HomeMy WebLinkAbout20200255.tiff 4572792 Pages: 1 of 2 03/08/2020 03:40 PM R Fee:$0.00 Carly Koppes, Clark and Recorder, Weld County, CO �k�411h ails nal iMYk 11 11 1 RESOLUTION RE: APPROVE CERTIFICATION TO THE WELD COUNTY TREASURER OF ZONING VIOLATION PENALTIES AS SPECIAL ASSESSMENT, AND AUTHORIZE STAFF TO PURSUE INJUNCTION IN THE DISTRICT COURT OF WELD COUNTY - LANCE RAUSCH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Weld County, on behalf of the Weld County Department of Planning Services, filed a complaint in the Weld County Court against Defendant Lance Rausch claiming that the Defendant's property is in violation of the Weld County Code, and WHEREAS, the County Court found the Defendant's property to be in violation of the Weld County Code, and WHEREAS, the Defendant failed to bring the property into compliance with the Weld County Code, and upon Weld County's motion, the County Court ordered Defendant to pay $50.00 per day that the property remained in violation of the Weld County Code, beginning on January 26, 2017, and WHEREAS, the Board of County Commissioners previously approved the certification of $16,700.00 to the Weld County Treasurer for the daily penalties accruing period between July 2, 2018, and May 31, 2019, for a period of 333 days, and WHEREAS, the property is still in violation of the Weld County Code, and WHEREAS, C.R.S. §30-28-124.5(1) and Weld County Code Section 23-10-40.A allow these costs to be assessed against the property and collected as a special assessment by the Treasurer, and WHEREAS, the County Attorney's Office has also requested approval to pursue an injunction in the District Court of Weld County for said violations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Certification of $10,700.00 to the Weld County Treasurer to be collected as a special assessment for the daily violation penalties from June 1, 2019, to December 31, 2019, be, and hereby is, approved. Plaintiffs bring this action for enforcement of zoning violations under Chapter 23 of the Weld County Code, as permitted by C.R.S. §30-28-124.5 and Weld County Code §23-10-40. The Court approved the Parties' stipulation on July 11, 2016. As relevant here, the stipulation required Defendant"to remove the mobile homes and the camper/trailer-RV's by September 12, 2016", and "to remove or completely SCREEN the NONCOMMERCIAL JUNKYARD by September 12, 2016." (capitalization in original). 2. The Court held an evidentiary hearing on September 26, 2016. At that hearing, the Court found that the Defendant was not in compliance with the stipulation. Nevertheless, the Court continued the matter until December 19, 2016,to allow the Defendant to come into compliance with the stipulation. 3. At the December 19, 2016 hearing, the Defendant requested a second continuance, so that he could hire an attorney. The Court continued the hearing until January 18, 2017. At that hearing, the Plaintiff was represented by Assistant County Attorney Bob Choate. Defendant represented himself. FINDINGS OF FACT 4. Defendant's property, located at 0 County Road 46, Weld County, Colorado, is being used in violation of the Weld County Zoning Code. Specifically,the property contains substantial amounts of unscreened junk and derelict vehicles, as defined by the Weld County Code. Further,the property contains multiple derelict campers, trailers, and RVs. 5. Exhibits 2 through 9 accurately depict the state of the property on December 13, 2016. Exhibits 10-18 accurately depict the state of the property on January 17, 2017, the day before the hearing was held. 1 of 3 6. All mobile homes were removed from the property before December 19, 2016. PRINCIPLES OF LAW 7. "Mobile Home", "Noncommercial Junkyard", "Screened", and "Derelict Vehicle"are terms defined by Weld County Code §23-1-90. 8. In the Agricultural Zone District, a noncommercial junkyard must be screened from all adjacent properties and adjacent road right-of-way. Weld County Code §§23-1-90 and 23-3-30. 9. Campers and Recreational Vehicles are not permitted to be used as dwelling units. Weld County Code § 23-1-90 10. "Each day after the issuance of the order of the county court during which such unlawful activity continues shall be deemed a separate violation and shall, in accordance with the subsequent provisions of this section, but the subject of a continuing penalty in an amount not to exceed one hundred dollars for each such day."C.R.S. §30-28-124.5 and Weld County Code §23-10-40(A). CONCLUSIONS OF LAW AND ORDER 11. The property and the defendant are in violation of the Weld County Code. That violation is continuing.Pursuant to Colorado statute and the Weld County Code,each violation"shall" be the subject of a continuing daily penalty. 12. An appropriate penalty is $50.00 per day, as stipulated to by the parties. 13. Although the mobile homes on the property were not removed prior to the September 12, 2016 deadline stipulated by the Parties,the Court finds that they have been removed prior to December 19,2016. Therefore the Court does not consider the mobile homes in issuing this Order. 14. Therefore, the Defendant is liable for the daily penalty of$50.00 for each day commencing September 26, 2016. As of January 18, 2017, the accrued daily penalty is $5,700, calculating$50.00 per day for 114 days.The daily penalty will continue to accrue until such time that Defendant brings the property into compliance with the Weld County Zoning Code. 15. The penalty may be collected according to law.
