ACCESS :
Weld County Public Works has reviewed the application materials related to access and determined that
access for this site is on County Road 2 IA which is under the jurisdiction of the City of Brighton .
ROADS AND RIGHT-OF-WAY:
This portion of County Road 2 'A is under the jurisdiction of the City (municipality) of Brighton . The
municipality has jurisdiction over access to the road . The applicant shall delineate on the plat the future
and existing right-of-way and the physical location of the road . Pursuant to the definition of setback in the
Weld County Code, Sec. 23- 1 -90 , the required setback is measured from the future right-of-way line . Be
aware that physical roadways may not be centered in the right-of-way. Please contact the municipality to
verify the access permit or for any additional requirements that may be needed to obtain or upgrade the
permit.
MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) :
This site is located in a Municipal Separate Storm Sewer System (MS4) Area which may trigger specific
water quality requirements or other drainage improvements . In addition to compliance with applicable Weld
County regulations , property owner is required to be compliant with any additional MS4 requirements .
Questions pertaining to the MS4 requirements should be directed to the Public Works Department 970-
304-6496.
CONDITIONS OF APPROVAL:
The plat shall be amended to delineate the following :
This portion of County Road 2 '�� is under the jurisdiction of the City of Brighton . Please contact the
municipality to verify the right-of-way. Show and label the right-of-way. Show the approved access
on the site plan and label with the approved access permit number if applicable. ( Department of

DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1 . The property owner or operator shall be responsible for controlling noxious weeds on the
site, pursuant to Chapter 15 , Article I and II , of the Weld County Code. (Department of
Public Works)
2. The historical flow patterns and runoff amounts will be maintained on the site . ( Department
of Public Works)
3. This site is located in the MS4 area and is subject to the regulations of the state-issued
MS4 Permit. (Department of Public Works)
4. If applicable, once any permanent control measure has passed final inspection by Public
Works , the site shall be routinely inspected at a frequency determined by Public Works,
usually on an annual basis unless otherwise noted , for the life of the control measure.
Inspections occur to ensure the permanent control measure remains fully operational and
is being adequately► maintained according to the site's Operation and Maintenance Plan .
Upon sale of the property, the responsibility of maintaining permanent control measures

Prior to Construction :
The applicant shall notify Public Works of the anticipated start date and schedule a stormwater
inspection . If construction has commenced without contacting Public Works , the site will be in
violation , a stop work order will be issued , and further enforcement actions may be pursued .

During Construction :
Public Works shall be allowed to enter the premises to inspect temporary control measures (BMPs)
for proper installation and maintenance as detailed in the site's Grading Permit. Inspections occur
to ensure adequate measures are taken to protect the landowner, neighboring properties, adjacent
roadways and nearby waterways from the potentially adverse effects of stormwater runoff.
Inspections shall occur at a frequency determined by the site's compliance , with higher inspection
frequencies for non-compliance. (Department of Public Works )
Prior to Certificate of Occupancy:
The applicant shall submit an As- Built Drawing of each permanent control measure, signed and
stamped by a Professional Engineer registered in the State of Colorado . After the submittal , Public
Works shall be allowed to enter the premises to inspect the permanent control measure(s) to
confirm proper installation , as detailed in the drawing . (Department of Public Works)

Environmental Health Services has reviewed this proposal for a Change of Zone from the
(Agricultural ) Zone District to the 1-3 ( Industrial ) Zone District.
The site is served by a well permitted for domestic use ( 15374) and an on-site wastewater
treatment system permitted for 2 residences (SE- 1100029). The well and the OWTS will be
required to be repermitted for commercial use when a site plan review is submitted .
We recommend the following appear as notes on the plat :
1 . Water service may be obtained from an appropriately permitted well .
2 . The parcel is currently not served by a municipal sanitary sewer system . Sewage
disposal may be by septic systems designed in accordance with the regulations of the
Colorado Department of Public Health and Environment, Water Quality Control
Division and the Weld County Code in effect at the time of construction , repair,
replacement, or modification of the system .
. Activity or use on the surface of the ground over any part of the OWTS must be
restricted to that which shall allow the system to function as designed and which shall
not contribute to compaction of the soil or to structural loading detrimental to the
structural integrity or capability of the component to function as designed .
4 . During development of the site, all land disturbances shall be conducted so that
nuisance conditions are not created . If dust emissions create nuisance conditions , at
the request of Weld County► Environmental Health Services , a fugitive dust control plan
must be submitted .
5 . If land development exceeds 6 months in duration , the responsible party shall prepare a
fugitive dust control plan , submit an air pollution emissions notice application , and apply
for a permit from the Colorado Department of Public Health and Environment.

Dear Jamie Hartig:
We have received your November 6 , 2019 submittal concerning the above referenced proposal to rezone
a 1 , 17 - acre parcel located in the SW 1 / 4 of the NE 1 / 4, Township 1 North , Range 66 West, 6t" P. M, from
agricultural to heavy industrial,
This referral does not appear to qualify as a "subdivision " as defined in Section 30 -28 - 101 ( 10 ) (a ) , C . R. S .
Therefore, pursuant to the State Engineer's March 4 , 2005 and March 11 , 2011 memorandums to county
planning directors, this office will only perform a cursory review of the referral information and provide
informal comments. The comments do not address the adequacy of the water supply plan for this project
or the ability of the water supply plan to satisfy any County regulations or requirements. In addition , the
comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water .
Estimated water requirements and proposed uses were not provided , Waste is currently disposed of
through a septic tank. The proposed water source is an existing well, permit no . 15374 . Well permit no .
15374 was issued May 20 , 1963 pursuant to §37- 92 - 602 (3 ) , C . R. S . for a maximum pumping rate of 20 GPM
and for withdrawal from the alluvium . The use of well no . 15374 is limited to historic domestic uses in
existence before May 8 , 1972 that have continued since that time [provided such uses are no greater
than those uses allowed for a well permit pursuant to §37 - 92 - 602 ( 1 ) , C, R, S , which are: fire protection ,
ordinary household purposes inside not more than three single-family dwellings, the watering of poultry,
domestic animals and livestock on a farm or ranch , and the irrigation of not more than one acre of home
gardens and lawns] , According to the submitted material, one single -family dwelling was constructed on
the property in 1962 . The well, as permitted , cannot be used for industrial purposes. If the well is to
be used for industrial purposes, a permit allowing such uses must first be obtained . The ability for this
lot to obtain well permit(s) , and the allowed use(s) , will be determined at the time that well permit
application (s) are submitted to and reviewed by the State Engineer's Office.
