To Whom It May Concern :
Mr . Faudoa visited the Denver Office of the Colorado Division of Water Resources
on July 22 , 2019 to re - permit his residential exempt well , permit no . 230142 , for
commercial uses . Mr . Faudoa would like to have a water supply to use for working
with granite in his garage . Exempt permits are not available for that type of
commercial use . To use well water for that type of use , Mr . Faudoa would need to
apply for a non - exempt well permit with a court approved augmentation plan . He
Was provided with the " Beginners Guide to Augmentation Plans for Wells" , a
document that outlines the process to obtain a court approved augmentation plan .
I suggested to Mr . Faudoa that a cheaper and faster option for his needs would be
to have water trucked in from off- site .

Beginners Guide to Augmentation Plans for Wells
February 2019
If you are considering using welts to provide water for a lawn and garden , domestic animals,
a subdivision, or some other project , you should be aware that in some areas of Colorado
you may be unable to get a well permit without an Augmentation Plan . An Augmentation
Plan is a water court approved document which is designed to protect existing water rights
by replacing the volume of water depleted in a new project . Augmentation Plans are
usually required in areas where there is a shortage of water during part or all of the year.
Augmentation Plans may be approved for areas located outside of the Designated Ground
Water Basins . Within Designated Ground Water Basins , the Ground Water Commission may
approve Replacement Plans , which are similar to Augmentation Plans and are also designed
to protect existing water rights by replacing water depleted in a new project . To determine
whether or not you need an Augmentation Plan , you should consult with the Colorado
Division of Water Resources Office responsible for administering water in the area in which
your project will be located .
The following basics of Water Administration wilt help in explaining what an Augmentation
Plan is and what it does . Under Colorado 's constitution , water is allocated according to the
Prior Appropriation System . A simplified way to explain this system is often referred to as
"first in time, first in right . " When an individual physically takes water from a stream ( or
underground aquifer) and places that water to some type of beneficial use , that action is
referred to as an "appropriation ". The first person to appropriate water by diverting and
applying it to beneficial use has the first right to use that water within a particular stream
system . After receiving a court decree to confirm the appropriation date and details of their
water use , this person then becomes the senior water right holder on the stream , and their
water right must be satisfied before any other water rights can be fulfilled . As someone
contemplating providing water for a new project, you are a new water user, and any new
water right that you establish wilt be "junior" to (or have less priority than ) other water
rights that were established earlier. The priority protects the older water rights, which are
therefore "senior" (or earlier in time) to your water right . When a shortage occurs , a senior
water right owner may place a "call" for water, which is a request that the Division Engineer
shut down (curtail) alt upstream water rights junior to them until their senior right is
satisfied . This may result in your junior water right being ordered to cease diverting water
so the seniors can receive their water. Simply put, augmentation is a method to allow you
to use your junior water right ( this could consist of a surface diversion , well , or other
structure that has been awarded a water right by the water court) when a calk has been
placed , without reducing water available to senior water rights . Augmentation typically
involves adding a new supply of water to the stream to replace the depletions that result
from the diversion of water for your new project.

You may be wondering how it is possible for welts to affect other water rights . To answer
this question , we need to look at how groundwater and surface water interact . Water
experts have known for some time that groundwater and surface water are usually
hydrologically connected . The connection is through small openings between grains of sand ,
gravel , and even in some rocks , that allow water to move through the ground to and from
streams . This is most evident in springs where water can be seen seeping or flowing from
the sides of hills or roadcuts . The result of this connection is that pumping a well will
eventually cause a reduction in the amount of water in nearby streams . This reduction in
st reamf Low can affect the amount of water available to water rights on that stream and
downstream portions of that stream system .
For an example of an Augmentation Plan , let's assume that you want to construct welts to
supply a proposed subdivision where there are senior water rights on a nearby stream . An
Augmentation Plan must be designed to put water in the stream to prevent reductions in
streamflow (caused by pumping your well ) from affecting senior water rights . This allows
the junior water right to keep pumping water if a "call" is placed by a senior water right .
To obtain approval of an Augmentation Plan , you must make an application (which is often
prepared by an attorney) to the water court. The application must explain exactly where
water is to be used , what it will be used for, how much water will be used , what the source
of augmentation water is , when and where augmentation water will be required , how much
augmentation water is required , and how the Augmentation Plan will be operated . The
application should be supported by an engineering analysis , usually prepared by a water
resources engineer, which shows how the water needs of the project were determined and
how the new water use can occur without affecting senior water rights .

there is no comprehensive source for information on sources or cost of augmentation water.
Water attorneys and engineers may be able to provide some suggestions . Due to legal
