therefore appear that the Board of County Commissioners is without juris-
diction to consider the Application or to grant it. It is the intention of the residents
to attack the validity of the Permit if it should be granted.
By way of general information, the residents of Dos Rios feel badly imposed upon
in view of the fact that of fairly recent date they have been burdened with the proxi-
mity of Monfort's new feedlot and the Hill 'N Park sewage lagoon. Adoption of the

totally establish the property as a ghetto area.

1. That you refuse any permit .F o:r = landfill dump on the
Southeast Quarter of the Southwest '.quarter (SLY. SW4) of said
Section 32 for the reason that there appears to be no test of
soil conditions on the SE;;u SWy4 of said Section 32; that raid 40
acres is adjacent to a north-south county road; is very close to
the oiled main highway running to Greeley from Milliken and will
depreciate the value of other lands in the neighborhood.
2. That if a permit is granted to open a landfill dump on
the ''lest Half of the Southwest Quarter (1436 SWy4) of said. Section
32, the following conditions he incorporated in the granting of
such petition:
a. That the north-south county road leading to the
dump site he blacktopped prior to the opening of the dump;
b. That the road leading from the county road to the
dump be blacktopped before the opening of the dump;
c. That the operator of the dump erect a screen of
woven wire along the south side and the east side of said
dump area to catch all trash and paper that might blow from
the dump and that said operator be required to clean the
screen at least once monthly. In the event litter and t:,r.ash
from the dump area blows. over onto other lands in. the
vicinity, that the dump operator be required to clean up
said areas re ularty, at; least monthly or oftener.
0 . That; the atreamboha in the draws adjacent to the
dump urea be protected from pollution from dump materials
and that said draws be free of obstructions at all times.
e. That the County Commissioners rerauire a periodic
inspection of the dump premises by a licensed sanitarian,
weekly or oftener;
F. That aid_ application for openin€' of a landfill dump
in the West Half of the Southwest Quarter ed SW%) he re-
stricted to that part of said. West Half of said Southwest
Quarter lying; east of a streambed. which traverses in. a
north-to-$outh direction through the West Half of the
Section - and that

said dump in no way interfere with. the water from the stream-
bed entering into or leaving; an irrigation reservoir located.

We--the undersigned, wish to take this method to let the Board of County
Commissioners of Weld County know how we feel about the placing of a land-
fill dump on the following described area:
West Half of the Southwest Quarter (W4 of Sw :`:), Southeast
Quarter of the Southwest Quarter (SEI of the SW ) on
Section Thirty-two (32), Township Five (5) North, Range
Sixty-si:. (66)-West of the Sixth P.M. ,Weld County,Colorado.
Whz that particular site was picked for a dump----none of us can figure out
unless it happened to be a financial "bargain" for the buyers It is
an upland area--not conducive to dumping anything: One only has to go out
to the area--and view it--to visualize what it would be like with a. dumping
situation.- - So much for the aesthetic point of view.
As for the feasibility of future drainage in that area---we think it could
create not,:;ing but problems: There is a good natural flow situation for all
needs concerned. Why interfere and cause problems?:?
We feel that if there was even one good reason for having a 'land-fill' there
- - we would be willing to consider the same--but we certainly cannot. see it.
We are 100% against this idea.

Dear Mr. Paul,
I made a personal on site investigation of the new proposed sanitary
landfill, located in the West half of the Southwest Quarter (W-2 of SW-1) and
the Southeast Quarter of the Southwest Quarter (SE1- of SW-) of Section Thirty
two (32), Township Five (5) N, Range Sixty Six (66) West of the Sixth Principle
Meridian, Weld County Colorado.
After checking the local Soil Office's soil survey, I found it inadequate
in so much as their borings were only based on forth (40) inch depth and reveal
only that the top soil, if properly stock piled, could be replaced on the
finished landfill.
I then made contact with a former well driller that had drilled several
test holes on this property some years back. I am enclosing the log from the
various test holes that he still had. It is my opinion that this site could
be worked to a great depth with the type of equipment that is now available.
This site is very comparable in formation to the Windsor site, except
there is much more top soil on the new proposed site.
I therefore would reccommend this site for a sanitary landfill as being
satisfactory.

City Council of Greeley, Colorado
Attached to this cover letter is a petition opposing the
selection of the "Gold" property, as it has been called,
located between 16th and 18th Streets and east of Lynn
Grove cemetery as a site for a city dump. By our signatures
we register our opposition to this site for the following
reasons :
1. Many of the homes in this area use well water for
household purposes and it is impossible to guarantee ;
that these waters will not be spoiled by the natural
discharge arising from a dump.
2. The site cannot' be a suitable one for a dump because
of the poor drainage of natural waters already
present on the property. Morevoer, it is clear
that the needs of the City of Greeley could not be
met by an area of thid size.
3. The property proposed for the dumping of trash
actually borders the property owned by more than
fifteen residents in the region and it is clear that
the dump would be a constant and unsightly presence
in their environment.
4. The residents in the areaprize the unspoiled,
country styled living which the region affords them
and they fear the encroachment of noxious waste
matter onto and adjacent to their hosesites which
has been demonstrated to be a natural consequence
of the traffic associated with a dump no matter
how strictly controlled.
Let it be made clear that the residents of this area, by
their signatures herein, indicate that they will vigorously
oppose any imposed change in our environment which would
detract from its present trend of development toward a region l
of simple beauty and charm.

A meeting was called by the Board of County Commissioners on
Friday, October 1, 1971. All members of the Board were present. The
following is taken from the tape recording taken during the meeting.
Mr. Anderson: We are now sitting as a Board of County Commissioners
on the decision of hearing we held approximately a week ago on Weld
County Landfill Incorporated
Docket Number 54
Date: September 22, 1971
Time: 2:00 P. M.
Request: Site Approval for A Sanitary Landfill
Location: West-Half of the Southwest Quarter
(WkSWk) and the Southeast Quarter of the
Southwest Quarter (SE4SW*) of Section 32,
Township 5 North, Range 66 West of the 6th
P. M., Weld County, Colorado
for the granting of a Land Use Permit for a sanitary landfill. Mrs.
Adams you can fill in the legal description on the record. At this
time I think it is in order to make a decision on the granting of this
Land Use Permit for Landfill Incorporated. At this time gentlemen what
is your pleasure?
Mr. Ashley: Gentlemen, I move that we approve it.
Mr. Anderson: Do I hear a second?

Mr. Billings: Since I am1thoroughly convinced that this is possibly
the best location I still have mixed emotions about what decision I should
make - I will have to vote no.
Mr. Anderson: The chair will vote yes on this decision. Let the
record reflect that the vote is 2 to 1 for the operation of the Land
Fill on the described property as shown on the application.
