SUBJECT: PUDZ18-0006 Todd Creek Village North Phase 1
The Weld County Department of Public Works has reviewed this PUD proposal . Staff comments made
during this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process .
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description : Change of Zone from the A (Agricultural) Zone District to the PUD (Planned Unit
Development) Zone District for three hundred (300) lots with E (Estate), R- 1 (Low Density Residential ), R-
2 (Duplex Residential , R-3 ( Medium Density Residential) , R-4 (High Density Residential), and C- 1
(Neighborhood Commercial) Zone District Uses with 13. 1 acres of open space.
This project is north of and adjacent to County Road 2 and is east of and adjacent to CR 21 .
Parcel number 146935300027 and 146935000024.
Access is from CR2 and CR 21 .
GENERAL
The applicant has not indicated the total number of phases for the project or the timelines for the phases .
Public Works recommends that this PUD go to the Board of County Commissioners at both Change of
Zone and Final stages .
SUBDIVISION INTERSECTIONS
This project is located within the boundaries of the Dry Creek Regional Urbanization Area (RUA). According
to the Dry Creek RUA map, County Roads 2 and 21 are designated as 4 Lane Arterial roads . Per the
applicant's August 13 , 2018 Traffic Impact Study, Figure 2 , there are three (3) proposed intersection
locations . A full movement intersection is proposed on County 21 at a location 660 feet north of County
Road 2, a right-in/right-out intersection is proposed on County Road 21 at a location 330 feet north of
County Road 2 , and a right-in/right-out intersection is proposed on County Road 2 at a location of 430 feet
east of County Road 21 . None of the proposed locations meet the minimum intersection spacing
requirements of 1 , 320 feet for arterial roads as specified in Table 1 below (Weld County Code, Section 8-
14-30 . 1 ). Please contact Public Works to discuss your intersections prior to recording the Change of Zone
Map. Per Chapter 8, Article XIV, Section 8- 14-30, an Access Permit is required for access to Weld County
maintained roadways . Refer to Chapter 8 of the Weld County Code for more information regarding access .

INTERNAL ROADS
The applicant shall follow the requirements and street sections as defined in Chapter 26 of the Weld County
Code. Per Chapter 27 , Article 2 , Section 27-2-20 , all PUD developments will be served by an internally
paved road system according to County standards . All internal roadways intersecting County
roadways will have to meet current spacing requirements and receive access permits for those
access points. If a proposed internal roadway does not meet the spacing requirements, a variance
for the special spacing criteria will need to be approved by the County at Final Plan . All Access
Permits for internal roadways accessing onto County maintained roads must be approved prior
to the Final Plan .
At Final Plan , a pavement study and roadway design are required . The roadway design shall include the
horizontal layout, road classifications , and vehicular speeds for each road . The vehicular circulation system
shall be depicted on the Utility Map, which shall be recorded with the PUD final plat. The applicant will
need to address oil and gas accesses to the drill sites and designate which internal roadways will
need to be constructed to accommodate oversize/overweight oil and gas vehicles. The applicant
must consider the truck turning radii when designing these access points .
ROADS AND RIGHTS-OF-WAY
These comments are subject to change upon receiving comments from Adams County.
County Road 2 is currently a paved road and is designated on the Weld County Functional Classification
Map (Code Ordinance 2017-01 ) as an arterial road , which requires 140 feet of right-of-way. The applicant
shall delineate on the site map or plat the future and existing right-of-way and the physical location of the
road . If the right-of-way cannot be verified it shall be dedicated . Pursuant to the definition of setback in the
Weld County Code, Sec. 23- 1 -90, the required setback is measured from the future right-of-way line . Be
aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld
County. Based upon a field inspection , the speed limit in this location is 45 mph . This portion of County
Road 2 is currently being maintained by Adams County. (Note : County Road 2 is designated as 4 Lane
Arterial road on the Dry Creek Regional Urbanization Area map. )
County Road 21 is a currently a gravel road and is designated on the Weld County Functional Classification
Map (Code Ordinance 2017-01 ) as a local road , which requires 60 feet of right-of-way. The applicant shall
delineate on the site map or plat the future and existing right-of-way and the physical location of the road .
If the right-of-way cannot be verified it shall be dedicated . Pursuant to the definition of setback in the Weld
County Code, Sec. 23- 1 -90, the required setback is measured from the future right-of-way line . Be aware
that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County.

Per Chapter 8 , Article 13, Section 8- 13-30. B , a Weld County Right-of-Way Use Permit is required for any
project that will be occupying , constructing or excavating facilities within , and/or encroaching upon , any
County rights-of-way or easement. Right-of-Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
The applicant submitted an updated Traffic Impact Study (dated August 13, 2018) for Phase 1 of the
development after the Sketch Plan submittal .
No ADT is available on CR 2 in this location .
Latest ADT on CR 21 counted 149 vpd with 27% trucks .
According to the updated traffic impact study, the site will generate approximately 5 , 199 daily roundtrips .
This traffic information was based on data taken from Trip Generation, 10h Edition, 2017, by the Institute of
Transportation Engineers (ITE) . Please see the Improvements Agreement Section of this referral for
information about required improvements .
The growth rate in the August 13, 2018 TIS indicates a 4% growth rate without explanation . Please provide
the methodology used in determining the projected growth rate with the Final Plan submittal .
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT
County Roads 2 and 21 roadways shall be designed to meet the full typical section specified in Appendix
26-T - Dry Creek RUA Street Sections , of the Weld County Code shown below.

Public Works will require an Improvements Agreement for one or all the following reasons:
• Off-Site Public Improvements
• Road Maintenance Agreement
• On-Site PUD Improvements
An Improvements Agreement is required for off-site improvements per Sec. 24-6-40. This agreement will
include on-site improvements associated with the development. Collateral is required to ensure the
improvements are completed and maintained .
Improvements/Road Maintenance Agreement: An example agreement is available at:

eview/sprusr. pdf. It will detail when off-site improvements are required . Possible mitigations included in the
road maintenance agreement may include but are not limited to: dust control , specified haul routes , damage
repairs , and future improvement triggers.
Based upon the updated traffic impact study, off-site improvements that will be required include , but are not
limited to:
• County Road 2 will be required to be built out to arterial cross section for the length of this
development, plus appropriate tapers .
• It is required that County Road 21 be built out to the full 4 Lane Urban Arterial cross section , as
indicated in the Dry Creek RUA. This is required from the intersection of County Road 2 for the
length of the development, plus appropriate tapers .
• EB LT deceleration lane on CR 2 at CR 21
• EB LT acceleration lane on CR 2 at CR 21
• WB RT deceleration lane on CR 2 at CR 21
• WB RT acceleration lane on CR 2 at CR 21
• WB RT deceleration lane on CR 2 at RIRO Intersection
• NB RT deceleration lane on CR 21 at RIRO Intersection
• NB RT deceleration lane on CR 21 at full movement Intersection
• SB LT deceleration lane on CR 21 at full movement Intersection
Auxiliary Turn Lanes/Speed Change Lanes shall be designed and installed in accordance with the criteria
defined in Sections Three and Four of the State of Colorado, State Highway Access Code, Volume 2, Code
of Colorado Regulations 601 - 1, March 2002, manual and the most recent edition of A Policy on Geometric
Design of Highways and Streets (Green Book) published by the American Association of State Highway
and Transportation Officials (AASHTO). The structural capacity of the road structure shall be designed in
accordance with the Guide for Design of Pavement Structures, published by AASHTO .
The applicant is responsible for all right-of-way acquisition and construction costs for offsite
County roadway upgrades needed to support the development.
DRAINAGE REQUIREMENTS
This area IS within an Urbanizing Drainage Area:
Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100-year, storm falling on
the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5-year storm
falling on the undeveloped site for URBANIZING areas .
The applicant submitted an updated Drainage Report (dated August, 2018) containing detailed hydrologic
and hydraulic design information for Phase 1 of the development. The updated report indicates that Pond
1 is being constructed north of the Phase 1 development area and will be accessed via a maintenance trail .
The Pond 1 outfall will drain offsite to the east using a 24-inch outlet pipe . The outlet pipe will be routed
under an existing irrigation ditch and will daylight approximately 1 , 700 feet east of Pond 1 . The applicant
shall obtain and record all easements needed for the construction , maintenance , and use of the pond and
outfall pipe . The applicant shall also submit a written and signed agreement from the irrigation company
stating they will allow the outlet pipe to run under their irrigation channel and within their right-of-way.
This drainage report will need to be further developed for the Final Plan submittal addressing the easement
and ditch company concerns mentioned above, and addressing any open items listed on the Weld County
Drainage Report Checklist. The Drainage Report Checklist can be downloaded at:

A final drainage report and detention pond design completed by a Colorado Licensed Professional Engineer
is required prior to recording the PUD Final plat. The drainage report must include a certification of
compliance stamped and signed by the PE. A Certification of Compliance form can be found on the Public
Works Development Review website .
Historic Flows :
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
Per Weld County Code , Chapter 8 , Article XII , Section 8- 12-30 . B , a Weld County Grading Permit will be
required if disturbing more than 1 acre . Grading Permits are issued after the planning process is complete
(map recorded ). An Early Release Request Form may be entertained only after the applicant, Public Works ,
and the Planning Department have reviewed the referral and surrounding property owner comments and
the case has been heard by the Board of County Commissioners . The Early Release Request may or may
not be granted depending on referral comments and surrounding property owner concerns . Contact an
Engineering Development Review representative from the Public Works Department for more information .
Application Fees : 1 -5 Acres/ $50, 5. 1 - 20 Acres/$ 100, 20. 1 Acres or Greater/$200 + $ 1 per acre over 20 .

A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre . Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division , Permit Support
Staff at 303-692-3517 .
CONSTRUCTION SCHEDULE
With the Final Plan application , a construction schedule will be required with submittal . This shall show the
approximate dates when construction of the development is proposed to start and finish . This shall describe
the stages in which the development will be constructed , and the number of buildings or structures and the
amount of common open space to be completed at each stage.
UTILITY MAP
At Final Plan , the utility map shall show: gas lines , water, electricity (above or below ground), telecomm (if
applicable), sewer (if applicable) , utility and drainage easements with labels , culverts , detention ponds and
structures . The Utility Map shall be recorded with the Final Plan plat.

At Final Plan, a construction set of plans will be required . The plan set shall include at a minimum :

• Existing Conditions Exhibit
• Overall Grading Exhibit
• Overall Utility Exhibit

CONDITIONS OF APPROVAL
A. Provide a signed copy of the agreement with the ditch company addressing the detention pond
outfall . ( Department of Public Works )
B. The plan shall be amended to delineate the following :

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN )
1 . On the Weld County Functional Classification Map, the Board of County Commissioners shall reclassify
County Road 21 from its current designation as a Local Road to an Arterial Road to be consistent with
the roadway classification specified in the Dry Creek RUA map. The reclassification shall extend from
County Road 21 , north to State Highway 52 .
2 . The property owner or operator shall be responsible for controlling noxious weeds on the site , pursuant
to Chapter 15, Article I and II , of the Weld County Code. (Department of Public Works)
3 . The access on the site shall be maintained to mitigate any impacts to the public road including damages
and/or off-site tracking . (Department of Public Works)
4. Any work that may occupy and or encroach upon any County rights-of-way or easement shall acquire
an approved Right-of-Way Use Permit prior to commencement . ( Department of Public Works)
5 . The historical flow patterns and runoff amounts on the site will be maintained . (Department of Public

6. Weld County is not responsible for the maintenance of onsite drainage related features . ( Department

The Weld County Environmental Health Services Division has reviewed this proposal for a
Change of Zone Request from the A (Agricultural ) Zone District to the PUD ( Planned Unit
Development) Zone District for three hundred (300 ) lots with E ( Estate) , R- 1 ( Low Density
Residential ) , R-2 ( Duplex Residential , R-3 ( Medium Density Residential ) , R-4 ( High Density
Residential ) , and - 1 ( Neighborhood Commercial ) Zone District Uses with 13 . 1 acres of open
space .
The application has satisfied Chapter 27 of the Weld County Code regarding public water and
sewer provisions . A signed agreement between the Todd Creek Village Metropolitan District
and Alf Equinox Todd Creek Village North , LLC to provide water and sewer service was
included with the application . The Weld County attorney' s office should have reviewed the
agreement to ensure adequate water and sewer service prior to submittal of this application .
The land use chart indicates there are approximately 14 . 1 acres of open space within the
proposed development . The COZ plat does designate a one-acre park with an exterior trail .
The park facilities may include a playground and multi-use fields . Environmental Health
Services is supportive of active recreational amenities .
Environmental Health Services encourages the developer to provide a trail system and
sidewalks which ensures safe walking and biking access to parks , schools and commercial
areas for current and future phases .
Environmental Impacts as outlined in the Specific Development Guide are adequate .
The Division recommends the following notes for the Change of Zone plat :
1 . Water and sewer service shall be obtained from Todd Creek Village Metropolitan District .
2 . During development of the site , all land disturbances shall be conducted so that nuisance
conditions are not created . If dust emissions create nuisance conditions , at the request
of Weld County Environmental Health Services , a fugitive dust control plan must be
submitted .

Good morning Kristine,
For some reason I was unable to open the referral form so I am sending our comments via email .
As part of our long standing conversation about this project the Fire District is requiring the
developer to provide a fire station site and building to serve the Dry Creek area . We believe that this
requirement should be reflected in the Metropolitan District documents . The exact location and type
of building requires continued discussion and approval .
I have included Fire Chief Mike Schuppe on this email as he would be the point of contact for the
developer for the details of the site and the station .

D. CAPITAL FACILITY FEE FOUNDATION (see attached Table 2 for methodology)
The Capital Facility Fee Foundation is a unique public/private nonprofit organization founded
in January 2001 to help fund school expansion or new school construction. This program has
been developed in partnership with each of the municipalities in the District, developer and
builder representatives, and School District 27J. Funding is provided by builders and developers
who have agreed to contribute per residential dwelling unit based on the current fee structure.
The current fees negotiated for this program are as follows : $ 843 per single family residential
unit and $ 481 per multi-family unit.
SCHOOL DISTRICT PLANNING COMMENTS AND RECOMMENDATIONS :
1. The District will accept cash in lieu of land dedication in the amount of $ 112 ,337 to
be payable to 27.1 Schools at the time of recording of the first subdivision plat.
2. Prior to the approval of the final subdivision plat, we recommend that the
developer enter into an agreement with the Capital Facility Fee Foundation to
} mitigate the impact of this development on District school facilities. The developer
is welcome to assign the agreement to builders as lots are purchased. CFFF fees
may be paid in a lump sum or by lot as permits are pulled.
We appreciate your continuing cooperation and the opportunity to comment upon issues of interest to

At this time, Fort. Lupton has no present obligation to provide sewer services for the
proposed project and does not intend to voluntarily offer sewer services to the Applicant. Fort
Lupton ' s obligation to provide sewer services is contingent upon conditions that currently do not.

The proposed water source is the Todd Creek Village Metropolitan District (District) . A Water
and Sewer Service Agreement between the District and ALF Equinox Todd Creek Village North ,
LLC dated September 17, 2008 was provided v ith application materials.
The District Last provided a Water Supply Report to this office , dated November 2011 , on
June 3 , 2014 . The District submitted updated information regarding the District' s surface
water supplies and water demands on August 19 , 2019 ( "updated 2011 Report " ) .
This office recognizes that the District continues to develop its water portfolio and
infrastructure so that it can meet the needs of its customers . However, when this office
evaluates water supplies available to any water district or municipal provider for the
purpose of meeting permanent customer commitments it does not consider a district ' s
short- term contract supplies, pending projects or junior water rights . Short term contracts

have the potential to be discontinued , water supplies that require a water court decree
prior to use have an uncertain yield until such time as a water court decree is obtained and
junior water rights are only able to divert during times when all downstream senior water
rights are satisfied , which in the South Platte river basin is infrequent in dry years . For
these reasons, we have not historically considered such supplies when evaluating the
permanent water supplies available to a district. This is consistent with the approach we
have taken in previous letters to the county regarding the District, including letters dated
January 2 , 2002 , June 18, 2002 , August 8, 2002 , October 29 , 2002, September 15 , 2004,
January 24, 2005 , February 8 , 2005, October 4, 2011 and November 17, 2016.
District Water Supply Demands
The updated 2011 Report estimates the District' s current and future demands are
approximately 3 , 375 . 08 acre-feet annually of which 1 ,452 .27 acre -feet annually is for potable
use and 1 , 922. 81 acre-feet annually is for irrigation use. This total includes 1 , 930 units for
Dry Creek East Subdivision.
According to information in this office, the District has implemented a dual pipeline system ,
one for potable water and one for non- potable irrigation water. New subdivisions will be
required to have two taps and the existing subdivisions have been retrofitted with this system .
Due to the nature of the District' s water rights, their dual pipeline system and the water
supply requirements of this office , the demand has been further broken down into potable
residential water demands, potable commercial water demands and non -potable irrigation
demands . This office will focus on the potable residential and commercial water demands
since Todd Creek has existing permanent water supplies that will provide a firm yield to meet
these demands and can supply potable water separate from non - potable water as a result of
their dual pipeline system . Currently, platted and future residential and commercial potable
water demands total 1 , 452. 27 acre-feet per year .
For the purposes of understanding the District 's ability to satisfy the county ' s water allocation
approach for the previously approved subdivisions, water demand can also be described by
the total residential and commercial potable water demand over the 100 year and 300 year
allocation periods . The total potable water demand for residential and commercial
developments is 303 , 664.4 acre-feet. The potable water requirements of each existing
residential and commercial development are listed in Table 1 .

District Water Supply Availability: Denver Basin Water
According to the District' s updated 2011 Report, the District has approximately 843 acre - feet
per year of currently decreed nontributary Laramie - Fox Hills ground water rights . The District
also has 39. 2 acre-feet per year of not- nontributary Lower Arapahoe ground water rights that
are currently included in a plan for augmentation and 503. 6 acre-feet per year of not-
nontributary Lower Arapahoe ground water rights that are currently not included in a plan for
augmentation . Once adjudicated , the District claims it wilt also have the right to withdraw
and use additional Laramie- Fox Hilts aquifer water underlying lands in the District 's
boundaries that is not currently adjudicated . Please note that these amounts are based on
the statutory 100-year aquifer life allocation approach .
Based on this information, the District currently has a total of 88 , 220acre-feet ( 882.2 acre-
feet per year for 100 years) of Denver Basin water supplies; the District is committed to
supplying a total of 303 ,931 . 7 acre-feet of potable water. If the Denver Basin water is
withdrawn over 100 years, it equates to 882.2 acre - feet of water per year, which is less than
the yearly potable commitment of 1 ,452 . 27 acre - feet per year.
The proposed source of water for this subdivision includes bedrock aquifer ground water in
the Denver Basin . The State Engineer's Office does not have evidence regarding the length
of time for which this source wilt be a physically and economically viable source of water.
According to 37- 90- 137(4) ( b ) ( I ) , c. R. S. , " Permits issued pursuant to this subsection (4) shall
allow withdrawals on the basis of an aquifer life of one hundred years . " Based on this
allocation approach , the annual amounts of water decreed by the District in the Denver
Basin are equal to one percent of the total amount, as determined by rules 8 . A and 8 . B of

the Statewide Nontributary butary round Water Rules, 2 CCR R 402 - 7 . Therefore , the water may
be withdrawn in those annual amounts for a maximum of 100 years .
In the Charter and Code of the County of Weld , Colorado , 2001 , Sec . 27- 2- 170 . Public water
provisions States:
" PUDs must be capable of meeting state drinking water regulations (Colorado Primary
Drinking Water Regulations) and have adequate provisions for a three - hundred -year supply
of water . "
The State Engineer's Office does not have evidence regarding the length of time for which
this source will provide a water supply.
District Water Supply Availability: Surface Water
According to the District ' s updated 2011 Report, the District has surface water rights ranging
from 1 , 740 acre-feet per year to 3 , 440 acre-feet per year . Some of this surface water is
limited to municipal or irrigation uses only, as outlined in Table 2 , below . Table 2 also
outlines what sources this office considers secure permanent supplies for the purposes of
evaluating a subdivision water supply plan . This office does not consider water subject to
short-term leases, water not yet adjudicated by the Water Court or junior water rights when
evaluating the amount of permanent supplies available to supply residential developments .
Regarding the District' s use of Coors water, the following issues need to be addressed before
we can provide additional comments. The Coors effluent may have very limited yield since
the decrees under which the majority of the water rights were changed (case nos . W - 8036 ,
W8256 and 89CW234) do not allow for reuse or successive use for municipal uses within the
District' s boundaries or augmentation uses other than the Coors Operations contemplated in
the decrees . It appears that only a portion of the water included in case no. 99CW236 ,
specifically water previously changed in case no . 96CW1117 , could be used within the
District's boundaries, subject to the terms and conditions of said decrees ..
The District has obtained a decree in case no . O CW165 since the District ' s updated 2011
Report, therefore the average historical consumptive usedecreed in that case for the Old
Brantner shares of 130 acre-feet has been included as a permanent supply as shown in Table
2 .

information provided it could not be determined if the land proposed to be irrigated is
included under the originally decreed lands.
**The Consolidated Mutual contract water is typically release . , from the Metro Wastewater
Facility; this water travels downstream to the District. Due to transit losses associated with
the water delivery, only 462. 1 acre-feet of the 500 acre -feet contracted is realized by the
District. This calculation is based on the standard river transit toss rates; in a dry year the
rate of transit loss could increase.
Based on the information provided by the District, and additional information available to this
office, it appears that the applicant has approximately 592 . 1 acre-feet of potable surface
water supplies that could be considered park, of the permanent water supply .
District Water Supply Availability: Conclusions
The District ' s ability to regulate astable and irrigation water separately through their dual
pipeline system allows this office to evaluate potable water supply and irrigation water supply
independently. Therefore, this office ' s conclusions regarding the District' s potable and
irrigation water are being addressed separately.

When the permanent supply of the District' s municipal surface rights ( 592 . 1 acre -feet per
year) is combined with the District ' s Denver Basin water (882. 2 acre-feet per year) , the
District's total permanent potable water supply becomes 1 ,474 . 3 acre-feet per year
(assuming a 100- year aquifer life) . This amount is not sufficient to meet the potable
residential and commercial demands for the existing District ' s commitments , which is
1 , 066 . 27 acre -feet per year, and the 386 acre-feet per year required for Dry Creek East
Planned Development for 300 years .
As discussed above based on the 100 year and 300 year allocation approaches required for the
subdivisions the total water requirement for the District' s current commitments is 303,931 . 7
acre-feet . The permanent water sources available to meet that demand is 882. 2 acre -feet
per year of Denver Basin water (88 , 220 acre -feet total based on a 100 year allocation
approach ) and 592 . 1 acre-feet of surface rights ( 177 , 630 acre-feet based on deliveries for 30O
years) . Therefore the total amount of permeant water supplies available over a 300 year
period would be 265, 850 acre- feet which would not be adequate to meet the demand over
that period of 303 ,,931 . 7 acre - feet .
The recognized permanent surface irrigation supplies are 312 acre-feet per year available
from the New Brantner shares . Permanent potable water supply that is not needed for existing
residential and commercial commitments may be used as a source of permanent irrigation
water supply, however Denver Basin water used for that purpose would reduce the amount
available to meet future potable water demands .
The 312 acre-feet of permanent irrigation supplies is less than the 1 , 922 . 81 acre -feet per
year irrigation demand projected for the platted parcels . It is our opinion that the District
does not have adequate permanent water supplies to meet the estimated future irrigation
requirements .
A review of our records found welt permit no . 161587 is located on the subject property .
Permit no . 161587-A was issued pursuant to S 37- 90- 105 C. R. S . for the replacement of the
late registered well under permit no . 161587 . Permit no . 161587 -A was issued on the
condition that the original well is plugged and abandoned . A Well Abandonment Report was
not received for the original well therefore , it is unknown if the original welt was plugged .

not located on the subject property .
State Engineer ' s Office Opinion
Based on the above and pursuant to Section 30 - 28 - 136 ( 1 ) ( h ) ( II ) , C. R. S. , the State Engineer's
Office has not received enough information to render an opinion regarding the potential for
causing material injury to decreed water rights , or the adequacy of the proposed water
supply . Prior to further review of the subdivision water supply plan the following
information is required :
1 . A completed Water Supply Information Summary Sheet (GWS - 76 ) , or report, that
specifies the water requirements for the subdivision and the proposed water supply.

2. The applicant must also clarify if the well operating under permit no . 161587 has
been plugged and abandoned prior to subdivision approval . If the well will be used
within the subdivision the proposed uses must be specified and the applicant must
demonstrate that a court approved augmentation plan has been obtained for the
welt.
3 . The District should show that they have additional permanent water supplies
currently available to supply water to their existing commitments and the Dry Creek
Planned Development or clarify the amount of water actually committed to Dry
Creek Planned Development .
The applicant should be aware that unless any storm water detention structure , can meet
the requirements of a "storm water detention and infiltration facility" as defined in Section
37- 92 - 602 ( 8 ) , C. R.S . , the structure may be subject to administration by this office . The
applicant should review the Division of Water Resources Administrative Statement
Regarding the Management of Storm Water Detention Facilities and Post- ildland Fire
Facilities in Colorado, available on our website, to ensure that the notification ,
construction and operation of the proposed structure meets statutory and administrative
requirements . The applicant is encouraged to use Colorado Stormwater Detention and
infiltration Facility Notification Portal , located at

requirements .
