HomeMy WebLinkAbout20203360.tiffHEARING CERTIFICATION DOCKET NO. 2020-71 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR20-0026, FOR AN OIL AND GAS SUPPORT AND SERVICE (OUTSIDE STORAGE OF OIL FIELD SUPPORT EQUIPMENT AND SUPPLIES) IN THE A (AGRICULTURAL) ZONE DISTRICT - JOEL VELASCO A public hearing was conducted on November 18, 2020, at 10:00 a.m., with the following present: Commissioner Mike Freeman, Chair Commissioner Steve Moreno, Chair Pro -Tern — EXCUSED Commissioner Scott K. James Commissioner Barbara Kirkmeyer — EXCUSED Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Karin McDougal Planning Services Department representative, Maxwell Nader Public Works Department representative, Mike McRoberts Health Department representative, Lauren Light The following business was transacted: e I hereby certify that pursuant to a notice dated October 9, 2020, and duly published October 14, 2020, in the Greeley Tribune, a public hearing was conducted to consider the request of Joel Velasco, for a Site Specific Development Plan and Use by Special Review Permit, USR20-0026, for an Oil and Gas Support and Service (outside storage of oil field support equipment and supplies) in the A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney, made this a matter of record. ID Chair Freeman explained for the applicant, that with only three Commissioners present, Mr. Velasco may choose to have his case heard today which will require a unanimous vote for approval or have the case moved to a different date. Mr. Velasco chose to proceed. IR Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal and described the location of the site, relaying the property owner also owns the adjacent property, permitted for a vehicle repair establishment under USR19-0045, including a shop truck and equipment storage. Mr. Nader relayed part of what is stored are the cranes used to move the tanks and, with the properties and uses being adjacent, the amount of traffic onto the county roads will be reduced, and it is proposed that the new site will utilize the same access point as USR19-0045. Mr. Nader relayed USR18-0019 (Anadarko E and P Company, LLC, c/o Kerr McGee Gathering, LLC) is approximately two (2) miles away, which also lessens the amount of time trucks on the road. He stated this will be an unmanned site and fencing is being proposed for screening to insure the storage yard is not exposed to adjacent properties and rights -of -way. Mr. Nader relayed the Town of Gilcrest returned a referral request with no concerns, the site is zoned A (Agricultural) and he described the surrounding USRs, six (6) of which are within one (1) PL(mnt/7P), PWC►Mw►/DA), ti+(u l 1 J 7 /Z02.1 2020-3360 PL2771 HEARING CERTIFICATION - JOEL VELASCO (USR20-0026) PAGE 2 mile. Mr. Nader relayed the site currently contains the applicant's residence and entered the favorable recommendation of the Planning Commission into the record as written, displaying images of the site and surrounding views. Mike McRoberts, Department of Public Works, provided a brief overview of the access location from County Road (CR) 36 which is designated as a local gravel road, stated the latest average daily trips are 65 vehicles per day, with 27% trucks and the 85th percentile speed is 51 mph. According to the application, there will be 50 truck round trips when delivering or removing incinerators to and from the site and once storage is no longer required, there will be five (5) truck round trips per week, with all deliveries occurring during daylight hours. He further stated staff is requiring a Road Maintenance Agreement; however, no upfront traffic control, water detention or grading permit is required. IR Lauren Light, Department of Public Health and Environment (EH), stated the existing residence is served by a domestic well, sized for three (3) bedrooms. She explained a screened, portable toilet will be used for the business, the incinerators contain no residue and won't be cleaned onsite. She relayed the typical dust and waste items are included and Development Standards (DS) #9 — 14 which address EH items. IR Joel Velasco, applicant, presented two slides and introduced himself and his business, which hauls and sets equipment for Questor, which is based out of Canada, providing hollow, thermal oxidizers that reduce noise, with no visible flare, low frequency vibrations, and a 99.99% reduction of emissions. He stated his original meeting for this permit was in January 2020, Questor has since found another location, but with approval of this permit, he is hoping he can get them back. IR No public testimony was offered concerning this matter. l Mr. Velasco inquired concerning any height restrictions, and Mr. Nader explained the USR allows for storage of oil and gas related materials, including cranes and Questor incinerators. There was some discussion regarding the adjacent USR and its uses which were for a diesel mechanic shop and storage of cranes for removal and installation of tanks. In response to Chair Freeman, the applicant stated he had no questions or concerns with the Conditions of Approval (COA) or DS. In response to Chair Freeman, Mr. McRoberts explained the intent of the Road Maintenance Agreement, and Mr. Nader confirmed the terms of the access license agreement. Responding further to Chair Freeman, Mr. Nader explained the Landscape and Screening Plan due to a letter received from one of the surrounding property owners, and he also confirmed the nearest residence is adjacent to the site, to the south. Mr. Nader requested a correction to move COA #1.C.6 to a new COA #1.C and re -letter the subsequent items. In response to Commissioner James, Mr. Velasco confirmed business operations will only be during daylight hours, since the tanks are an oversize load and are required to move during daylight hours; therefore, Commissioner James requested striking DS #3 (operations during daylight hours). Commissioner Ross requested adding the word "downcast" to DS #8 (lighting). The Board agreed to all the aforementioned changes. 2020-3360 PL2771 HEARING CERTIFICATION - JOEL VELASCO (USR20-0026) PAGE 3 Ei In response to Chair Freeman, Mr. Velasco indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. Commissioner James moved to approve the request of Joel Velasco for a Site Specific Development Plan and Use by Special Review Permit, USR20-0026, for an Oil and Gas Support and Service (outside storage of oil field support equipment and supplies) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Ross, and it carried unanimously. There being no further discussion, the hearing was completed at 11:21 a.m. This Certification was approved on the 23rd day of November, 2020.
