DECLARATION OF POOLING AND UNIT DESIGNATION
KNOW ALL MEN BY THESE PRESENTS, THAT, WHEREAS, Mallard Exploration, LLC, with
express authority to operate leasehold interests within Unit Lands on behalf of DPOC, LLC, the undersigned
(hereinafter called "Mallard") is the present owner and holder of leasehold interests in the oil, gas and
mineral leases, hereinafter collectively referred to as the "Leases" identified and described on Exhibit "A"
attached hereto and made a part hereof; and
WHEREAS, each of the said Leases provide that the owner of the leasehold estate shall have the
right and power to pool or combine acreage covered thereby, or portion(s) thereof, with other lands, leases,
or leases in the immediate vicinity thereof, in order to form a pooled unit or units of the size and type herein
described or, in the absence of such right to unitize or pool by the Lessee in a particular Lease, Lessee has
secured the consent of Lessor to unitize or pool the Lease; and
WHEREAS, under the Order Number 535-1242, made effective as of September 25, 2019, the
Colorado Oil and Gas Conservation Commission established a 1,280 -acre drilling and production unitized
area (hereinafter referred to as "Unit Lands") for the production of oil, gas and associated hydrocarbons
from the Niobrara, Fort Hays, Codell and Carlile Formations, being further described as:

AND WHEREAS, it is necessary and advisable to pool and combine said Leases insofar as they
cover the Unit Lands, in order to properly develop and operate the premises for the production of oil and
gas and associated hydrocarbons in order to promote the production and conservation of same, that may be
produced and saved from said Unit Lands; and
NOW THEREFORE, Mallard, acting under and by virtue of the power and authority conferred and
granted by the provisions of said Leases, as amended or ratified, or in the absence of such right to unitize
or pool by the Lessee in a particular Lease, acting pursuant to the consent of Lessor, does hereby pool,
combine, unitize, and designate said Leases, insofar as said Leases cover the Unit Lands, together with all
unleased mineral rights, royalty rights, overriding royalty rights, and any production payment rights
pertaining to the Unit Lands and/or said Leases to form a unit for the purposes of developing and operating
such pooled acreage for the production, storage, processing, and marketing of oil, gas and associated
hydrocarbons. The entire acreage included in the Unit Lands shall be treated for all purposes, as if it were
included in the same lease, and the owners of leasehold, mineral, royalty, overriding royalty, and production
payment interests shall be entitled to receive on production from the Unit Lands only such portion of the
royalty and other interests payable under the terms and provisions of said Leases as the amount of their
acreage placed in the unit or their royalty or other interest therein bears to the total number of acres included
in the Unit Lands.

This Declaration of Pooling and Unit Designation shall in all respects amend and further clarify the
Leases subject to this Declaration of Pooling and Unit Designation. Lessee specifically reserves the right
to amend this Declaration of Pooling and Unit Designation as deemed necessary at the discretion of Mallard,
including, but not limited to, the right to amend this Declaration of Pooling and Unit Designation or to
correct the erroneous inclusion or omission of any leases or any part of the land covered by any leases
herein or to include in this unit any unleased tract or interest which is located within the Unit Lands and not
heretofore force pooled.
IN WITNESS WHEREOF, this Declaration of Pooling and Unit Designation is dated this 15' day
of July, 2020, but shall be effective as of the date of first production from the first well within the Unit
Lands.
