RESOLUTION
WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that a certain tract of land, being the
property of George B. McClellan Jr. and Betty J. McClellan, Route 1, Box
157, LaSalle, Colorado, and more particularly described as follows, to-wit:
All of the West Half of the Northeast Quarter of Section 4,
Township 4 North, Range 65 West of the 6th Principal Meridian,
County of Weld, State of Colorado, more particularly described
as follows:
Beginning at the Northwest corner of said Northeast Quarter;
thence along the North line of said West Half South 89°20'12"
East 1312. 15 feet to the Northeast corner of said West Half;
thence along the East line of said West Half South 0°30'22"
West 2519. 22 feet to the Southeast corner of said West Half;
thence along the East-West centerline of said Section North
89°17'30" West 1314. 89 feet to the Center of said Section; thence
along the North-South centerline of said Section North 0°33'59"
East 2518. 88 feet more or less to the POINT OF BEGINNING.
The above described parcel is subject to a 30. 00 foot right-
of-way for County Road along the Northerly portion thereof.
The above described parcel contains a gross acreage of 75. 97 acres,
more or less,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of Weld,
State of Colorado, desires to exempt this particular division of land upon the
recommendation of the Weld County Zoning Administrator for the reasons as
stated and pursuant to its authority under CRS 106-2-33 (d), 1963, as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by George B. McClellan Jr. and Betty J. McClellan
be exempt from the definition of the terms "subdivision" and "subdivided
lands" as provided for in the new Weld County Subdivision Regulations at
Section 2-1A. , (3), adopted August 30, 1972, as amended.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 18thday of December, A.D. ,
1974.

Dear Sirs:
The enclosed application, plat, and other information are in reference to
a request by George McClellan, for a recorded exemption. The parcel in
question is approximately 77 irrigated acres. The Board previously granted
a Lot Size Variance (LSV:5:74:5) for this property in compliance with
Section 9-4A. (6) of the Weld County Subdivision Regulations.
Based upon the information submitted and the Weld County Regulations, the
Planning staff recommends approval for the following reasons:
1 . The proposed land split is in compliance with Section 9-2 of the
Weld County Subdivision Regulations for recorded exemption and
the Weld County Comprehensive Plan in that non-productive agricultural
land is to be utilized.
2. All requirements for recorded exemption have been met.
