RE: APPROVE DISMISSAL OF CERTIFICATION TO THE WELD COUNTY TREASURER
OF ZONING VIOLATION PENALTIES AS SPECIAL ASSESSMENT -JOSE LOPEZ
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County, on behalf of the Weld County Department of Planning Services,
filed a complaint in the Weld County Court against Defendant Jose Lopez claiming that the
Defendant's property is in violation of the Weld County Code, and
WHEREAS, the County Court found the Defendant's property to be in violation of the
Weld County Code, and
WHEREAS, the Defendant failed to bring the property into compliance with the
Weld County Code, and upon Weld County's motion, the County Court ordered Defendant to pay
$100.00 per day that the property remained in violation of the Weld County Code, beginning on
February 25, 2019, and
WHEREAS, the Board of County Commissioners previously approved the certification of
$9,600.00 to the Weld County Treasurer for the daily penalty accruing period between
February 25, 2019, and May 31, 2019, for a period of 95 days, and
WHEREAS, C.R.S. §30-28-124.5(1) and Weld County Code Section 23-10-40.A allow
these costs to be assessed against the property and collected as a special assessment by the
Treasurer, and
WHEREAS, at a hearing held on January 20, 2020, the Board considered certification of
$21,400.00 to the Weld County Treasurer for the daily penalty accruing period between June 1,
2019, to December 31, 2019, at which time they deemed it advisable to continue said matter to
July 13, 2020, to allow Mr. Lopez time to find a new location to move the business to, and
WHEREAS, on July 13, 2020, it was determined that the property is still in violation of the
Weld County Code; however, Mr. Lopez is in the process of purchasing a new property in a
location that allows for his business and is preparing to move the business, thus, the Board
deemed it advisable to continue said matter to September 14, 2020, to allow adequate time for
Mr. Lopez to move the business to a new location, and
WHEREAS, on September 14, 2020, the Board was presented with evidence that the
business is partially removed from the subject property; therefore, the Board deemed it advisable
not to certify daily penalties against the property at this time.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that consideration of daily penalties from June 1, 2019, to January 20,
2020, to the Weld County Treasurer to be collected as a special assessment, be, and hereby is,
dismissed.

Bruce,
This certification was originally continued from January. The certification amount in January was for
$21,400.00. We agreed to continue it in January because Mr. Lopez had new counsel who better understood
the land use process. Mr. Lopez paid $2,001.00 to the County as part of the agreement to continue the
certification. The Board continued it again in July as Mr. Lopez was making progress and looking for a new
location in Keenesburg.
Bethany inspected on Thursday and said that substantial progress had been made. That the property was
probably at least 1/2 complete and up to 2/3's complete. The commercial vehicles were down from a couple

dozen to around 7. Mr. Lopez does not appear to be running the tire business anymore either. Mr. Lopez
continued to clean over the weekend and last night sent the attached pictures. Bethany agrees that even
more progress has been made but that it is not done so she cannot close her violation. This is the most
progress we have seen on this property since this violation began.
My understanding from Corey Preston, Mr. Lopez's new attorney is that Mr. Lopez has a buyer for this
property and they have reached out to our planning department, but that the sale is not yet complete. The
original property in Keenesburg fell through, but they still have another prospective property in Keenesburg
and they are planning to meet again with Keenseburg on Tuesday.
The Board has three options: (1) Dismiss this certification round. The violation is still open and the Court case
is still active so we still can enforce, but the landowner is making good progress and it seems in the past that
the Board has taken this into consideration. (2) Certify a lesser amount than is due. (3) Certify the full amount
minus the previously paid $2,000.00.
I think both Bethany and I agree that the property owner has worked hard and deserves credit for that. That
they have a prospective buyer, a prospective property and that they have worked hard to clean up the
property. Mr. Preston and Mr. Lopez are both aware of the urgency in continuing the clean-up. If the Board
asked my opinion, I would recommend dismissing this round, but keeping the County Court case open.
Both Mr. Preston and Mr. Lopez will be present at the hearing today. Mr. Lopez speaks solely Spanish, so Mr.
Preston will be making the presentation and translating for Mr. Lopez. Bethany will also be present at the
hearing for questions.

This letter is to provide you with notice of Weld County's intent to certify certain liens on your property
to the Weld County Treasurer. As you know, the County Court found your property to be in violation of
the Weld County'Code
On February 25, 2019,the Court granted the County's Motion to Impose Daily penalties on your property
located on Weld County Road 38 The Court found that your property was in violation of the Weld County
Code and ordered you to pay daily penalties in the amount of$100 00 per day,continuing until the zoning
violations are removed. (Court Order attached). Upon information and belief, the zoning violations still
exists on this property
At a_public hearing on January 20, 2020 at 9:00 a.m., the Weld County Board of County Commissioners
will ,determine whether to certify the continuing daily penalties against your property which have
continued to accrue The hearing will be held at the Weld County Administration Building at 1150 "O"
Street,Greeley,CO 80632 The hearing will address the penalties for the period from June 1,2019 through
December 31, 2019 This period totals 214 days and amounts to $21,400 00 Please note that the daily
penalty'will continue to accrue until the property is brought into compliance with the Weld County Code
The total request at the hearing will be$21,400 00,which is in addition to liens from prior years.This lien
together with liens from prior years,will have priority over all other security interests,except for taxes In
addition to the$21,400.00,the Weld County Treasurer's fee may increase the lien as permitted by law

YOU ARE HEREBY NOTIFIED that at a review hearing which was held on Monday,
February 25,2019,it was ordered by Magistrate Randall Lococo that a daily penalty fine of$100 00
per day was ordered Both Plaintiff and Defendant were present
1 On March 19, 2018, the Parties in this case entered into a Stipulation regarding the
property in violation of the Weld County Code, which was accepted by the Court
2 On September 10,2018,the Parties agreed the Defendant was not in compliance with
the Stipulation and to impose daily penalties but stay imposition of those penalties until the next
review hearing
3 The case was continued two more times on October 22,2018 and January 14,2019 to
allow additional time to complete the Use By Special Review Application or otherwise bring the
property into compliance with the Weld County Code Penalties of$25 00 per day continued to
accrue, as did the stay on imposition of those daily penalties.
4 On February 25, 2019, Parties met for another review There were still issues with
completing the Use by Special Review application Parties agreed to dismiss the previously accruing
penalties at$25 00 per day but impose penalties at$100 00 per day beginning on this day until an
application is complete or the property is otherwise brought back into compliance.
5 A review has been set for Monday, April 1, 2019 at 10:30 a m Parties must be
present at this hearing
