Gas II, LLC ("Bison") is proposing to drill (8) eight horizontal wells to the Niobrara Formation (the "Wells") pursuant to Colorado Oil and Gas Conservation Commission ("COGCC") Order No. 535-893, as amended by Order No. 535-1202, which created a 960 -acre drilling and spacing for Township 8 North, Range 60 West, Section 22: All and Section 23: W2, 6th P.M. in Weld County, Colorado (the "Hale Unit"). The Orders allow for the Wells to be drilled no closer than 300 feet from the unit boundaries. Bison wishes to extend the length of the Wells up to 150 feet from the eastern unit boundary to prevent waste and allow for more efficient and economic development of the reservoir. In order to do so, Bison plans to request from the Director of the COGCC an exception pursuant to Rule 318.c. You own minerals in the adjacent drilling and spacing unit established by COGCC Order No. 535- 1306 covering Township 8 North, Range 60 West, Section 23: E2 and Section 24: W2. Your minerals are currently unleased, and Bison operates both this adjacent unit and the Hale Unit described above. While Bison is authorized to operate and drill wells in both units, in order for Bison to obtain the exception from the Director, COGCC Rule 318.c. requires that Bison obtain your consent. This letter requests that you provide your consent to allow the Wells in the Hale Unit to be drilled up to 150 feet from the boundary of the unit that includes your minerals. Upon receiving consent from you and the other mineral owners, Bison will submit its request to the Director. Should the Director approve the exception locations, Bison will file an application with the COGCC to amend Order No. 535-1306 to establish a matching unit boundary setback so that the wells in your unit can be drilled to within 150 feet from the Hale Unit. This setback amendment will protect your mineral interests and correlative rights and prevent waste. As a mineral owner in 8N -60W, Sections 23 & 24, please indicate your agreement and consent with Bison's proposal herein, by signing in the space provided on the following page.
