HEARING CERTIFICATION DOCKET NO. 2020-84 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR20-0018, FOR ACCESSORY BUILDINGS WITH GROSS FLOOR AREA LARGER THAN FOUR PERCENT (4%) OF THE TOTAL LOT AREA INCLUDING STRUCTURES FOR THE STORAGE OF AGRICULTURAL EQUIPMENT AND AGRICULTURAL PRODUCTS (STORAGE AND DISTRIBUTION OF BAGGED SEED AND GRAIN) LOCATED IN HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT - LUCERNE, INC. A public hearing was conducted on December 30, 2020, at 10:00 a.m., with the following present, and by unanimous consent, Chair Freeman turned the meeting over to Commissioner Kirkmeyer to chair her final land use hearing. Commissioner Mike Freeman, Chair Commissioner Steve Moreno, Chair Pro-Tem Commissioner Scott K. James - EXCUSED Commissioner Barbara Kirkmeyer Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle Public Works Department representative, Zackery Roberson Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated November 5, 2020, and duly published November 11, 2020, in the Greeley Tribune, a public hearing was conducted to consider the request of Lucerne, Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR20-0018, for Accessory Buildings with gross floor area larger than four percent (4%) of the total lot area including structures for the storage of agricultural equipment and agricultural products (storage and distribution of bagged seed and grain) located in historic townsites in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. IE Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and described the size of the parcel, referral responses, adjacent land uses and the zoning thereof, and explained land uses to the west are located within the Union Pacific Railroad right-of-way, which structures are utilized by Lucerne, Inc., and permitted under Site Plan Review, SPR-136. He described the surrounding USRs and stated the staff sent notices to 29 surrounding property owners (SPOs) and received no responses. Mr. Ogle relayed the Conditions of Approval (COA) will require a Lighting Plan and a Landscape Plan and the Development Standards (DS) and COA assist in mitigating the impacts of the facility on adjacent properties. He explained the services provided, stated there will be no full-time employees at the site and temporary employees will utilize restroom facilities located in the general office of Lucerne, Inc., and described the proposed PL(VioI-rP), (z12-) t it,L) 2020-3853 PL2779 HEARING CERTIFICATION - LURERNE, INC. (USR20-0018) PAGE 2 primary and accessory buildings. Mr. Ogle relayed 12 referral agencies reviewed the application, two (2) offered comments, which are addressed in the COA and he entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. Zackery Roberson, Department of Public Works (PW), provided a brief overview of the transportation plans and requirements. He stated access for the property will be on Elm Street, which is classified as a local, gravel road on the Weld County Functional Classification map, and no traffic counts were available; however, according to the application materials, there will be two (2) semi -truck round -trips per week and two (2) pickup truck, daily round -trips. He explained all semi -truck traffic will come from the north of Railroad Avenue and will leave the site utilizing the same route, and due to the limited traffic generated by the site, neither upfront tracking control, nor a Road Maintenance Agreement is requested. Mr. Roberson explained the applicant has submitted a Drainage Narrative which has been reviewed and accepted by PW, no stormwater detention or MS4 requirements are necessary, and due to the small size of the property, a Grading Permit is not required. e Lauren Light, Department of Public Health and Environment (EH), stated sanitary facilities will be provided by the existing office, owned by the applicant, and if that office is no longer available, a portable toilet may be utilized. Ms. Light relayed EH has included DS #8 — 16, which address health issues. IR Ralph Anders, Lucerne, Inc., stated the application request provides for additional space to store their equipment because their business is growing. e No public testimony was offered concerning this matter. In response to Commissioner Moreno, Mr. Ogle explained the Landscaping Plan includes mitigation of weeds, and Commissioner Moreno suggested deletion of COA #1.B (Landscape Plan). Responding to Commissioner Kirkmeyer, Mr. Ogle explained lighting over man doors or overhead doors is required by Code. Commissioner Moreno requested deletion of COA #1.C.6 (Landscaping). Commissioner Ross confirmed with Mr. Anders, there are never more than three (3) employees onsite at a time, and the Board deleted DS #3 (Hours of operation), DS #4 (Number of Employees), DS #5 (Commercial vehicles), and DS #24 (Landscaping). The Board agreed to all the aforementioned changes. IR No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. IR In response to Commissioner Kirkmeyer, Mr. Anders indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. 2020-3853 PL2779 HEARING CERTIFICATION - LURERNE, INC. (USR20-0018) PAGE 3 Commissioner Freeman moved to approve the request of Lucerne, Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR20-0018, for Accessory Buildings with gross floor area larger than four percent (4%) of the total lot area including structures for the storage of agricultural equipment and agricultural products (storage and distribution of bagged seed and grain) located in historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Ross, and it carried unanimously. There being no further discussion, the hearing was completed at 10:21 a.m. This Certification was approved on the 4th day of January, 2021.
