HomeMy WebLinkAbout20201761.tiffHEARING CERTIFICATION DOCKET NO. 2020-45 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR20-0010, FOR ACCESSORY BUILDINGS WITH GROSS FLOOR AREA LARGER THAN FOUR PERCENT (4%) OF THE TOTAL LOT AREA IN THE A (AGRICULTURAL) ZONE DISTRICT - PAUL AND VALERIE TAMS A public hearing was conducted on June 17, 2020, at 10:00 a.m., with the following present: Commissioner Mike Freeman, Chair Commissioner Steve Moreno, Chair Pro-Tem Commissioner Scott K. James Commissioner Barbara Kirkmeyer Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Bob Choate Planning Services Department representative, Angela Snyder Public Works Department representative, Melissa King Health Department representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated May 12, 2020, and duly published May 20, 2020, in the Greeley Tribune, a public hearing was conducted to consider the request of Paul and Valerie Tams, for a Site Specific Development Plan and Use by Special Review Permit, USR20- 0010, for accessory buildings with gross floor area larger than four percent (4%) of the total lot area in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. e Angela Snyder, Department of Planning Services, presented a brief summary of the proposal for an oversized, agricultural pole barn to be used for personal storage, and when combined with existing outbuildings, will add up to 4.7% lot coverage. Ms. Snyder explained the site location, stated it is located within the three (3) mile referral area of the Towns of Berthoud, Johnstown and Mead, and relayed the Town of Johnstown, in their referral comments dated April 17, 2020, indicated no concerns. She noted the location of the proposed barn on the property, stating the barn will only be visible to a few neighbors, as other outbuildings in the area will block the view; however, the new barn will not block neighboring views of the mountains, nor will it be out of character with the neighborhood. She noted a petition from seven (7) surrounding property owners (SPOs) within 500 feet was received, requesting denial; however, no explanation was included. She stated several homes in the neighborhood have large outbuildings, none of which have required USR permit, detailed the three (3) USRs in the neighborhood, displayed images of the site and surrounding views, and entered the favorable recommendation of the Planning Commission into the record as written. CC:PL(iA- tree) I VVt hIDA-) €Pr(l_L-) 1�2q I2wzo 2020-1761 PL2756 HEARING CERTIFICATION - PAUL AND VALERIE TAMS (USR20-0010) PAGE 2 El Melissa King, Department of Public Works (PW), provided a brief overview of an unpermitted, existing access on Yucca Court, off County Road (CR) 42 at CR 11. Ms. King stated PW will require an Access Permit for this location, which is a paved, local road, and relayed there will be limited construction traffic and no additional traffic subsequent to construction. She indicated PW will not require further traffic information or tracking control and the applicant has submitted a drainage narrative with a qualifying exception to stormwater detention. e Lauren Light, Department of Public Health and Environment (EH), explained the existing residence is served by the Little Thompson Water District and they have a septic system permitted for a three (3) bedroom residence. She stated EH has no Development Standards (DS) or issues with this request as the system is located adjacent to Yucca Court and is not in the vicinity of the proposed building. El Paul and Valerie Tams, applicants, stated the petition was not related to the building, but rather, it expressed the neighbors' frustration over the fact that they are restricted from operating their businesses in the neighborhood. Mr. Tams clarified he is only storing personal property in the building. No public testimony was offered concerning this matter. IE Commissioner Kirkmeyer proposed modifying DS#3 to read: "The existing landscaping and screening on the site shall be maintained". The Board agreed to the aforementioned changes. IE No public testimony was offered regarding the change made to the Development Standards. e In response to Chair Freeman, Mr. Tams indicated they had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. El Commissioner Kirkmeyer moved to approve the request of Paul and Valerie Tams for a Site Specific Development Plan and Use by Special Review Permit, USR20-0010, for accessory buildings with gross floor area larger than four percent (4%) of the total lot area in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Ross, and it carried unanimously.
