The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Use by Special Review Permit for Mining in the
A(Agricultural)Zone District
This project is north of and adjacent to CR 64 and is east of and adjacent to CR 27.
Parcel number 080529300009.
Access is from CR 64 (O Street).
ACCESS
Weld County Public Works has reviewed the application materials related to access and determined: 1)the
applicant is proposing to create an access on County Road 64 located approximately 205 feet west of the
southeast property corner; and 2)there is an existing access on County Road 64 located approximately 65
feet east of the proposed access. To meet Weld County Code's (Chapter 12, Article V, Section 12-5-30.
F)goal of no"net increase" in the number of accesses onto adjacent County roads when accesses already
exist, the applicant shall use the existing access for site access. Although the existing access does not
meet the minimum access spacing requirements for an arterial road (per Table 12A.2 of the Weld County
Code)there are no complying access locations possible with this parcel.
Per Chapter 12, Article 5, Section 12-5-30, an Access Permit is required for access to Weld County
maintained roadways. Please refer to Chapter 12 of the Weld County Code for more information regarding
access.
ROADS AND RIGHTS-OF-WAY
County Road 27 is a paved road and is designated on the Weld County Functional Classification Map(Code
Ordinance 2017-01) as an arterial road, which requires 140 feet of right-of-way. The applicant shall
delineate and label on the site map or plat the future and existing right-of-way (along with the documents
creating the existing right-of-way)and the physical location of the road. If the right-of-way cannot be verified
it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Chapter 23, Article III,
Section 23-3-50,the required setback is measured from the future right-of-way line. Be aware that physical
roadways may not be centered in the right-of-way. This road is maintained by Weld County.
County Road 64(O Street)is a paved road and is designated on the Weld County Functional Classification
Map (Code Ordinance 2017-01) as an arterial road, which requires 140 feet of right-of-way. The applicant
shall delineate and label on the site map or plat the future and existing right-of-way (along with the
documents creating the existing right-of-way)and the physical location of the road. If the right-of-way cannot
be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. Be aware
that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County.
Per Chapter 12, Article 4, Section 12-4-30.B, a Weld County Right-of-Way Use Permit is required for any
project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any
County rights-of-way or easement. Right-of-Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
Latest ADT on CR 64 counted 3,235 vpd with 23%trucks. The 851h percentile speed is 58 mph.
The traffic information submitted with the application materials indicated that at full buildout there will be
approximately 34 truck daily roundtrips and 10 passenger vehicle daily roundtrips. 75%of the traffic will be
going to the east on CR 64 and 25%of the traffic will be going to the west.
TRACKING CONTROL
Tracking control is required to prevent tracking from the site onto public roadways. For access to paved
roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt.
Temporary Tracking Control shall be used during construction unless permanent tracking control is installed
ahead of construction activities. Recycled concrete is not allowed in County right-of-way. A variance
request for alternatives to the tracking control requirement can be submitted to Public Works for review and
consideration.
ROAD MAINTENANCE AGREEMENT
Public Works is requiring a Road Maintenance Agreement (RMA) for this project. The RMA will include,
but is not limited to, dust control and damage repair to specified haul routes.

DRAINAGE REQUIREMENTS
This area IS within a Non-Urbanizing Drainage Area: Non-Urbanizing Drainage Areas typically require
detention of runoff from the 1-hour, 100-year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1-hour, 10-year storm falling on the undeveloped site for NON-
URBANIZING areas.
All developed stormwater associated with this project drains to the gravel pit. As a result,this USR qualifies
for an exception to stormwater detention (Weld County Code Sec. 8-11-40.1.6). The applicant's engineer
has agreed to submit a signed and stamped drainage narrative citing Exception #6 which states, "Gravel
pits if the stormwater drains into the gravel pit. Releases from the site shall comply with the Weld County
Storm Drainage Criteria, including dewatering. Topographical information shall be provided."
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
If more than 1 acre is to be disturbed for construction of non-gravel pit items such as structures, parking
lots, laydown yards etc., a Weld County grading permit will be required prior to the start of construction.
Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early
Release Request Form may be entertained only after the applicant, Public Works and Planning Department
have reviewed the referral and surrounding property owner comments. The Early Release Request may or
may not be granted depending on referral comments and surrounding property owner concerns. Contact
an Engineering representative from the Public Works for more information.
CONDITIONS OF APPROVAL
A. A Road Maintenance Agreement is required at this location. Road maintenance includes, but is not
limited to, dust control and damage repair to specified haul routes. (Department of Public Works)
B. A Drainage Narrative with qualifying exception (Sec. 8-11-40.1.6) is required. (Department of Public
Works)

so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled

Prior to Construction:
A. The approved access and tracking control shall be constructed prior to on-site construction.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off-site tracking. (Department of Public Works)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

4. Any work that may occupy and or encroach upon any County rights-of-way or easement shall acquire
an approved Right-of-Way Use Permit prior to commencement. (Department of Public Works)
5. The Property Owner shall comply with all requirements provided in the executed Road Maintenance

Environmental Health Services has reviewed this proposal for a Site-Specific
Development Plan and Special Review Permit for Mining in the A (Agricultural) Zone
District.
As mining is considered a temporary use, portable toilets and bottled water are
acceptable for sanitary uses.
Noise is restricted to the level allowed in the industrial zone district. The application
contains a noise report which indicates noise levels will meet the industrial limit as
measured 25 feet from the property line. The report states: "For mitigation, dirt berms
will be placed in areas deemed most sustainable or effected by high noise levels (i.e.
residential property). As mining continues and the pit descends, the amount of noise
disturbance will decrease to the surrounding properties. There will be no constant
stationary noise from items like pumps (after initial dewatering), crushing, or screening.
Since all construction equipment is mobile, no one area adjacent to the mine shall be
persistently noisy."
A dust abatement plan was submitted which states a water truck will be utilized. A
waste handling plan was submitted which indicates trash receptacles will be used and
collected by a trash pick-up service.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant
to include those wastes specifically excluded from the definition of a solid waste

in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The facility shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code and the accepted waste handling plan.
4. Fugitive dust should attempt to be confined on the property. Uses on the property
shall comply with the Colorado Air Quality Commission's air quality regulations
and the accepted dust abatement plan.
5. The operation shall submit an Air Pollution Emission Notice (A.P.E.N.) and
Emissions Permit Application and obtain a permit from the Air Pollution Control
Division, Colorado Department of Public Health and Environment, as applicable.
6. The facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S. The facility shall operate in
accordance with the accepted noise report.
7. The operation shall remove, handle, and stockpile overburden, gravel, sand and
soil from the facility area in a manner that prevents nuisance conditions.
8. Adequate drinking, hand washing, and toilet facilities shall be provided for
employees and the public, at all times. Portable toilets and bottled water are
acceptable to provide drinking and sanitary services to the site. Records of
maintenance and proper disposal for portable toilets shall be retained on a quarterly
basis and available for review by the Weld County Department of Public Health and
Environment. Portable toilets shall be serviced by a cleaner licensed in Weld
County and shall contain hand sanitizers and be screened from existing adjacent
residential properties and public rights-of-way.
9. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
10. If applicable, the operation shall obtain a stormwater or other discharge permits
from the Colorado Department of Public Health & Environment, Water Quality
Control Division.
11 .The operation shall comply with all applicable rules and regulations of the
Colorado Division of Reclamation Mining and Safety.
12.The operation shall comply with the Mine Safety and Health Act (MSHA).
13.The facility shall notify the County of any revocation and/or suspension of any
State issued permit.
14.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Feuerstein landowners' Concerns
Please be advised that Feuerstein Farms LLC, Larry D. Feuerstein and Randall J.
Feuerstein are Whitney Irrigation Company shareholders who are delivered their
irrigation water via a lateral underground tile line from the Whitney Ditch. We are
concerned about the adverse effects upon this irrigation water for our farming
operations located at 13771 and 13621 WCR 64, Greeley, CO 80631. The applicant
wants to relocate our irrigation tile line,which now passes from the Whitney Ditch
headgate under the proposed gravel pit area, to a new location around the north end
of the proposed gravel pit. Thus, a pipeline containing four or more corners would
replace a currently straight shot tile line. Corners in an underground pipeline are
problematic because logs, sticks and other irrigation ditch debris would get caught
in the corners and eventually plug the line resulting in the loss of our irrigation
water for the farms.
We have meetings scheduled with representatives of the applicant on 10/17/19 to
discuss our issues with the proposed gravel pit,but wanted to make sure that Weld
County Planning and Commissioners are aware of our concerns. We will ask the
applicant to consider including in a structure agreement or other agreement with
adversely affected landowners, among other things,the following topics,to protect
the delivery of our irrigation water from the Whitney Ditch:
1. Relocation of the proposed new pipeline route parallel to the railroad right of
way to minimize corners in the new line. Any new easement should run for the
benefit of the affected landowners and be obtained at the sole expense of the
applicant.
2. Manholes with clean outs at every corner of the relocated pipeline along with
a contractual commitment to maintain the relocated pipeline including periodic
cleaning of all corners.
3. Crop and water loss damages reimbursement.
4. Reimbursement for property devaluation from interrupted irrigation water
supply.
5. If necessary, pumping units to maintain water quantity and quality flow.
6. Installing a ditch cleaner at the Whitney Ditch headgate.
7. Capacity of the relocated line must equal or exceed the current pipeline
sizing.
8. Applicant's acknowledgement that changes to structure and flow does and
will not diminish the priority and volume of the landowners' water rights.
9. Other customary contractual provisions.

Thanks for providing the above-referenced USR application for the Tollgate Pit. As you know, I
represent the Storms Lake Drainage District (District) which owns and operates a clay drainage tile
line crossing a portion of the property which is the subject of the USR application. The clay tile line
was installed in the early 1900s and has operated continuously.
It appears that the Applicant proposes to use an existing access over the District's clay tile line for
heavy equipment and trucks and to transport topsoil and up to 444,000 CY of overburden from the
east part of the project to the proposed western stockpile. Because of the proposed substantial
expansion of scope of use of the access, the District requests that the County condition any approval
of the application on a requirement that the applicant enter into a crossing agreement with the
District before the access can be used.

North Weld County Water District(NWCWD) has reviewed the application and it appears that the
proposed mining operation will not require potable water.Therefore,we find no conflicts with our
interests.
However, the proposed mining operation falls within NWCWD's service area and therefore if the
operation requires potable water in the future they will be required to submit a Water Tap Request
Form (available at www.nwcwd.org)to NWCWD for review. At such point in time, NWCWD will review
to determine our ability to provide water service.

General Comments
1. Advisory. The design standards in LREGA are such that the industrialization along the
railroad corridor is supportable, due to the costs of developing new rail corridors; existing
rail systems represent an important and unique existing resource. Thus, staff is an
agreement that this use, despite its proximity to the residential estate parcels to the west, is
consistent with the North Greeley Rail Corridor Subarea Plan .
2. Advisory. Although this use is supportable, mitigation measures must be considered to
ensure that quality of life is preserved, especially to the western residents. With any
intensive industrial mining operation, there is bound to be dust, noise, and visual impacts.
Thus, please require buffering in the way of landscaping in combination with wall or solid
fence material on the west side of the subject parcel facing the roadway and the single-
family residential estate lots.

❑ The City of Greeley's 2035 Comprehensive Transportation Plan indicates that WCR 64
("O" Street) will be a four lane Major Arterial roadway requiring 150'of total public right
of way (75' half right of way). Please ensure that the site map calls out the future north
half of the right of way for "O" Street and that all proposed structures (buildings and
paved areas) are set back a minimum of 25 feet from the future right of way line.
❑ The City of Greeley's 2035 Comprehensive Transportation Plan indicates that WCR 27
(83rd Avenue) will be a Minor Arterial roadway requiring120'of total public right of way
(60' half right of way). Please ensure that the site map calls out the future east half of the
right of way for 83rd Avenue and that all proposed structures (buildings and paved areas)
are set back a minimum of 25 feet from the future right of way line.
❑ Advisory. It appears that the access to this site will be from a Weld County managed and
maintained road, therefore an access permit would not be required at this time from the
City of Greeley.
❑ Show all easements and/or rights-of-way for any City of Greeley infrastructure on the
subject property, including water lines, sewer lines, stormwater facilities, roadways or
any other City infrastructure on final maps/plans/plats. The City requires that all Greeley
utilities and pipelines within 100' of the construction site be shown on the USR plat map.
❑ Advisory. The subject property is located within the City of Greeley Long Range Expected
Growth Area (LREGA). If, in the future, water and sanitary sewer service are requested
to serve the property, then annexation into the City of Greeley will be required prior to the

City of Greeley providing utility service. The City of Greeley does not currently provide
utility services to the subject property.
❑ Advisory. The City of Greeley and North Weld County Water District(NWCWD)have
adopted a Water Service Agreement for providing water in this area. Please note that if a
new water service is requested, then the City of Greeley will decide if water will be
provided by the City of Greeley or NWCWD in accordance with the executed Water
Service Agreement.

Dear Ms. Snyder:
We have reviewed the above referenced proposal for a use by special review to allow gravel
mining of the subject property. The submitted material does not appear to qualify as a "subdivision"
as defined in Section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4,
2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a
cursory review of the referral information and provide comments. The comments will not address the
adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy
any County regulations or requirements.
The application seeks a Site Specific Development Plan and Special Review Permit to allow for
open mining of aggregate in the A (Agriculture) zone district. The application concerns a proposed
aggregate mining operation known as the Tollgate Pit, which will be operated under Colorado Division
of Reclamation Mining and Safety (DRMS) permit no. M-2008-017. The site is proposed to be reclaimed
to developed water resources and residential land use upon completion of the mining operation.
Comments regarding the reclamation permit were provided to the DRMS in a memo dated December
6th, 2018.
The proposed mining operations will predominately occur below the groundwater table and will
impact groundwater hydraulically connected to the Cache la Poudre River ("River"). The site is
proposed to be dry mined using dewatering trenches that will be constructed around the perimeter of
the site and will be discharged first to settling basins and then to the adjacent Storms Lake Drainage
Ditch, which travels approximately 0.5 miles before discharging to the River. A slurry wall is proposed
to be constructed around the mine boundary prior to the commencement of mining. Consumptive use
of water at the site will result from evaporative loss in dewatering trenches and settling basins, water
retained in any mined product removed prior to the installation and provisional approval of the slurry
wall, and water used for dust control. According to the permit application submitted to the DRMS, the
estimated annual amount of water to be consumed is 11.74 acre-feet. If groundwater will be exposed
at the site prior to the construction and approval of the slurry wall liner, or if groundwater will be put
to any beneficial use at the site, the applicant will first need to obtain a well permit and/or substitute
water supply plan as appropriate.
The site is anticipated to have two employees on site, with additional visits by material haul
truck drivers and other site users. Bottled drinking water will be provided for employees and visitors,
and portable toilets will be located on site.

If storm water runoff is intercepted by this operation and is not diverted or captured in priority,
it must infiltrate into the ground or be released to the stream system within 72 hours; otherwise the
operator will need to make replacements for evaporation.
